DETAILING THE IMPLEMENTATION OF CLAUSE 3, ARTICLE 54 OF THE LABOR CODE ON THE ISSUANCE OF PERMITS FOR TEMPORARY EMPLOYMENT AGENCIES, SECURITY DEPOSITS, AND THE LIST OF JOBS THAT CAN BE HANDLED THROUGH TEMPORARY EMPLOYMENT AGENCIES
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Labor Code dated June 18, 2012;
Pursuant to the Investment Law dated November 26, 2014;
Pursuant to the Enterprise Law dated December 8, 2014;

The Government issues this Decree detailing the implementation of Clause 3, Article 54 of the Labor Code on the issuance of permits for temporary employment agencies, security deposits, and the list of jobs that can be handled through temporary employment agencies,
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates conditions, authority, procedures, and formalities for issuing, extending, reissuing, and revoking permits for temporary employment agencies (hereinafter referred to as permits); the security deposit of temporary employment agencies; and the list of jobs that can be handled through temporary employment agencies as prescribed in Clause 3, Article 54 of the Labor Code.
Article 2. Applicability
1. Temporary employment agency.
2. Employer.
3. Leased worker.
4. Other agencies, organizations, and individuals related to the activities of temporary employment agencies.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. A temporary employment agency is an enterprise established in accordance with the provisions of the Enterprise Law, which has been granted a permit for temporary employment agency operations, recruits and signs labor contracts but does not directly employ workers but instead leases them to other employers (hereinafter referred to as the leasing company).
2. An employer is an enterprise, agency, organization, cooperative, household, or individual with a need to use workers for a specific period without directly recruiting them but instead leasing them from a temporary employment agency.
3. A leased worker is a worker with full capacity for civil acts, recruited and signed a labor contract by a temporary employment agency, then works and is managed by the employer.
Article 4. Purpose of leasing workers
1. To meet temporarily the sudden increase in demand for labor during a specific period.
2. To replace workers during maternity leave, work-related accidents, occupational diseases, or when performing civic duties.
3. To have a need for highly skilled technical workers.
Chapter II
CONDITIONS, AUTHORITY, PROCEDURES, AND FORMALITIES FOR ISSUING, EXTENDING, REISSUING, AND REVOKING PERMITS
Article 5. Conditions for Issuing Permits
1. The legal representative of the enterprise conducting temporary employment agency activities must satisfy the following conditions:
a) Being a manager of the enterprise;
b) Having no criminal record;
c) Having worked in the field of temporary employment agency or labor supply for at least three years (36 months) within the five consecutive years prior to applying for a permit.
2. The enterprise must have deposited a security deposit of 2,000,000,000 Vietnamese dong (two billion Vietnamese dong) at a commercial bank or a branch of a foreign bank legally established and operating in Vietnam.
Article 6. Authority to Issue, Extend, Reissue, and Revoke Permits
The Chairman of the People's Committee of the province or centrally governed city (hereinafter collectively referred to as the Chairman of the Provincial People's Committee) where the enterprise's main office is located has the authority to issue, extend, reissue, and revoke permits for enterprises.
Article 7. Permit for Labor Leasing Activities
1. The permit for labor leasing activities shall be printed on stiff paper with A4 size (21 cm x 29.7 cm); the front side shall bear the content of the permit on a white background with blue floral patterns, featuring an embossed national emblem and a black border; the back side shall have the national emblem, national emblem, and the phrase "PERMIT FOR LABOR LEASING ACTIVITIES" printed on a blue background.
2. The content of the permit for labor leasing activities shall be in accordance with Model No. 01 prescribed in Appendix II issued together with this Decree.
3. The validity period of the permit shall be stipulated as follows:
a) The maximum validity period of the permit is 60 months;
b) The permit may be renewed multiple times, each renewal having a maximum validity period of 60 months;
c) The validity period of the newly issued permit shall be equal to the remaining validity period of the previously issued permit.
Article 8. Documents for Application for a Permit
1. The enterprise's application for a permit according to Model No. 02 prescribed in Appendix II issued together with this Decree.
2. A copy of the Enterprise Registration Certificate in accordance with the provisions of the law.
3. The self-declaration resume of the legal representative of the enterprise according to Model No. 04 prescribed in Appendix II issued together with this Decree.
4. Criminal record sheet No. 1 in accordance with the law on criminal records of the legal representative of the enterprise. In cases where the legal representative is a foreigner not eligible for a Vietnamese criminal record sheet, Criminal Record Sheet No. 1 shall be replaced by a criminal record sheet or a confirmation document from abroad stating that the foreign worker is not a convicted person or subject to criminal prosecution.
The above documents must be issued no more than six months prior to submission of the application.
5. A document proving the working period of the legal representative of the enterprise as prescribed in Point c Clause 1 Article 5 of this Decree shall be one of the following types of documents:
a) A certified copy of the labor contract or employment contract of the legal representative of the enterprise;
b) A certified copy of the appointment decision (for those appointed) or the recognition document of the election result (for those elected) of the legal representative of the enterprise.
In cases where the documents prescribed in Points a and b of this Clause are in a foreign language, they must be translated into Vietnamese.
6. Certificate of deposit for labor leasing business according to Model No. 05 prescribed in Appendix II issued together with this Decree.
Article 9. Procedures for Issuing a Permit
1. The enterprise shall submit a set of documents as prescribed in Article 8 of this Decree to the Department of Labor, Invalids and Social Affairs of the province or centrally-administered city (hereinafter referred to as the Department of Labor, Invalids and Social Affairs) where the enterprise's main office is located to apply for a permit.
2. The application for a permit shall be accepted when all required documents as prescribed in Article 8 of this Decree are complete. After accepting the documents, the Department of Labor, Invalids and Social Affairs shall issue a receipt clearly indicating the date, month, and year of receipt of the documents.
3. Within twenty working days from the date of receiving the complete documents, the Department of Labor, Invalids and Social Affairs shall review and submit the permit application for labor leasing activities of the enterprise to the Chairman of the People's Committee of the province.
If the documents do not meet the requirements, within ten working days from the date of receiving the documents, the Department of Labor, Invalids and Social Affairs shall issue a document requesting the enterprise to complete the documents.
4. Within seven working days from the date of receiving the submitted documents, the Chairman of the People's Committee of the province shall examine and issue the permit to the enterprise; if the permit is not granted, a reply document shall be issued to the enterprise specifying the reasons for not granting the permit.
5. The Chairman of the People's Committee of the province shall not grant a permit to the enterprise in the following cases:
a) Not meeting the conditions prescribed in Article 5 of this Decree;
b) Using a fake permit to conduct labor leasing activities;
c) Having a legal representative who was previously the legal representative of an enterprise whose permit for labor leasing activities was revoked according to Points d, đ, e, and g Clause 1 Article 12 of this Decree within five consecutive years prior to applying for a permit for labor leasing activities;
d) Having a legal representative who was previously the legal representative of an enterprise using a fake permit.
Article 10. Extension of License
1. Enterprises seeking to extend their license must ensure the following provisions:
a) Ensuring the conditions stipulated in Article 5 of this Decree;
b) Not being subject to administrative penalties in the field of labor leasing for two or more times during the validity period of the immediately preceding license;
c) Fully complying with the reporting regime prescribed in this Decree;
d) The application for extension of the license must be submitted to the Department of Labor, Invalids and Social Affairs sixty working days before the expiration date of the current license.
2. Documents required for the application for extension of the license include:
a) The enterprise's request for extension of the license according to Model No. 02 specified in Appendix II issued together with this Decree;
b) The documents stipulated in Clause 2 and Clause 6 of Article 8 of this Decree;
c) The documents stipulated in Clauses 3, 4 and 5 of Article 8 of this Decree in cases where the enterprise requests an extension of the license while simultaneously changing the legal representative of the enterprise.
3. The procedures and formalities for extending the license shall be carried out in accordance with the procedures and formalities for issuing licenses as stipulated in Clauses 1, 2, 3 and Clause 4 of Article 9 of this Decree.
4. For enterprises that do not meet the requirements set forth in Clause 1 of this Article or fall under the circumstances stipulated in Clause 5 of Article 9 of this Decree, the Chairman of the Provincial People's Committee shall respond in writing to the enterprise, stating the reasons for not extending the license.
Article 11. Reissuance of License
1. Enterprises may request the Chairman of the Provincial People's Committee to reissue the license in the following cases:
a) Changing one of the contents of the previously issued license, including: the name of the enterprise; the main office address; the legal representative of the enterprise;
b) Loss or destruction of the license;
c) Damage to the license rendering it incomplete.
2. Documents required for the application for reissuance of the license are as follows:
a) The enterprise's request for reissuance of the license according to Model No. 02 specified in Appendix II issued together with this Decree;
b) The document stipulated in Clause 2 of Article 8 of this Decree in cases of changing the name of the enterprise, the main office address or damage to the license rendering it incomplete;
c) The documents stipulated in Clauses 2, 3, 4 and Clause 5 of Article 8 of this Decree in cases of changing the legal representative of the enterprise;
d) The documents stipulated in Clauses 2, 3, 4, 5 and Clause 6 of Article 8 of this Decree and a certificate from the local authority confirming the loss or destruction of the license in cases of loss or destruction of the license;
đ) The previously issued license in cases stipulated in point a and point c of Clause 1 of this Article.
3. The procedures and formalities for reissuing the license shall be carried out in accordance with the procedures and formalities for issuing licenses as stipulated in Article 9 of this Decree.
Article 12. Revocation of License
1. Enterprises will have their licenses revoked in the following cases:
a) Ceasing labor leasing activities at the enterprise's request;
b) The enterprise is dissolved or declared bankrupt by the Court;
c) Failing to meet one of the conditions stipulated in Article 5 of this Decree;
d) Allowing other enterprises, organizations, or individuals to use the license;
đ) Leasing labor for work not included in the list of works permitted for labor leasing as specified in Appendix I issued together with this Decree;
e) Being subject to administrative penalties in the field of labor leasing three or more times within a maximum period of thirty-six months from the first penalty date;
g) Engaging in fraudulent acts involving falsification of documents in the application for issuance, extension, or reissuance of the license, or tampering with the content of the issued license, or using a fake license;
h) Other cases as required by the Court.
2. Documents required for the application for revocation of the license in cases stipulated in points a and b of Clause 1 of this Article include:
a) The enterprise's request for revocation of the license according to Model No. 03 specified in Appendix II issued together with this Decree;
b) The previously issued permit;
c) A report on the enterprise's labor leasing activities according to Model No. 09 specified in Appendix II issued together with this Decree.
3. The procedures and formalities for revoking the license in cases stipulated in points a and b of Clause 1 of this Article are as follows:
a) The enterprise submits a complete set of documents as stipulated in Clause 2 of this Article to the Department of Labor, Invalids and Social Affairs where the enterprise is headquartered;
b) The Department of Labor, Invalids and Social Affairs receives the documents, checks them, and issues a receipt noting the date of full receipt of the documents. Within ten working days from the date of full receipt of the revocation application, the Department of Labor, Invalids and Social Affairs reviews the valid labor leasing contracts of the enterprise and reports to the Chairman of the Provincial People's Committee to revoke the license;
c) Within seven working days from the date of receipt of the report from the Department of Labor, Invalids and Social Affairs, the Chairman of the Provincial People's Committee decides to revoke the license. The decision to revoke the license is made according to Model No. 06 specified in Appendix II issued together with this Decree.
4. The procedures and formalities for revoking the license in cases stipulated in points c, d, đ, e, g and h of Clause 1 of this Article are as follows:
a) When discovering that the enterprise falls under the circumstances stipulated in points c, d, đ, e, g and h of Clause 1 of this Article, the Department of Labor, Invalids and Social Affairs conducts inspections, collects relevant evidence, and reports to the Chairman of the Provincial People's Committee to revoke the license;
b) Within seven working days from the date of receipt of the report from the Department of Labor, Invalids and Social Affairs, the Chairman of the Provincial People's Committee decides to revoke the license of the enterprise;
c) Within three working days from the date of receipt of the revocation decision, the enterprise has the responsibility to return the license to the Provincial People's Committee.
5. A business shall not be granted a license within five years from the date of revocation of its license in cases where the license is revoked pursuant to points c, d, đ, e, g, and point h of Clause 1 of this Article.
Article 13. Responsibilities of businesses in cases where licenses are revoked or not renewed or reissued
1. Within fifteen working days from the date of receipt of the document issued by the Chairman of the Provincial People's Committee regarding non-renewal, non-reissuance, or revocation of the license, the leasing business shall settle all ongoing labor dispatch contracts, resolve the legitimate rights and interests of dispatched workers and receiving entities in accordance with labor laws, and simultaneously publish the cessation of labor dispatch operations on an online news website for seven consecutive days.
2. The leasing business shall be responsible for arranging employment for dispatched workers according to signed labor contracts. In cases where workers must stop work, the employer of the leasing business must pay suspension wages in accordance with Clause 1 of Article 98 of the Labor Code.
Chapter III
SECURITY DEPOSIT OF LABOR LEASING BUSINESSES
Article 14. Use of Security Deposit
The security deposit shall be used to pay wages, allowances, social insurance, health insurance, unemployment insurance, occupational accident insurance, occupational disease insurance, or compensation to dispatched workers in cases where the leasing business breaches the labor contract with dispatched workers or causes damage to dispatched workers due to failure to ensure their legitimate rights and interests.
Article 15. Payment of Security Deposit
1. Leasing businesses shall complete the procedures for paying the security deposit in accordance with bank regulations and comply with relevant laws.
2. The bank accepting the security deposit shall issue a certificate of the security deposit for labor leasing activities based on Model No. 05 stipulated in Appendix II accompanying this Decree after the leasing business has completed the security deposit procedures. In case of changes to any information on the certificate of the security deposit for labor leasing activities, including: business name; main office address; deposit account number, the leasing business shall submit a request letter and supporting documents proving the change of information to the bank accepting the security deposit to update the certificate of the security deposit for labor leasing activities.
Article 16. Management of Security Deposit
1. The bank accepting the security deposit shall freeze the entire amount of the security deposit of the business and manage it in accordance with the provisions of this Decree and the regulations on security deposits.
2. The bank accepting the security deposit shall allow the business to withdraw the security deposit, deduct from the security deposit, and require the business to replenish the security deposit in accordance with the provisions of Articles 17, 18, and 19 of this Decree.
3. The bank accepting the security deposit shall not allow the business to withdraw the security deposit without written approval from the Chairman of the Provincial People's Committee.
Article 17. Withdrawal of Security Deposit
1. The Chairman of the Provincial People's Committee shall decide to permit the business to withdraw the security deposit in the following cases:
a) The leasing business encounters temporary difficulties and is unable to pay wages, allowances, social insurance, health insurance, unemployment insurance, occupational accident insurance, and occupational disease insurance to dispatched workers as prescribed by law after thirty days from the payment deadline;
b) The leasing business encounters temporary difficulties and is unable to compensate dispatched workers in cases where the business breaches the labor contract with dispatched workers or causes damage to dispatched workers due to failure to ensure their legitimate rights and interests after sixty days from the compensation deadline;
c) The business is not granted a license;
d) The leasing business is revoked its license or is not granted a renewal or reissue of the license;
đ) The leasing business has already deposited the security deposit at another commercial bank.
2. Documents for requesting withdrawal of the security deposit submitted to the Department of Labor, Invalids, and Social Affairs include:
a) A request letter for withdrawing the security deposit signed by the authorized representative of the business;
b) A plan for using the withdrawn funds from the security deposit account, including: reasons and purpose for withdrawing the security deposit; list of dispatched workers, quantity, amount, time, and method of payment for cases specified in points a and b of Clause 1 of this Article;
c) Report on fulfilling obligations and proof of fulfillment of obligations to dispatched workers for cases specified in point d of Clause 1 of this Article;
d) Certificate of the security deposit for labor leasing activities at another commercial bank for cases specified in point đ of Clause 1 of this Article.
3. Documents for withdrawing the security deposit submitted to the bank accepting the security deposit include:
a) A request letter for withdrawing the security deposit signed by the authorized representative of the business;
b) Approval letter for withdrawing the security deposit from the Chairman of the Provincial People's Committee based on Model No. 07 stipulated in Appendix II accompanying this Decree;
c) Withdrawal documents for the security deposit as required by the bank accepting the security deposit (if applicable).
4. The procedure for withdrawing the security deposit shall be carried out as follows:
a) The leasing business shall submit one set of documents as prescribed in Clause 2 of this Article to the Department of Labor, Invalids, and Social Affairs at the location of the business's main office;
b) The Department of Labor, Invalids, and Social Affairs shall accept the documents, check them, and issue a receipt noting the date, month, and year when the complete set of documents was received. Within five working days from the date of receipt of the complete set of documents requesting withdrawal of the security deposit, the Department of Labor, Invalids, and Social Affairs shall verify the completion of obligations to dispatched workers by the leasing business and submit a request to the Chairman of the Provincial People's Committee to approve the withdrawal of the security deposit by the business;
c) Within five working days from the date of receipt of the submission from the Department of Labor, Invalids, and Social Affairs, the Chairman of the Provincial People's Committee shall issue an approval letter for withdrawing the security deposit and the plan for using the security deposit (if applicable) and send it to the business and the bank accepting the security deposit.
d) After receiving the approval document for withdrawing the deposit from the Chairman of the Provincial People's Committee, the leasing enterprise shall submit the dossier in accordance with Clause 3 of this Article to the bank accepting the deposit.
đ) The bank accepting the deposit receives and examines the withdrawal dossier of the enterprise. If it is lawful and valid, the bank accepting the deposit allows the enterprise to withdraw the deposit. In cases of withdrawing the deposit as stipulated at points a and b of Clause 1 of this Article, the payment and compensation to the workers shall be directly paid by the bank accepting the deposit according to the plan approved by the Chairman of the Provincial People's Committee after deducting banking service fees.
Article 18. Withdrawing the Deposit when the Leasing Enterprise Fails to Fulfill Obligations towards Rehired Workers
1. Withdraw the deposit of the enterprise to pay the benefits and rights for rehired workers as prescribed in Article 14 of this Decree if, within 60 days from the due date of payment, the enterprise does not make the payment and does not request to withdraw the deposit to pay the benefits and rights for rehired workers.
2. The Department of Labor, Invalids, and Social Affairs is responsible for checking, verifying, and requesting the leasing enterprise to report the list of rehired workers, the amount unpaid, and compensation for each worker. Within five working days from the date of receipt of the request from the Department of Labor, Invalids, and Social Affairs, the leasing enterprise must complete the aforementioned reporting. Within three working days from the date of receipt of the enterprise's report, the Department of Labor, Invalids, and Social Affairs will compile and submit to the Chairman of the Provincial People's Committee for a decision on withdrawing the enterprise's deposit to implement the payment as prescribed in Clause 1 of this Article.
3. Within five working days from the date of receipt of the request from the Department of Labor, Invalids, and Social Affairs, the Chairman of the Provincial People's Committee decides to withdraw the enterprise's deposit. The decision to withdraw the deposit follows Model No. 08 prescribed in Appendix II issued together with this Decree.
4. Within seven working days from the date of receipt of the decision of the Chairman of the Provincial People's Committee on withdrawing the deposit, the bank accepting the deposit shall withdraw the deposit of the enterprise and directly pay according to the plan and list attached to the decision of the Chairman of the Provincial People's Committee after deducting banking service fees.
5. The Department of Labor, Invalids, and Social Affairs is responsible for supervising the implementation of payments and compensations to rehired workers as prescribed in Clause 1 of this Article and reporting the results to the Provincial People's Committee.
Article 19. Supplementing the Deposit
1. Within thirty days from the date the money is withdrawn from the deposit account for payment as prescribed in points a and b of Clause 1 of Articles 17 and 18 of this Decree, the enterprise must supplement the deposit in accordance with Clause 2 of Article 5 of this Decree.
2. After the deadline prescribed in Clause 1 of this Article, if the leasing enterprise fails to fully supplement the deposit, the bank accepting the deposit has the responsibility to notify in writing the Department of Labor, Invalids, and Social Affairs and the Provincial People's Committee.
Chapter IV
WORK PERFORMED THROUGH LABOR LEASING
Article 20. List of jobs to be performed under labor leasing
1. The list of jobs to be performed under labor leasing is specified in Appendix I attached to this Decree.
2. Labor leasing shall be carried out for jobs listed in Clause 1 of this Article and must comply with the provisions of Article 4 and Article 21 of this Decree.
Article 21. Cases where labor leasing is not allowed
1. When the leasing enterprise or the employer is involved in labor disputes, strikes, or leases labor to replace workers who are on strike or resolving labor disputes.
2. When the leasing enterprise does not specifically agree with the employer on the responsibility for compensating work-related accidents or occupational diseases of the leased workers.
3. Without the consent of the leased worker.
4. To replace workers who have been dismissed due to changes in organizational structure, technology, mergers, consolidations, divisions, or spin-offs of enterprises for economic reasons.
Chapter V
IMPLEMENTING PROVISIONS
Article 22. Responsibilities of the leasing enterprise
1. Publicly display the original license at its main office and certified copies of the original license at branch offices and representative offices (if any) of the leasing enterprise.
2. Report semi-annually and annually on the situation of labor leasing according to Model No. 09 prescribed in Appendix II attached to this Decree to the People's Committee of the province and the Department of Labor, Invalids and Social Affairs where the leasing enterprise is headquartered. Semi-annual reports are submitted before June 20th and annual reports are submitted before December 20th.
3. Promptly report any incidents related to labor leasing activities to the competent state agencies at the local level or upon request of the state management agency on labor.
4. Fully implement the responsibilities of the leasing enterprise as stipulated in this Decree.
Article 23. Responsibilities of the bank receiving the guarantee deposit
1. Properly implement regulations on opening guarantee accounts, depositing guarantee funds, using guarantee accounts of the leasing enterprise, and other relevant regulations concerning these accounts.
2. Report quarterly on the implementation of guarantee deposits by the leasing enterprise according to Model No. 11 prescribed in Appendix II attached to this Decree to the People's Committee of the province and the Department of Labor, Invalids and Social Affairs where the leasing enterprise is headquartered before the 15th day of the first month of each quarter.
3. Fully implement the responsibilities of the bank receiving the guarantee deposit as stipulated in this Decree.
Article 24. Responsibilities of the Provincial Department of Labor, Invalids and Social Affairs
1. Promote and disseminate laws and regulations on labor and labor leasing to employers, workers, and relevant agencies and organizations within their jurisdiction.
2. Guide, inspect, audit, and supervise the implementation of laws and regulations on labor leasing within their jurisdiction.
3. Monitor, compile, and report semi-annually and annually on the situation of labor leasing within their management area according to Model No. 10 prescribed in Appendix II attached to this Decree to the Ministry of Labor, Invalids and Social Affairs and the People's Committee of the province. Semi-annual reports are submitted before July 20th and annual reports are submitted before January 20th of the following year.
4. Fully implement the responsibilities of the Provincial Department of Labor, Invalids and Social Affairs as stipulated in this Decree.
Article 25. Responsibilities of Provincial People's Committees
1. Notify the issuance, extension, reissue, or revocation of licenses to the Ministry of Labor, Invalids and Social Affairs within five working days from the date of issuance, extension, reissue, or revocation of the license for monitoring and management.
2. Announce enterprises that have been issued, extended, reissued, or had their licenses revoked for labor leasing activities on the website of the People's Committee of the province.
3. Fully implement the responsibilities of the People's Committee of the province as stipulated in this Decree.
Article 26. Responsibilities of the Ministry of Labor, Invalids and Social Affairs
1. Promote, disseminate, guide, inspect, and audit the implementation of labor laws on labor leasing.
2. Inspect, audit, and supervise the issuance, extension, reissue, or revocation of licenses by the People's Committee of the province.
3. Compile and publicize enterprises that have been issued, extended, reissued, or had their licenses revoked on the website of the Ministry of Labor, Invalids and Social Affairs.
4. Compile and report on the operation of labor leasing nationwide.
5. Fully implement the responsibilities of the Ministry of Labor, Invalids and Social Affairs as stipulated in this Decree.
Article 27. Transitional Provisions
Enterprises that have been granted licenses prior to the effective date of this Decree shall proceed as follows:
1. Continue to carry out labor leasing activities until the license expires.
2. Enterprises that fall under the cases of license renewal or reissuance as stipulated in Articles 10 and 11 of this Decree shall obtain new licenses in accordance with this Decree.
3. Enterprises that fall under the cases of license revocation shall have their licenses revoked by the People's Committee of the province where the enterprise is headquartered in accordance with Article 12 of this Decree.
Article 28. Effective Date
1. This Decree takes effect from May 5, 2019.
2. The Decrees No. 55/2013/NĐ-CP dated May 22, 2013 of the Government detailing the implementation of Clause 3 Article 54 of the Labor Code on granting permission for labor dispatch activities, depositing guarantees, and the list of jobs that can be performed through labor dispatch; Decree No. 73/2014/NĐ-CP dated July 23, 2014 of the Government amending and supplementing Article 29 of Decree No. 55/2013/NĐ-CP dated May 22, 2013 of the Government detailing the implementation of Clause 3 Article 54 of the Labor Code on granting permission for labor dispatch activities, depositing guarantees, and the list of jobs that can be performed through labor dispatch; Circular No. 01/2014/TT-BLĐTBXH dated January 8, 2014 of the Minister of Labor, Invalids and Social Affairs detailing and guiding the implementation of certain provisions of Decree No. 55/2013/NĐ-CP dated May 22, 2013 of the Government detailing the implementation of Clause 3 Article 54 of the Labor Code on granting permission for labor dispatch activities, depositing guarantees, and the list of jobs that can be performed through labor dispatch; Circular No. 40/2014/TT-NHNN dated December 11, 2014 of the Governor of the State Bank of Vietnam guiding the depositing of guarantees and the management of guarantee money of enterprises engaged in labor dispatch cease to be effective from the date this Decree takes effect.
Article 29. Responsibility for Implementation
The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under central cities, and related agencies, organizations, enterprises, cooperatives, and individuals shall be responsible for implementing this Decree./.
