RESOLUTION

Issuing pilot policies for implementing the roadmap for using E10 gasoline

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;

Pursuant to the Law on Enactment of Legal Normative Documents No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;

At the proposal of the Minister of Industry and Trade;

The Government issues this Resolution on piloting certain policies for implementing the roadmap for using E10 gasoline.

 

Article 1. Scope of Regulation and Applicability

1. This Resolution stipulates the pilot of certain policies for implementing the roadmap for using E10 gasoline, including: leasing testing services to check fuel quality; determining E10RON95-III as a commonly consumed biofuel product announced by the State; determining factors forming the price of E10RON95-III; handling remaining unleaded gasoline stock and responsibilities of relevant agencies, organizations, and individuals.

2. This Resolution applies to traders dealing with gasoline and other organizations and individuals related thereto.

Article 2. Provisions on Leasing Testing Services

1. Primary traders producing and trading in gasoline shall lease testing services from designated testing organizations according to the law to check fuel quality in accordance with national technical standards.

2. Contracts for leasing testing services with designated testing organizations according to the law have the value of documentation explaining the testing laboratory capacity currently available at blending facilities.

 

 

Article 3. Provisions on the Price of E10RON95-III

1. From the date this Resolution takes effect, E10RON95-III will be piloted as a commonly consumed product, with the State announcing the base price to replace RON95-III.

2. The Ministry of Industry and Trade and the Ministry of Finance will determine the factors constituting the base formula for oil prices and announce the base oil prices to implement the pilot price management for E10RON95-III according to Clause 11, 12 Article 1 of the Government's Decree No. 80/2023/NĐ-CP dated November 17, 2023 amending and supplementing some articles of the Government's Decree No. 95/2021/NĐ-CP dated November 1, 2021 and the Government's Decree No. 83/2014/NĐ-CP dated September 3, 2014 on trading in oil products and the Government's Resolution No. 55/NQ-CP dated March 19, 2026 amending and supplementing some contents of the Government's Resolution No. 36/NQ-CP dated March 6, 2026 on the regular meeting of the Government in February 2026.

3. Factors forming the base price of E10RON95-III include:

a) The world oil price determined by the Ministry of Industry and Trade according to the principle of averaging over the number of days with prices between two periods of announcing the base price of RON95 traded on the international market;

b) The ethanol fuel price applied in the formula for calculating the base price of E10RON95-III determined by the Ministry of Finance and notified to the Ministry of Industry and Trade for application in the pricing formula;

c) Costs of bringing gasoline from abroad to Vietnamese ports, premium for calculating gasoline prices from domestic production sources, costs of bringing gasoline from domestic refineries to ports, applied at the level of costs forming the base price of RON95-III; fixed profit margin, fixed business cost margin applied at the level of costs forming the base price of E5RON92;

d) When all factors for operating costs for E10RON95-III trading comply with Clause 12 Article 1 of the Government's Decree No. 80/2023/NĐ-CP, the Ministry of Finance will take the lead, coordinate with the Ministry of Industry and Trade to compile, review, request additional reports or conduct field surveys (if necessary) to examine and decide on costs of bringing gasoline from abroad to Vietnamese ports, premium for calculating gasoline prices from domestic production sources, costs of bringing gasoline from domestic refineries to ports, fixed business cost margin, and notify the Ministry of Industry and Trade for application in the pricing formula.

4. Primary traders in gasoline have the responsibility to report fully, promptly, truthfully, and accurately to the Ministry of Finance and the Ministry of Industry and Trade all information and data serving the determination of factors forming the base price formula for E10RON95-III according to regulations; bear full responsibility under the law for the content, information, and data reported.

5. The Ministry of Industry and Trade will cooperate with the Ministry of Finance to manage the price of E10RON95-III replacing RON95-III from the nearest price adjustment period from the date this Resolution takes effect.

Article 4. Rights and Responsibilities of Gasoline Traders

1. For the remaining finished unleaded gasoline stock before June 1, 2026, it is encouraged that gasoline traders purchase, sell, and transfer among themselves to serve blending activities and must complete such activities by July 31, 2026.

2. Primary traders in gasoline bear legal responsibility for the quantity of unleaded gasoline purchased, sold, and transferred as stipulated in Clause 1 of this Article and must report to the Ministry of Industry and Trade before August 15, 2026 for monitoring.

3. Distributors of gasoline, retailers of gasoline, and retail gasoline agents bear legal responsibility for the quantity of unleaded gasoline purchased, sold, and transferred as stipulated in Clause 1 of this Article and must report to the Department of Industry and Trade in their business location before August 15, 2026 for monitoring.

Article 5. State Management Responsibilities and Implementation

1. Responsibilities of the Ministry of Industry and Trade

a) During the implementation of the roadmap for using E10 gasoline, based on actual economic, social, technical, technological, supply-demand, price, and other relevant changes, take the lead in coordinating with ministries and sectors to report to the Government for consideration and adjustment of the contents of this Resolution to ensure energy security, environmental protection, and consumer rights; b) Take the lead in coordinating ethanol and gasoline base supplies for blending and mixing E10 gasoline; coordinate with the Ministry of Science and Technology to inspect and supervise the blending and mixing process, sales, and quality of E10 gasoline;

c) Organize the nationwide implementation of the E10 gasoline roadmap starting from June 1, 2026;

d) Review and guide construction and renovation standards for storage infrastructure and biofuel blending stations to ensure safety and compliance with regulations.

2. Responsibilities of the Ministry of Science and Technology

 

 

Strengthen inspection, control, and supervision of measurement and quality management regulations for E10 gasoline during production, blending, importation, and circulation in the market.

3. Responsibilities of the Ministry of Finance

Study and propose specific adjustments to special consumption tax and environmental protection tax for biofuels to encourage the use of biofuels (if necessary).

4. Responsibilities of the Ministry of Construction

Coordinate with the Ministry of Industry and Trade to review and guide construction and renovation standards for storage infrastructure and biofuel blending stations to ensure safety and compliance with regulations.

5. Responsibilities of the Ministry of Agriculture and Environment

Study and propose mechanisms to develop raw material regions for biofuel production. Evaluate and announce emission reduction indicators when using biofuels to support communication efforts.

6. Responsibilities of People's Committees of provinces and centrally governed cities

a) Direct specialized agencies at the local level to support businesses in building, renovating, and upgrading infrastructure for storing and distributing E10 gasoline;

b) Strengthen inspection and supervision of the quality of E5, E10 gasoline circulating within their jurisdiction.

7. Responsibilities of gasoline traders and testing organizations

a) Gasoline traders must comply with the roadmap for transitioning to E10 gasoline trading; proactively build plans to ensure supplies of gasoline base and biofuels; invest in and upgrade blending facilities, storage facilities, and distribution systems to organize E10 gasoline trading across the system, ensuring product quality meets national technical standards and legal regulations before entering the market;

Have the responsibility to ensure the completeness, accuracy, honesty, and legality of documents related to production, blending, importation, and trading activities; bear legal responsibility for product quality and matters within their management scope;

b) Testing organizations have the responsibility to ensure the accuracy, objectivity, and honesty of test results; bear legal responsibility for test results provided according to the law.

Article 6. Effective Date

1. This Resolution shall take effect from June 16, 2026 to June 15, 2028.

2. The Ministers, Heads of ministerial-level agencies, agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and relevant agencies, organizations, and individuals are responsible for implementing this Resolution./.
