GUIDANCE
implement the system of material allowances for cultural and information workers operating under hazardous and toxic conditions
Pursuant to Circular Joint Circular No. 10/1999/TTLT-BLDTBXH-BYT dated March 17, 1999, jointly issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health, guiding the implementation of the system of material allowances for workers operating under hazardous and toxic conditions;
Pursuant to Circular Joint Circular No. 10/2006/TTLT-BLDTBXH-BYT dated September 12, 2006, jointly issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health, amending and supplementing Clause 2, Section II of Joint Circular No. 10/1999/TTLT-BLDTBXH-BYT dated March 17, 1999, jointly issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health, guiding the implementation of the system of material allowances for workers operating under hazardous and toxic conditions;
Pursuant to Circular No. 508/LD dated June 24, 1983 of the Ministry of Labor (now the Ministry of Labor, War Invalids and Social Affairs) and Circulars No. 2182/TC-CV dated August 2, 1995 and No. 1664/LDTBXH-BHLD dated May 15, 1997 of the Ministry of Labor, War Invalids and Social Affairs agreeing on the system of material allowances for toxic hazards for the Circus industry and cultural and information workers operating under hazardous and toxic conditions;;
The Ministry of Culture and Information guides the implementation as follows:
I. OBJECTS AND AMOUNT OF ALLOWANCE:
Amount of allowance: The amount of material allowance is calculated based on the quota for one working day, equivalent in value to money according to the following levels:
Level 1: Equivalent to 4,000 VND for one shift or one working day, applicable to workers (including students and trainees or apprentices) directly performing the following jobs:
1. Caring for and maintaining animals in circuses;
2. Ballet dancing, traditional dance, and opera singing;
3. Mixing and preserving chemicals;
4. Developing film onto metal plates;
5. Setting electronic type;
6. Inventorying, preserving, and processing technical items, documents, books, and films in museum and library archives;
7. Restoring and repairing library, archive, and museum items;
8. Puppet making;
9. Operating and repairing offset printing machines, typographic machines, paper cutting machines, and paper ruling machines;
10. Developing metal plates (coating, developing, and fixing);
11. Electroplating with lead;
12. Casting monotype characters;
13. Cooking glue;
14. Paper marbling;
15. Film coating;
16. Photographic development and chemical mixing;
17. Film repair;
18. Repairing and operating film coating machinery;
19. Chemical warehouse management, film storage, and distribution warehouses;
20. Operating and repairing air conditioning systems;
21. Industrial cleaning in film coating areas and water supply and drainage;
22. Battery workers (charging batteries);
23. Sound recording.
Level 2: Equivalent to 6,000 VND for one shift or one working day, applicable to workers (including students and trainees or apprentices) directly performing the following jobs:
1. Veterinary staff directly treating animals;
2. Archaeological surveying and excavation;
3. Operating and maintaining technical equipment in museum tunnels;
4. Water puppetry performance;
5. Lead casting.
Level 3: Equivalent to 8,000 VND for one shift or one working day, applicable to workers (including students and trainees or apprentices) directly performing the following jobs:
1. Animal trainers and animal circus performers;
2. Acrobatic, contortionist, high-wire, and aerial circus performers;
3. Metal polishing on printing machines;
4. Alloy lead cooking.
II. PRINCIPLES:
1. The system of material allowances above shall not be paid in cash but must be organized for the beneficiaries to consume at their workplace during breaks or between shifts. In special cases such as scattered work, mobile work, or small groups, employers may provide materials for workers to self-compensate according to regulations.
2. Workers who perform the above jobs for more than 50% of the standard working time of a shift or a working day shall be entitled to the full allowance quota. If they work less than 50% of the standard working time, they shall be entitled to half the allowance quota.
In cases where overtime work is required, the material allowance will also increase proportionally with the number of overtime hours.
3. Costs for material allowances for production and business units shall be included in the cost of products or circulation fees; for administrative agencies and public institutions, it shall be included in regular expenses; for students, trainees, apprentices, etc., managed by any agency or unit, the respective agency or unit shall provide funding.
The above system of material allowances shall take effect from October 1, 2006, replacing Circular No. 1437/VHTT-TCCB dated April 17, 1999, of the Ministry of Culture and Information guiding the implementation of the system of material allowances for cultural and information workers operating under hazardous and toxic conditions./.
