CIRCULAR
Guidelines for implementing the rest and recuperation regime for military personnel
as stipulated in Decree No. 89/2003/NĐ-CP dated August 5, 2003 of the Government

Pursuant to Clause 3, Article 1 of Decree No. 89/2003/NĐ-CP dated August 5, 2003 of the Government on amending and supplementing certain articles of the Social Insurance Regulations for officers, non-commissioned officers, and enlisted personnel of the Vietnam People's Army and the Vietnam People's Public Security Force issued together with Decree No. 45/CP dated July 15, 1995 of the Government; after reaching consensus with the Ministry of Labor, Invalids and Social Affairs (in Circular No. 4178/LĐTBXH-BHXH dated November 24, 2003) and the Ministry of Finance (in Circular No. 11265/TC-HCSN dated October 29, 2003), the Ministry of National Defense issues guidelines for implementing the rest and recuperation regime for officers, non-commissioned officers, and enlisted personnel as follows:
I. APPLICABLE OBJECTS
The subjects applying the rest and recuperation regime prescribed in Clause 3, Article 1 of Decree No. 89/2003/NĐ-CP within the military include:
1. Officers.
2. Non-commissioned officers.
3. Enlisted personnel.
II. CONDITIONS, DURATION, AND BENEFITS
1. Conditions for entitlement
a) Officers and non-commissioned officers are entitled to rest and recuperation annually when they meet one of the following three conditions:
a.1) Having contributed to social insurance for at least three years and suffering from health deterioration.
a.2) After inpatient or outpatient treatment due to illness, work-related injury, or occupational disease without full recovery.
a.3) Female military personnel receiving salary who suffer from weakened health after maternity leave.
b) Enlisted personnel receiving subsistence allowance are entitled to rest and recuperation when they meet one of the following two conditions:
b.1) Suffering from a work-related injury, after treatment without full recovery.
b.2) Suffering from an occupational disease, after treatment without full recovery.
2. Duration of rest and recuperation
a) Officers and non-commissioned officers meeting one of the three conditions specified in point a, Clause 1, Section II above shall be granted rest and recuperation for five to ten days in a year (including weekly holidays, public holidays, and travel days if resting at a centralized facility), depending on the degree of health deterioration.
b) Enlisted personnel receiving subsistence allowance meeting one of the two conditions specified in point b, Clause 1, Section II above shall be granted rest and recuperation for five to ten days in a year at their unit (including weekly holidays and public holidays), depending on the degree of health deterioration.
c) The duration of rest and recuperation does not reduce the annual leave period and entitles the person to receive salary (for officers and non-commissioned officers) or subsistence allowance (for enlisted personnel).
3. Cost of rest and recuperation
a) For officers and non-commissioned officers:
The cost is 80,000 VND/day/person, applicable to those resting and recuperating at rehabilitation groups inside and outside the military or centralized facilities organized by units. This cost includes food, accommodation, transportation, and common medical expenses.
The cost is 50,000 VND/day/person, applicable to those resting and recuperating at home or at their unit, or female military personnel after maternity leave.
b) For enlisted personnel: The cost is 30,000 VND/day/person to supplement daily meals at the unit.
III. IMPLEMENTATION
1. Responsibilities of units at the Brigade level and equivalent
a) To implement the regime fairly and reasonably, based on the provisions in Sections I and II above, the Unit Commander at the Brigade level and equivalent, directly managing military personnel, directs relevant agencies: Policy, Finance, Cadres, Military Affairs, led by the Policy Department, in coordination with the Medical Service, Military Council, Women's Association (if any) to examine and decide on military personnel eligible for rest and recuperation as follows:
Based on annual health check-ups at the unit to identify those who have contributed to social insurance for at least three years and need rest and recuperation due to health deterioration.
Based on medical records and opinions from treatment facilities to identify military personnel who need rest and recuperation after treatment due to illness, work-related injuries, or occupational diseases.
For female officers and female non-commissioned officers after maternity leave (or miscarriage), the Military Council and Women's Association (if any) will examine and decide.
b) The Unit Commander at the Brigade level and equivalent signs the list of military personnel in the unit requesting rest and recuperation assistance for the year to the Central Office (Department) of Policy of the Ministry of National Defense. The Head of the Central Office (Department) of Policy reviews and reports to the Chief of the Political Department for a joint decision for that unit. Based on the decision of the Chief of the Political Department, units provide funds and organize rest and recuperation for military personnel (Form No. 01/BHXH-DS attached).
Units proactively contact military rehabilitation groups to organize rest and recuperation for those in need.
c) In cases where the unit exhausts its allocated budget for rest and recuperation in a year, the remaining amount can be carried over to the next year. If the expenditure exceeds the allocation, it will not be reimbursed but must be supplemented from the unit's fund.
d) Annually, units are responsible for settling accounts for rest and recuperation costs with higher-level financial authorities according to current regulations.
2. Responsibilities of the Military Social Insurance
a) Policy Department - General Political Department;
To主持与国防部财务局合作，根据国防部的社会保险收入计划，与越南社会保险建立年度休养和恢复健康经费预算。依据由越南社会保险根据不超过每年军队实际缴纳社会保险基金总额的0.6%（从每年军队实际缴纳社会保险基金总额的5%中提取，用于疾病、生育、工伤和职业病三种制度）分配给国防部的休养和恢复健康经费，根据社会保险收入计划及各主要单位的具体情况，政策局主持并与国防部财务局合作，分配休养和恢复健康的经费，并指导各主要单位预先拨付休养和恢复健康的经费，以便各单位主动组织军人、国防公务员和合同工进行休养和恢复健康。政策局主持并与国防部相关职能机关合作，对各单位实施休养和恢复健康制度的情况进行检查和监督。
b) 国防部财务局 - 接收并按照现行财政管理规定管理休养和恢复健康的资金来源。
主持与总政治局政策局合作，指导和管理各主要单位与越南社会保险之间每年休养和恢复健康经费的决算工作，确保按照财政原则和制度及时、充分地保障受益人的权益。
IV. IMPLEMENTATION PROVISIONS
1. This Circular shall take effect fifteen days after its publication in the Official Gazette.
2. 对于军官、文职人员、士官和士兵的休养和恢复健康制度的规定，如果与本通知相冲突，则予以废除。
