DECREE NO. 29-CP OF MAY 8, 1996 ON RETIREMENT REGIME DUE TO ORGANIZATIONAL AND STAFF REORGANIZATION
ARRANGEMENT OF ORGANIZATION AND STAFF
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Article 145 of the Labor Code dated June 23, 1994.
At the proposal of the Minister, Head of the Civil Service and Personnel Department of the Government, the Minister of Labor, Invalids and Social Affairs, and the Minister of Finance,
DECREE:
Article 1.- Civil servants and elected officials of Party organizations, People's Front, and mass organizations at provincial level, centrally-administered municipalities, provincial municipalities, districts, counties, and towns who are subject to organizational and staff reorganization in 1996 and meet the following conditions shall be entitled to monthly retirement benefits as stipulated in Point a, Clause 1, Article 27 of the Social Insurance Regulations issued together with Decree No. 12/CP dated January 26, 1995 of the Government:
1. Male aged 55 years old and female aged 50 years old with at least 20 years of social insurance contributions.
2. Male aged 50 years old and female aged 45 years old with at least 20 years of social insurance contributions, during which period they have worked for at least 15 years under one of the following circumstances:
- Engaged in heavy or hazardous work for 15 years;
- Worked in areas with regional allowances of coefficient 0.7 or higher for 15 years;
- Worked in the South, Laos before April 30, 1975, or Cambodia before August 31, 1989 for 10 years.
Article 2.- This Decree takes effect from the date of signature. The Minister, Head of the Civil Service and Personnel Department of the Government, the Minister of Labor, Invalids and Social Affairs, and the Minister of Finance are responsible for guiding the implementation of this Decree.
Article 3.- The Minister, Heads of Ministries equivalent to Ministries, Heads of Government-affiliated agencies, Chairpersons of Provincial People's Committees, centrally-administered municipal People's Committees, and General Director of Vietnam Social Security are responsible for enforcing this Decree./.
