Pursuant to Decree No. 43/2023/NĐ-CP dated June 30, 2023 of the Government detailing certain provisions and implementing measures of the Inspection Law;
Pursuant to Decree No. 03/2024/NĐ-CP dated January 11, 2024 of the Government on specialized inspection agencies and activities of agencies assigned to perform specialized inspection functions;
BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;
At the proposal of the Inspector General of the Ministry of Transport;
The Minister of Transport hereby stipulates the conditions, standards, uniforms, and inspection cards for specialized inspectors assigned to perform specialized inspection tasks in the field of transportation (hereinafter referred to as specialized inspection officials); the functions and powers of agencies performing inspection functions in the field of transportation.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the conditions, standards, uniforms, and inspection cards for specialized inspectors assigned to perform specialized inspection tasks in the field of transportation (hereinafter referred to as specialized inspection officials); the functions and powers of agencies performing inspection functions in the field of transportation.
Article 2. Applicability
This Circular applies to the Inspectorate of the Ministry of Transport; the Inspectorate of the Civil Aviation Authority of Vietnam; the Inspectorate of the Vietnam Maritime Administration; the Inspectorate of the Department of Transport; the Bureaus: Vietnam Highway Administration, Vietnam Inland Waterway Administration, Vietnam Registration Bureau, Vietnam Railway Administration (hereinafter referred to as agencies assigned to perform specialized inspection functions under the Ministry of Transport); inspectors, specialized inspection officials, and other organizations and individuals related thereto.
Chapter II
CONDITIONS AND STANDARDS FOR SPECIALIZED INSPECTION OFFICIALS IN THE FIELD OF TRANSPORTATION
TRANSPORTATION INDUSTRY
Article 3. Conditions and standards for specialized inspection officials
1. Specialized inspection officials are civil servants belonging to the advisory organization assisting the head of the agency assigned to perform specialized inspection functions under the Ministry of Transport; units directly subordinate to the agency assigned to perform specialized inspection functions under the Ministry of Transport.
2. Specialized inspection officials must meet the conditions and standards prescribed in Clause 3, Article 38 of the Inspection Law and the following conditions and standards:
a) Specialized inspection officials of the Vietnam Highway Administration, Vietnam Railway Administration, and Vietnam Inland Waterway Administration must have a university degree or higher education that is suitable for the job requirements in one of the fields related to transportation, construction, architecture, mechanical engineering, information technology, telecommunications, law, economics, finance;
b) Specialized inspection officials of the Vietnam Registration Bureau must have a university degree or higher education that is suitable for the job requirements in one of the technical fields related to vehicle registration, transportation equipment, or one of the fields related to law, finance.
Article 4. Allocation and De-allocation of Professional Inspectors
1. The head of the agency entrusted with the function of specialized inspection under the Ministry of Transport decides on the allocation and de-allocation of professional inspectors based on the proposal of the Head of the advisory unit for specialized inspection work.
2. The dossier for proposing the allocation of professional inspectors includes:
a) The proposal for allocating professional inspectors issued by the Head of the advisory unit for specialized inspection work;
b) The original or certified copy of the following documents: decision on appointment to the inspector rank; academic certificates corresponding to the conditions and standards of professional inspectors as stipulated in Clause 2, Article 3 of this Circular; certificates or training and refresher course certificates in inspection business.
3. A professional inspector shall be de-allocated from their position when they fall into one of the following cases: termination of employment; retirement; transfer to another agency or unit unrelated to the field assigned to perform specialized inspection tasks; failure to complete duties for one year at the current inspector rank; dishonest declaration in the dossier for proposing the allocation of professional inspectors; committing prohibited acts as prescribed in Article 8 of the Inspection Law; being convicted by a court and the judgment or decision having taken legal effect; due to health reasons, family circumstances, or other reasons that prevent them from continuing to perform the duties of a professional inspector.
4. The decision on the allocation and de-allocation of professional inspectors must include the following basic information: basis for issuance; name, inspector rank, current position held; field assigned to perform specialized inspection tasks; reason for de-allocating professional inspectors (for de-allocation decisions).
Chapter III
DRESS CODE FOR PROFESSIONAL INSPECTORS
Article 5. Dress Code for Professional Inspectors
1. The dress code for professional inspectors of agencies entrusted with the function of specialized inspection under the Ministry of Transport includes: trousers, shirts (winter, spring-summer); leather belt; leather shoes; backless sandals; socks; tie; raincoat; rubber boots; helmet; document case; kepi hat; spruce branch; nameplate; insignia.
The dress code model for professional inspectors is specified in Appendix I attached to this Circular.
2. Based on specific regional conditions and the nature of work, professional inspectors are provided with labor protective equipment in accordance with the law.
3. The specifications and colors of the dress code for professional inspectors shall comply with the provisions of Articles 6, 7, 8, and 9 of this Circular.
Article 6. Specifications and Colors of Men's Uniforms
1. Overcoat
a) Material: blended wool fabric TW8058-1; diagonal weave 3/1; ratio PW45/55; longitudinal density 360s/10cm2, transverse density 270s/10cm2; weight 245g/m2;
b) Color: dark slate blue;
c) Style: vest style, B-shaped collar, belted waist, brass zipper; chest pocket with cup design, one row of four white-plated buttons; shoulder straps for insignia, padded shoulders; two chest pockets on each side; two slanted pockets on the front; separate shoulder seams on the back, stitched spine, split back seam; cuffs with two buttons; entire collar, lapel, pocket flap, and body made of mex; length reaches mid-thigh.
2. Vest
a) Material: blended wool fabric TW8058-1; diagonal weave 3/1; ratio PW45/55; longitudinal density 360s/10cm2, transverse density 270s/10cm2; weight 245g/m2;
b) Color: dark slate blue;
c) Style: jacket, B-shaped collar; one row of four white-plated buttons; four chest pockets (two on the chest, two below), all with flaps; shoulder straps for insignia, padded shoulders; stitched spine on the back, split back seam; cuffs with two buttons, folded outwards; entire collar, lapel, pocket flap, and body made of mex.
3. Long-sleeved shirt (winter, spring-summer)
a) Material: poplin fabric 8151 PE/VIS; ratio 65/35; longitudinal density 320s/10cm2, transverse density 286s/10cm2; weight 145g/m2;
b) Color: sky blue;
c) Style: standing collar shirt; two chest pockets on the front, with flaps, round bottom corners; one row of six buttons; shoulder straps for insignia; back with shoulder seams, pleats on both sides; long sleeves with cuffs, buttoned cuffs.
4. Short-sleeved shirt (spring-summer)
a) Material: poplin fabric 8151 PE/VIS; ratio 65/35; longitudinal density 320s/10cm2, transverse density 286s/10cm2; weight 145g/m2;
b) Color: sky blue;
c) Style: standing collar shirt; two chest pockets on the front, with flaps, round bottom corners; one row of six brass buttons; shoulder straps for insignia; back with shoulder seams, pleats on both sides; short sleeves, cuffs folded inward with two parallel stitches.
5. Trousers (winter, spring-summer)
a) Material: blended wool fabric TW8058-1; diagonal weave 3/1; ratio PW45/55; longitudinal density 360s/10cm2, transverse density 270s/10cm2; weight 245g/m2;
b) Color: dark slate blue;
c) Style: suit pants, separate waistband, two slanted side pockets; front with pleats on both sides; zipper closure; waistband with one hook and one hidden button; back with pleats on both sides, two rear pockets with buttons; six belt loops; hem turned up at the front.
6. Leather Shoes
a) Material: PU sole; black nappa leather; thickness 1.4mm - 1.6mm; tensile strength (MPa) ≥16, (N/cm²) ≥1100; Shore hardness A 60 ± 5;
b) Style: Oxford style, smooth toe; lace-up with four pairs of eyelets, cushioned sole for comfort, elastic inserts inside and outside; upper made of soft black nappa leather, matte finish, smooth grain; lining and insole made of light brown cowhide; PU sole with a 4cm heel, textured for anti-slip.
7. Backless Sandals
a) Material: black nappa leather; thickness 1.2mm - 1.4mm; tensile strength (MPa) ≥18, (N/cm²) ≥3;
b) Style: strap across the foot; 3cm high sole with a buckle.
Article 7. Specifications and Colors of Women's Uniforms
1. Overcoat
a) Material: blended wool fabric TW8058-1; diagonal weave 3/1; ratio PW45/55; longitudinal density 360s/10cm2, transverse density 270s/10cm2; weight 245g/m2;
b) Color: dark slate blue;
c) Style: veston style with a B-shaped collar; the chest has a row of four white-plated buttons; designed with shoulder straps for insignia, padded shoulders; the front body is designed with a piece cut from the shoulder down, with two diagonal pockets below; the back is designed with a stitched seam at the spine, with a slit at the back; the sleeves are two-piece with a flap, buttoned; the entire collar, lapel, pocket flap, and body are made of mex material.
2. Vest
a) Material: blended wool fabric TW8058-1; diagonal weave 3/1; ratio PW45/55; longitudinal density 360s/10cm2, transverse density 270s/10cm2; weight 245g/m2;
b) Color: dark slate blue;

c) Style: suit pants with separate waistband, two diagonal side pockets; the front body is gathered inward on each side towards the vertical part of the pants; the fly is zipped with plastic; the waistband has one hook and one plastic button inside; the back is gathered on each side; hem straight.
6. Skirt
a) Material: twill fabric blended with wool; code TW8050-1; weave type 3/1; ratio PW45/55; longitudinal density 360s/10cm2, transverse density 270s/10cm2; weight 245g/m2;
b) Color: dark slate blue;
c) Style: A-line skirt with a separate waistband, wide waistband; the front body has two diagonal pockets, with two straight lines from the waist to the hem; the back uses a tear-drop closure and has a back slit.
7. Leather Shoes
a) Material: TPR sole; black nappa leather; thickness 1.2mm - 1.4mm; tensile strength (Mpa) ≥18, (N/cm²) ≥320; Shore hardness A 60 ± 5;
b) Style: slip-on style; smooth toe made of nappa leather; inner lining of the shoe cap and sole made of light brown cowhide; the sole underside has anti-slip patterns; heel height 5cm.
8. Backstrap Sandals
a) Material: black nappa leather; thickness 1.2mm - 1.4mm; tensile strength (MPa) ≥18, (N/cm²) ≥3;
b) Style: cross strap; sole height 7cm, with a buckle.
Article 8. Specifications and Colors of Other Uniforms Commonly Equipped for Both Men and Women
1. Raincoat Pants and Jacket
a) Material: polyester fabric coated with plastic; thickness 0.2mm ± 0.01; weight 230g/m2 ± 10; tensile strength of fabric strip (N) longitudinal ≥700, transverse ≥370;
b) Color: dark green (withered grass);
c) Style: trench coat style with a turned-down collar, chest with a flap covering the zipper, buttoned; the front body is seamless, the back shoulder is detachable, lined with breathable mesh; the sleeve is one-piece, with elastic cuffs; the hat is detachable and attached to the jacket with buttons; all seams are taped inside to prevent water seepage; "TTGT" printed on the front and back.
2. Necktie
a) Material: blended wool fabric TW8058-1; diagonal weave 3/1; ratio PW45/55; longitudinal density 360s/10cm2, transverse density 270s/10cm2; weight 245g/m2;
b) Color: dark slate blue;
c) Style: moderate length and width, pre-tied, with a zipper, automatic lock mechanism.
3. Socks
a) Material: synthetic cotton blend: cotton 40%, acrylic 23%, spandex 37%; weight 45g ± 2/pair; knitted fabric with stretch; weave types rip and single;
b) Color: dark slate blue;
c) Style: low-cut top.
4. Leather Belt
a) Material: belt made of buffalo hide, black color; buckle made of cast aluminum alloy; weight of buckle 72g ± 5; thickness of belt 2.8mm - 3mm;
b) Style: the buckle and faceplate are chrome-plated white, with the central emblem of the Transport Inspection Department measuring 22mm in diameter; the belt is edge-finished, the end is rounded, the inner end is grooved for sliding.
5. Name Badge
a) Material: yellow brass sheet 0.6mm thick; pin made of stainless steel alloy; weight 10g ± 1;
b) Color: blue;
c) Style: made of brass sheet, surface coated with blue paint; length 81mm, width 23mm; border width 1mm; distance from the inner edge of the border to the emblem is 3mm; on the left side is the emblem of the Transport Inspection Department with a diameter of 15mm, the right side has three lines of text: the top line is the name of the agency, the second line is the user's full name, the third line is the position (title or civil servant grade of the user);
d) The name badge is attached to the upper edge of the left pocket on the uniform jacket of specialized transport inspectors.
6. Document Case
a) Material: black leather with a number lock; thickness 1.4mm - 1.6mm; tensile strength (Mpa) ≥16, (N/cm²) ≥1100;
b) Style: with carrying handle and shoulder strap.
7. Button
a) Material: yellow brass sheet 0.3mm thick; button shank made of red brass with a diameter of 0.8mm, button shank height 2.5mm;
b) Color: bright white;
c) Plating process: copper plating, followed by nickel plating, and finally chromium plating;
d) Style: circular shape with a star in the center of two pine branches, below is the embossed text "TTGT".
8. Insignia Button
a) Material: yellow brass sheet 0.8mm thick; button shank and nut made of brass, M2;
b) Color: bright white;
c) Plating process: copper plating, followed by nickel plating, and finally chromium plating;
d) Style: circular shape with a star in the center of two olive branches, below is the embossed historical wheel with the text "TTGT".
9. Emblem and Shield
The emblem features a red circular symbol, with a five-pointed yellow star in the center, below is a yellow historical wheel with the text "TTGT" engraved, the outer ring is two yellow olive branches on a blue background.
The shield is attached to the left sleeve of the specialized transport inspector's uniform, 80mm - 100mm away from the shoulder seam; the shield has a maximum width of 70mm, shield top width 24mm, maximum height 90mm, height from the shield edge to the base 80mm, from the shield edge to the top edge 23mm, made of blue fabric, with long rice flowers on both sides, a yellow border around the shield, the top has the name of the agency responsible for specialized inspection functions under the Ministry of Transport; the emblem embroidered on the shield has a size of 35mm.
The emblem and shield model as stipulated in Appendix II issued together with this Circular.
10. Pine Branches
The pine branches are attached to the lapel and on the star of the cap.
a) Material: yellow brass sheet 0.7mm thick; pin fitting made of brass 15mm x 3mm; weight 6g ± 0.4;
b) Color: bright white;
c) Plating process: copper plating, followed by nickel plating, and finally chromium plating;
d) Style: straight, consisting of 11 leaves and 7 fruits.
11. Cap Star
a) Material: yellow brass sheet 0.8mm thick; button shank and nut made of brass, M4;
b) Color: bright white;
c) Plating process: copper plating first, followed by nickel plating, chromium plating, and finally a protective surface polishing; red enamel painting for the glass; the middle base and two edges painted blue; historical wheels painted yellow;
d) Design: the star-shaped cap badge is made from pine branches, with the traffic inspection emblem of the Ministry of Transport in the center, having a diameter of 36mm;
12. Cap
a) Material and color of the cap: the cap body is made of wool blend twill fabric marked TW8058-1, dark navy blue; decorative cord core is made of peco fiber with a rating of 34Nm, dark brown, covered with metallic thread; the forehead support is made of pure plastic, white; the brim is made of black plastic; the cap button is made of gold-plated brass sheet 0.6mm thick, with a pin made of red brass, 0.8mm in diameter, 15mm long, plated white and shiny; the plating process for the cap button: copper plating first, followed by nickel plating, and finally chromium plating;
b) Material and plating process for the pine branch on the cap: the pine branch on the cap is made of gold-plated brass sheet 0.8mm thick, with four pins made of red brass, 8mm in diameter, 15mm long; the pine branch on the cap is plated white and shiny; the plating process: copper plating first, followed by nickel plating, and finally chromium plating;
c) Design of the cap: the cap crown is high, the brim is curved, the top and support of the cap are made of the same fabric; the cap has a round shape, surrounded by a plastic tube, inside which is a steel spring; there is a foam cushion at the front forehead, with a round star badge in the center between two pine branches, each side carrying two air vents; above the brim, there is a decorative cord braided in a fish tail style, dark brown, with both ends fastened by metal buttons with a star in the center between two pine branches; the brim is made of black plastic, gradually sloping forward, with a white and shiny pine branch attached to the top of the brim;
13. Helmet
a) Material: the helmet shell is made of nylon 6 (PA6) plastic, the visor is made of polycarbonate (PC) plastic, and the protective padding is made of expanded polystyrene (EPS);
b) Color: the helmet shell is dark blue, the inner lining is black felt, the padding is white, the logo with the word "TTGT" in white, 50mm high and 30mm wide, in Arial font, located inside the helmet;
c) Design: the helmet covers the entire head and ears, with a face shield and a removable brim; inside the helmet, there is a padded foam lining with a felt cover, a ventilation mesh at the top of the head, and a woven label; there is a chin pad in the middle of the strap, with a buckle at the end of the strap;
14. Rubber Boots
a) Material: synthetic rubber;
b) Color: black;
c) Design: seamless boot design, waterproof and slip-resistant;
Article 9. Rank Insignia
1. The rank insignia includes shoulder straps and rank bars worn on both shoulders of the uniform of specialized inspectors.
The model of the rank insignia is specified in Appendix III issued together with this Circular.
2. Specifications for Shoulder Straps
The shoulder straps of specialized inspectors have a length of 13cm, the tip is 4cm wide, and the tail is 5cm wide; the background of the rank insignia is dark navy blue felt; the frame of the rank insignia is made of white pure plastic; the star of the rank insignia is made of gold-plated brass sheet, with a red ribbon 3mm wide; the button of the rank insignia is circular with a star in the center between two pine branches.
3. Specifications for Rank Bars
a) Specialized inspectors who are Heads of agencies assigned to perform specialized inspection functions under the Ministry of Transport: the shoulder straps are attached with four 23mm stars in a vertical row on the shoulder straps, with two white shiny metal stripes;
b) Specialized inspectors who are Deputy Heads of agencies assigned to perform specialized inspection functions under the Ministry of Transport: the shoulder straps are attached with three 23mm stars in a vertical row on the shoulder straps, with two white shiny metal stripes;
c) Specialized inspectors who are Heads of advisory units for specialized inspection work and equivalent positions in agencies assigned to perform specialized inspection functions under the Ministry of Transport: the shoulder straps are attached with two 23mm stars in a vertical row on the shoulder straps, with two white shiny metal stripes;
d) Specialized inspectors who are Deputy Heads of advisory units for specialized inspection work and equivalent positions in agencies assigned to perform specialized inspection functions under the Ministry of Transport: the shoulder straps are attached with one 23mm star in the center of the shoulder straps, with two white shiny metal stripes;
đ) Specialized inspectors: the shoulder straps are attached with one 23mm star in the center above one white stripe.

2. Uniforms issued once: peaked caps, spruce branches, name plates, rank insignia. In cases where uniforms issued once become old, damaged, lost, or when there is a change in position, they shall be reissued.
3. Based on specific regional conditions, the Heads of agencies entrusted with the specialized inspection functions under the Ministry of Transport may decide to convert the overcoat and autumn jackets into two spring and summer jackets or convert the overcoat into an autumn jacket with additional padding to suit weather conditions.
Article 11. Management and use of uniforms
1. Specialized inspection civil servant uniforms are to be used when performing specialized inspection tasks, attending conferences, traditional days, and other ceremonies related to inspection activities as prescribed.
2. Specialized inspection civil servants have the responsibility to manage and use the uniforms provided in accordance with the provisions of this Circular and other relevant laws.
3. Agencies entrusted with the specialized inspection functions under the Ministry of Transport have the responsibility to provide uniforms in accordance with the provisions of this Circular.
Article 12. Budget for making and equipping uniforms
The budget for making and equipping uniforms for specialized inspection civil servants is allocated within the annual state budget estimate assigned by the competent authority; it is provided outside the administrative expenditure quota based on staffing.
Chapter IV
SPECIAL INSPECTION BADGE
Article 13. Specialized Inspection Badge
1. The specialized inspection badge is issued to specialized inspection civil servants for use when performing specialized inspection tasks.
The Director of the Inspectorate of the Ministry of Transport decides to issue new, replace, reissue, or recall specialized inspection badges upon the proposal of the Heads of agencies entrusted with the specialized inspection functions under the Ministry of Transport.
The validity period of the specialized inspection badge is 05 years from the date of issuance, including newly issued, replaced, and reissued badges as stipulated in Article 14 of this Circular. For specialized inspection civil servants with less than 05 years remaining in their service, the validity period of the specialized inspection badge extends until the retirement date as prescribed.
2. The model of the specialized inspection badge is specified in Appendix IV attached to this Circular.
3. Specialized Inspection Badge Number
a) Each specialized inspection civil servant is assigned one specialized inspection badge number. The specialized inspection badge number consists of three parts, separated by hyphens;
b) The first part includes one uppercase letter and two digits: A06;
c) The second part includes uppercase letters to distinguish the agency using the specialized inspection civil servant, specifically: Vietnam Highway Administration is CDBVN; Vietnam Railway Administration is CDsvn; Vietnam Inland Waterway Administration is CDtnDvn; Vietnam Registration Bureau is CDkvn;
d) The third part includes three digits starting from 001, which is the serial number of the specialized inspection civil servant of the agency entrusted with the specialized inspection function under the Ministry of Transport.
4. The specialized inspection badge number does not change in cases where the specialized inspection civil servant is transferred or rotated within the same agency entrusted with the specialized inspection function under the Ministry of Transport, except in cases where the specialized inspection civil servant is no longer assigned as prescribed in Clause 3, Article 4 of this Circular.
5. The specialized inspection badge number changes (new number is assigned) in cases where the specialized inspection civil servant transfers to another agency entrusted with the specialized inspection function under the Ministry of Transport.
6. Raised stamp on the specialized inspection badge
a) The raised stamp on the specialized inspection badge is the seal of the Inspectorate of the Ministry of Transport, with a diameter of 18mm;
b) The raised stamp is used to stamp in the lower right corner of the photograph of the person receiving the specialized inspection badge;
c) The Inspectorate of the Ministry of Transport has the responsibility to manage and use the raised stamp in accordance with the law.
Article 14. Issuance, Replacement, and Reissuance of Specialized Inspection Cards
1. A new specialized inspection card shall be issued when a civil servant is assigned to perform specialized inspection functions for the first time by the head of the agency entrusted with such functions under the Ministry of Transport.
2. A specialized inspection card shall be replaced when it expires, becomes damaged, or when information about the holder changes.
3. A specialized inspection card shall be reissued if it is lost and does not fall within the circumstances subject to revocation as stipulated in Article 15 of this Circular.
4. The application dossier for issuing a new or replacement specialized inspection card includes:
a) A request for issuance of a new or replacement specialized inspection card from the head of the agency entrusted with specialized inspection functions under the Ministry of Transport, accompanied by a list of individuals being requested to obtain a new or replacement card according to the model prescribed in Appendix V attached to this Circular;
b) Decision on assignment of specialized inspector (original or copy stamped by the agency), except in cases where a replacement is requested due to expiration or damage of the card;
c) Two color portrait photographs measuring 23mm x 30mm, wearing the uniform of a specialized inspector, taken no more than six months prior to submission of the application;
d) The old specialized inspection card that has been corner-cut for replacement requests.
5. The application dossier for reissuing a specialized inspection card includes:
a) A request for reissuance of a specialized inspection card from the applicant confirmed by the head of the agency entrusted with specialized inspection functions under the Ministry of Transport according to the model prescribed in Appendix VI attached to this Circular;
b) A request for reissuance of a specialized inspection card from the head of the agency entrusted with specialized inspection functions under the Ministry of Transport, accompanied by a list of individuals being requested to reissue the card according to the model prescribed in Appendix V attached to this Circular;
c) Two color portrait photographs measuring 23mm x 30mm, wearing the uniform of a specialized inspector, taken no more than six months prior to submission of the application.
6. Within fifteen days from the date of receipt of the complete application dossier as prescribed, the Director of the Inspectorate of the Ministry of Transport shall issue a specialized inspection card according to the model prescribed in Appendix IV attached to this Circular. In case of refusal to issue a specialized inspection card, a written notice must be provided with clear reasons stated.
7. A specialized inspector shall not be considered for issuance, replacement, or reissuance of a specialized inspection card if they fall within any of the following circumstances: having received a transfer notice to another position, during detention, disciplinary action, or if there is a notice regarding disciplinary review of the civil servant by the competent authority.
Article 15. Revocation of Specialized Inspection Cards
1. A specialized inspection card shall be revoked when a specialized inspector is decided to be relieved of their duties or when the card was issued without meeting the required conditions and standards as stipulated.
2. Within ten days from the date of issuance of the decision to relieve a specialized inspector of their duties or upon discovery that the specialized inspection card was issued without meeting the required conditions and standards, the head of the agency entrusted with specialized inspection functions under the Ministry of Transport shall be responsible for revoking the card, reporting, and returning it to the Inspectorate of the Ministry of Transport.
Article 16. Budget for printing forms, cards, and issuing specialized inspection cards
1. The budget for printing forms, cards, and issuing specialized inspection cards shall be funded from the State budget allocated to the Ministry of Transport.
2. The Inspectorate of the Ministry of Transport shall base on actual annual needs to prepare the budget estimate for printing forms, cards, and issuing specialized inspection cards. The budget for printing forms, cards, and issuing specialized inspection cards shall be provided outside the administrative expenditure quota based on staffing levels.
Chapter V
DUTIES AND LIMITATIONS OF THE AGENCY PERFORMING INSPECTION FUNCTIONS
SPECIALIZED INSPECTION IN THE TRANSPORT SECTOR
Article 17. Duties and powers of the agency performing inspection functions under the Ministry of Transport
1. Duties and powers of the Inspectorate of the Ministry of Transport
a) Perform duties and powers as prescribed in Clause 1, Article 14 and Article 15 of the Inspection Law;
b) In specialized inspection activities, conduct inspections of the implementation of transport policies and laws by provincial People's Committees and specialized agencies under provincial People's Committees.
Inspect cases involving two or more areas within the scope of management of the Ministry of Transport.
Inspect cases as specified in paragraph 1, point c, Clause 2 of this Article, and other cases assigned by the Minister of Transport.
2. Duties and powers of the Vietnam Maritime Administration Inspectorate, the Vietnam Civil Aviation Authority Inspectorate, and other agencies entrusted with specialized inspection functions under the Ministry of Transport
a) The Vietnam Maritime Administration Inspectorate and the Vietnam Civil Aviation Authority Inspectorate perform duties and powers as prescribed in Clause 1, Article 18 and Article 19 of the Inspection Law;
b) Agencies entrusted with specialized inspection functions under the Ministry of Transport perform duties and powers as prescribed in Clause 1, Article 23 of Decree No. 03/2024/NĐ-CP dated January 11, 2024, of the Government on specialized inspection agencies and their operations;
c) In specialized inspection activities, conduct inspections of the implementation of transport policies and laws by organizations and individuals within the scope of specialized management.
Inspect cases as specified in paragraph 1, point b, Clause 1 of this Article, and other cases assigned by the Minister of Transport.
Article 18. Information and Reporting System in Specialized Inspection Activities in the Transport Sector
1. Types of Reports
a) Monthly reports;
b) Quarterly, six-monthly, nine-monthly, and annual summary reports;
c) Special topic and ad hoc reports as required by competent authorities.
2. Content Required in Reports
a) Monthly reports: report on the results of specialized inspections;
b) Quarterly, six-monthly, nine-monthly, and annual summary reports: report on the results of specialized inspections; management work, force building; law dissemination; proposals and recommendations for enhancing the effectiveness of specialized inspection activities;
c) Special topic and ad hoc reports: content as required by the requesting authority.
3. The Vietnam Civil Aviation Authority Inspectorate, the Vietnam Maritime Administration Inspectorate, the Transport Inspectorates of Departments of Transport, and other agencies entrusted with specialized inspection functions under the Ministry of Transport shall submit information and reports on specialized inspection activities to the Inspectorate of the Ministry of Transport in accordance with the provisions of this Article.
4. Methods of Submission and Receipt; Report Outline Templates
a) For monthly reports: submit reports by entering data into the specialized inspection activity reporting software;
b) For quarterly, six-monthly, nine-monthly, and annual summary reports: submit reports in writing according to the report outline template prescribed in Appendix VII attached to this Circular.
5. Deadlines for Submitting Reports; Frequency of Reporting; Data Closure Periods
a) Monthly reports: close data for the month from the 16th of the previous month to the 15th of the reporting month; complete data entry before the 18th of the reporting month;
b) Quarterly reports: close data for the quarter from the 16th of the last month of the previous quarter to the 15th of the last month of the reporting quarter; submit reports before the 18th of the last month of the reporting quarter;
c) Six-monthly reports: close data for the period from December 16 of the previous year to June 15 of the reporting year; submit reports before June 18 of the reporting year;
d) Nine-monthly reports: close data for the period from December 16 of the previous year to September 15 of the reporting year; submit reports before September 18 of the reporting year;
e) Annual summary reports: close data for the year from December 16 of the previous year to December 15 of the reporting year; submit reports before December 18 of the reporting year.
Chapter VI
IMPLEMENTATION
Article 19. Effective Date
1. This Circular takes effect from September 15, 2024.
2. This Circular abolishes the following Circulars:
a) Circular No. 68/2013/TT-BGTVT dated December 31, 2013, of the Minister of Transport on inspectors, civil servants in specialized inspection, and cooperative inspectors in the transport sector;
b) Circular No. 52/2015/TT-BGTVT dated September 24, 2015, of the Minister of Transport on insignia, flags, uniforms; means and technical equipment of transport inspectors.
3. Certificates or training certificates for specialized transport inspection that have been recognized as civil servants in accordance with Circular No. 68/2013/TT-BGTVT dated December 31, 2013, of the Minister of Transport on inspectors, civil servants in specialized inspection, and cooperative inspectors in the transport sector shall continue to be valid until further guidance is issued by the Government Inspectorate in accordance with Article 17 of Decree No. 43/2023/NĐ-CP dated June 30, 2023, of the Government detailing certain provisions and measures to implement the Inspection Law.
4. The inspection uniforms issued in accordance with Circular No. 52/2015/TT-BGTVT dated September 24, 2015, of the Minister of Transport regarding insignia, flags, uniforms; means of transport and technical equipment of the transport inspection sector shall continue to be used until further guidance from the Government Inspectorate in accordance with Clause 1 of Article 43 of the Inspection Law and Clause 1 and Clause 5 of Article 13 of Decree No. 43/2023/NĐ-CP dated June 30, 2023, of the Government detailing certain provisions and measures for implementing the Inspection Law.
5. In cases where the regulatory legal documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replacing regulatory legal documents.
Article 20. Implementation
The Heads of the Ministry's Office, the Heads of the Ministry's Inspectorate, the Directors of Departments, the Heads of the Vietnam Civil Aviation Authority Inspectorate, the Heads of the Vietnam Maritime Administration Inspectorate, the Heads of the Transport Inspectorates of the Departments of Transport; the Directors of the Departments: Highway of Vietnam, Railways of Vietnam, Inland Waterway of Vietnam, Inspection of Vietnam; inspectors, specialized inspection civil servants and other organizations and individuals related shall be responsible for implementing this Circular./.
