Pursuant to the Road Traffic Law dated November 13, 2008;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 52/2009/ND-CP dated June 3, 2009 of the Government detailing and guiding the implementation of certain provisions of the Law on Management and Use of State Property;
Pursuant to Circular No. 09/2013/TT-BGTVT dated May 6, 2013 of the Minister of Transportation on issuing the National Technical Regulation on Mobile Overload Control Stations - QCVN 66:2013/BGTVT;
Based on the proposal of the Director of the Department of Transport Infrastructure and the General Director of the Vietnam Highway Administration,
DECISION:
Article 1. Issued herewith are the "Regulations on the Management of Operations of Mobile Overload Control Stations."
Article 2. This Decision takes effect from the date of issuance.
Article 3. The Heads of the Office and Inspectorate of the Ministry; Heads of Departments; General Directors of the Vietnam Highway Administration, Directors of the Information Technology Center, Directors of Provincial Departments of Transport under central cities and heads of related agencies and units shall be responsible for implementing this Decision./.

Chapter 1.
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. Regulations on the management, use, and organization of operations of mobile overload control stations.
2. These regulations apply to agencies, organizations, and individuals involved in the management of mobile overload control station operations.
Article 2. Interpretation of Terms
1. A mobile overload control station (referred to as the Station) is a station established by an authorized agency; equipped with portable or vehicle-mounted devices for monitoring and controlling overloaded vehicles at locations designated by the competent authority.
2. A mobile weighing unit is a set of equipment consisting of one specialized automobile, electronic scales, and accompanying auxiliary devices provided to the Station.
3. The managing agency is the entity directly assigned by the provincial People's Committee to organize and manage the operations of mobile overload control stations.
Article 3. Principles of Management
1. The People's Committee of provinces and centrally governed cities (collectively referred to as the Provincial People's Committee) manages and organizes the operations of the Station; implements weight control on national highways passing through the province and local roads.
2. The managing agency of the mobile weighing unit must manage and use it according to current regulations on state asset management (must fully implement registration, statistics, inventory, inspection, and reporting procedures as prescribed).
3. The use of the mobile weighing unit must be purposeful and effective in vehicle inspection and violation handling.
Chapter 2.
REGULATIONS ON ORGANIZATION OF OPERATIONS
Article 4. Sources of Operating Funds
1. The operating funds of the Station are guaranteed from the local road maintenance fund, local traffic safety fund, and other sources.
2. Expenditures for the Station's operations include: fuel for vehicles, materials, supplies, office supplies, lighting, communication, maintenance, training, meetings, inspections, rental fees for station sites, equipment calibration and verification, allowances (if applicable), and other expenses related to the Station's operations as approved by the competent authority.
Article 5. Management and Use
1. Manage, use, and maintain the Mobile Weighing System in accordance with the manufacturer's guidelines and current procedures and standards.
2. Maintain the operational status of the Mobile Weighing System normally between two calibration and verification periods as prescribed; conduct technical condition checks before putting the Mobile Weighing System into operation.
Article 6. Forces Implementing Tasks at the Station
1. Direct forces managing the Station: The number of staff at the Station shall be arranged according to the provincial People's Committee's regulations based on the proposal of the Station Management Authority.
2. Forces assigned tasks to implement at the Station according to the Vehicle Load Control Plan approved by the competent authority.
Article 7. Standards, Equipment, and Regulations for Forces Participating at the Station
1. Forces implementing tasks at the Station shall be selected according to current standards; ensuring good moral character, sufficient capability, and appropriate professional qualifications for the job requirements.
2. Means of transportation and equipment of forces participating in coordinated work at the Station shall be provided and used according to the regulations of their respective sectors.
3. Salaries and accompanying allowances of members of the forces coordinating activities at the Station shall be paid by the dispatching agency. Allowances for working at the Station and other benefits (if any) shall be stipulated by the provincial People's Committee.
4. Forces participating in performing tasks at the Station shall be organized for vocational training including violation handling procedures, operation, and regular maintenance of the Mobile Weighing System.
Article 8. Organization of Mobile Overload Control Station Operations
1. The organizational model of the Station shall be regulated by the provincial People's Committee; the Station operates according to the Vehicle Load Control Plan approved by the provincial People's Committee; it carries out load control on national highways passing through the province and local roads.
2. The Vehicle Load Control Plan clearly defines the functions, responsibilities, and duties of the person responsible for implementing the Plan and the forces participating in load control.
3. To achieve effectiveness in load control operations, the Station operates 24/7 every day, including holidays and public holidays.
4. Locations for load control
a) Parking locations for inspection must ensure safety and not cause traffic congestion;
b) Select places with sufficient area to set up the Station and unload or areas where the road width does not obstruct or impede traffic; the electronic scale base must comply with the manufacturer's regulations or the National Technical Regulation QCVN 66:2013/BGTVT on Vehicle Load Control Stations;
c) Do not weigh vehicles or unload on narrow roads that only accommodate two lanes of traffic, expressways, or roads with high traffic density which may cause traffic congestion and traffic safety risks.
5. Forces participating in coordination during the implementation of tasks shall follow the direct assignment of the person responsible for implementing the Vehicle Load Control Plan; when resolving and handling matters, if there are differing opinions among members of each sector, the person responsible for implementing the Vehicle Load Control Plan has the right to decide and bear responsibility for their decision, and report to higher authorities if the decision exceeds their authority.
6. The management agency shall establish and promulgate internal rules and regulations of the Station based on legal provisions to fulfill assigned tasks.
Article 9. Information Connection
The Station directly updates the results of implementation, sends information and processed violation data to the electronic portal of the system, connects via the Internet to transmit to the server of the Vietnam Highway Administration; at the same time reports to the management agency as prescribed. Strictly prohibit all acts of interfering with the processing of data and inspection results.
Chapter 3.
IMPLEMENTATION
Article 10. Responsibilities of the Provincial People's Committee
1. Responsible for organizing the implementation of vehicle weight control on national highways passing through the province and local roads.
2. Approves the Vehicle Weight Control Plan, inspects and urges the implementation of the Plan to ensure effective vehicle weight control.
3. Adequately allocates funds for the operation of the Station.
Article 11. Responsibilities of the Vietnam Highway Administration
1. Guides, urges, audits, and inspects the nationwide vehicle weight control work.
2. Maintains the continuous operation of the server to serve the inspection and supervision of the Station's vehicle weight control activities.
3. Compiles and reports the situation of nationwide vehicle weight control work to the Ministry of Transport (according to Model 01-Annex attached).
Article 12. Responsibilities of the Management Agency
1. Cooperates with functional agencies to build the Vehicle Weight Control Plan to be submitted to the Provincial People's Committee for approval and implement the Vehicle Weight Control Plan on national highways passing through the province and local roads.
2. Manages, operates, uses, and maintains the mobile scale set and organizes the Station's activities effectively.
3. Inspects and supervises the Station's vehicle weight control activities.
4. Regularly quarterly, annually, or urgently reports data, analyzes, and evaluates the situation and results of the Station's activities to the Vietnam Highway Administration and the Provincial People's Committee (according to Model 02-Annex attached).
Article 13. Responsibilities of Forces Implementing Tasks at the Station
1. Forces assigned to perform tasks at the Station base on their functions, duties, and authorities to coordinate responsibilities and assigned tasks, ensuring the Station operates continuously, effectively, and in accordance with the law.
2. Maintain the regular regime of sending information and processed violation data to the system's electronic portal, connecting via the Internet to transmit to the server of the Vietnam Highway Administration. Update data daily, assess the situation, report the activity results to the direct management agency (according to Model 03-Annex attached).
