CIRCULAR
Regulations on the annual reporting system within the scope of state management
of the Ministry of Natural Resources and Environment
Pursuant to Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government stipulating the reporting system of administrative agencies;
On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the request of the Director of the Office of the Ministry of Natural Resources and Environment;
The Minister of Natural Resources and Environment issues this Circular to regulate the annual reporting system within the scope of state management of the Ministry of Natural Resources and Environment.
Chapter I.
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular stipulates the annual reporting system within the scope of state management of the Ministry of Natural Resources and Environment:
a) Reports evaluating the implementation of natural resource and environmental management tasks by provincial People's Committees (referred to as provincial-level People's Committees);
b) Reports evaluating the implementation of natural resource and environmental management tasks by Ministries and ministerial-level agencies.
2. This Circular does not regulate: the statistical reporting system as prescribed by law and the confidential reporting system as prescribed by law on state secrets.
Article 2. Applicability
Ministries, ministerial-level agencies, provincial-level People's Committees, and organizations and individuals related to the implementation of the annual reporting system within the scope of state management of the Ministry of Natural Resources and Environment.
Article 3. Principles of Reporting
1. Reporting must be complete, accurate, objective, timely, and in accordance with the format and content requirements of each type of report; comply with the provisions of laws on natural resources and environment and the guidance provided in this Circular. The person signing the report must ensure compliance with the appropriate authority, suitable for each type of report and the functions, tasks, and powers of the reporting agency.
2. Ensure clarity, transparency, provision, and sharing of information and data from reports, security, and confidentiality of information according to the law; ensure the ability to apply information technology to meet the requirements of the National Reporting Information System.
Article 4. Reporting Information System
1. The reporting information system of the Ministry of Natural Resources and Environment connects from central to local levels to facilitate electronic reporting, serving the processing, summarizing, and timely sharing of reporting information, enhancing efficiency and saving time and costs.
2. The reporting information system of the Ministry of Natural Resources and Environment connects with the National Reporting Information System, of other ministries, sectors, and localities, comprising two subsystems: the natural resources and environment reporting subsystem and the subsystem connecting with the National Reporting Information System.
Chapter II.
REPORTING SYSTEM
Article 5. Requirements for Reporting
1. Reports must ensure necessity to serve the management, direction, and operation objectives of administrative state agencies and those with authority.
2. Reports must clearly identify issues requiring focused reporting, difficulties, obstacles, causes, and recommendations (if any).
3. Depending on specific cases, reports may consist solely of narrative parts or include both narrative and numerical data parts.
Article 6. Content of Reports
1. Annual reports evaluating the implementation of natural resource and environmental management tasks by provincial-level People's Committees shall be carried out according to the outline specified in Appendix I attached to this Circular.
2. Annual reports evaluating the implementation of natural resource and environmental management tasks by Ministries and ministerial-level agencies shall be carried out according to the outline specified in Appendix II attached to this Circular.
Article 7. Time for finalizing data in reports
The time for finalizing data in periodic reports as prescribed in Article 6 of this Circular shall be from December 15 of the year preceding the reporting period to December 14 of the reporting period.
Article 8. Forms of report, methods of submitting reports, and deadlines for submission
1. Reports shall be carried out in one of the following two forms:
a) Written report on paper, signed by the head of the agency, organization, or unit, and stamped according to regulations;
b) Electronic written report, using digital signature of the head of the agency, organization, or unit.
2. Reports shall be submitted to the receiving entity through one of the following methods:
a) Direct delivery/receipt;
b) Delivery/receipt via postal service;
c) Delivery/receipt via fax;
d) Delivery/receipt via email system;
e) Delivery/receipt via other methods as prescribed by law;
g) Updating through the Environmental Information Reporting System of the Ministry of Natural Resources and Environment;
h) Updating through the System for State Management, Guidance, and Operation of the Ministry of Natural Resources and Environment.
3. Deadline for submitting reports:
a) Ministries, ministerial-level agencies, and provincial People's Committees shall submit the Report as prescribed in Article 6 of this Circular to the Ministry of Natural Resources and Environment before December 20 each year;
b) Data in periodic reports as prescribed in Article 7 of this Circular shall be updated and submitted to the Ministry of Natural Resources and Environment before January 31 of the following year. Updated periodic reports may replace periodic reports prescribed in specialized legal documents.
Chapter III
IMPLEMENTING PROVISIONS
Article 9. Effective Date
This Circular takes effect from February 18, 2020.
Article 10. Responsibility for Implementation
1. Ministries, ministerial-level agencies, provincial People's Committees, and related organizations and individuals are responsible for implementing this Circular.
2. During implementation, if there are difficulties, it is requested that relevant agencies, organizations, and individuals promptly reflect them to the Ministry of Natural Resources and Environment for appropriate amendments and supplements./.
