CIRCULAR

Specifies the list of state secrets of Confidential level in the field of

on natural resources and the environment

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

After reaching agreement with the Minister of Natural Resources and Environment, the Minister of Public Security shall issue a Circular specifying the list of state secrets of Confidential level in the field of natural resources and environment as follows:

Article 1. The list of state secrets of Confidential level in the field of natural resources and environment includes information within the following scope:

1. Regarding water resources including:

a) Documents on water quality that have a serious impact on public life, economy, and society but have not been published;

b) Maps of specialized water usage planning in regions related to borders at scales of 1:25,000 and larger;

c) Hydrogeological maps and underground water resource maps at scales of 1:10,000 and larger;

d) Data from investigations, assessments, surveys, and designs for important water resource exploitation, utilization, and protection projects related to national defense, security, and other economic sectors.

2. Regarding mineral geology including:

a) Coordinates and reserves of radioactive elements that have not been published;

b) Reserves of minerals included in the long-term national strategic reserve;

c) Geophysical data including absolute gravity field values and coordinates of gravity measurement points of various types;

d) Specialized geological and mineral maps prepared based on topographic maps according to the national coordinate system at scales of 1:10,000, 1:25,000, 1:50,000, and 1:100,000;

đ) Satellite images, aerial photographs of Vietnam showing locations of mines, factories, enterprises, industrial zones;

e) Unpublished or non-published assessment materials on mineral potential;

g) Exploration materials on radioactive minerals such as uranium and thorium that have not been approved by competent authorities and have not been published, except for common construction materials, mud coal, and limestone for cement;

h) Investigation, assessment, and exploration materials on radioactive minerals such as uranium and thorium that have not been published or non-published.

3. Regarding the environment including:

a) Information on cross-border environmental pollution issues related to national defense, security, economy, and society; information on environmental issues causing adverse effects on national interests; monitoring results of cross-border environmental pollution affecting national defense, security, economy, and society that have not been published or non-published;

b) Materials and samples collected through investigations, comprehensive national data on the consequences of chemical warfare on people and the environment in Vietnam that have not been published or non-published;

c) Comprehensive analysis data on dioxins conducted by Vietnamese laboratories that have not been published or non-published;

d) Data and contents of research programs, topics, and projects on remediation of chemical warfare consequences in Vietnam that have not been published or non-published;

đ) Procedures and technologies for handling and remedying environmental incidents related to national defense that have not been published or non-published.

4. Regarding Meteorology and Hydrology:

Basic investigation materials on marine meteorology and hydrology currently being processed and not yet published or non-published.

5. Regarding Surveying and Mapping including:

a) National surveying original data system including: Geodetic coordinates, astronomical coordinates, satellite coordinates, absolute gravity values, height values, depth values;

b) Aerial film and photographs including digital aerial film and photographs and scanned products with coordinate determination data exceeding 200 km2 in actual area;

c) Paper and digital topographic maps and geographic database at scales of 1:2,000, 1:5,000, 1:10,000, 1:25,000, 1:50,000, 1:100,000, with areas exceeding 200 km2;

d) Surveying and mapping materials of areas, targets, and objects under confidentiality.

6. Regarding Land:

Results of basic investigations on land resource evaluation that have not been published.

7. Regarding Marine and Island Areas:

a) National elevation mark files in Vietnam's marine and island regions;

b) Data, materials, diagrams, and specialized maps in marine geological surveys that have not been published;

c) Data on severe marine pollution caused by oil spills and other environmental incidents or natural disasters that have not been published due to lack of benefit to national interests;

d) Draft reports on current marine environmental conditions;

đ) Materials belonging to planning and adjustment files for marine and island use that have not been published, including:

- Analysis and synthesis materials on the demand for marine and island resource exploitation, utilization, and environmental protection;

- Analysis and assessment materials on natural advantages and limitations in developing the marine economy and protecting the environment to ensure national defense and security;

- Reports and tables summarizing directions for exploiting and utilizing various marine and island resources for planning development;

- Plans for using priority marine areas for economic development, areas with favorable conditions, prohibited areas, and special protected areas to ensure national defense and security;

- Maps of plans for using marine resources and protecting the marine environment.

e) Comprehensive monitoring data on marine resources and the environment that have not been published;

g) Scientific materials for naming islands that have not been published;

h) Operation and exploitation plans for state-budget-funded research and basic investigation equipment for marine resources and the environment;

i) Analysis and synthesis materials on international cooperation in managing marine resources and protecting the marine environment that have not been published;

k) Data and contents of research programs, topics, and projects on the impact of radiation in marine water environments that have not been published.

8. Design regulations, technical information about internal computer network security and safety protection;

9. Scientific research works, inventions, useful solutions, and particularly important trade secrets in the field of natural resources and environment; research works on natural resources and the environment related to national defense and security that have not been published.

10. Documents, programs, projects, research topics on information technology in the field of natural resources and environment related to national security, defense, and socio-economic development of Vietnam that have not been published.

11. Accounting and statistical documents in the field of natural resources and environment that have not been published.

12. Files of leaders at the Department level and higher within Ministries, documents concerning planning, promotion, disciplinary actions against officials, and internal political issues that have not been published.

13. Inspection and audit documents; inspection and audit conclusions; results of handling complaints and petitions that have not been published.

14. Documents using information and materials classified as Secret in the State Secrets List of agencies, units, and organizations inside and outside the Ministry of Natural Resources and Environment.

Article 2. Effective Date

This Circular takes effect from June 24, 2013.

This Circular replaces Decision No. 919/2004/QĐ-BCA(A11) dated November 21, 2003 of the Minister of Public Security regarding the List of State Secrets classified as Secret in the field of natural resources and environment.

Article 3. Implementation Organization

1. The Ministry of Natural Resources and Environment and the Ministry of Public Security shall be responsible for inspecting and guiding the implementation of this Circular.

2. Ministries, ministerial-level agencies, agencies under the Government; People's Committees of provinces and centrally governed cities shall be responsible for implementing this Circular./.
