Decree No. 3-CP On Tasks, Authorities, and Organizational Structure of the Central Overseas Vietnamese Affairs Board

DECREE

OF THE GOVERNMENT DECREE NO. 3-CP JANUARY 18, 1993 ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE STATE COMMITTEE FOR OVERSEAS VIETNAMESE

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

To strengthen and innovate work related to the community of Vietnamese residing abroad;

At the proposal of the Chairman of the State Committee for Overseas Vietnamese and the Minister, Head of the Government Organization-Cadre Department,

DECREE:

Article 1. - The State Committee for Overseas Vietnamese is an agency under the Government, having the function of state management and directing work concerning overseas Vietnamese (hereinafter referred to as overseas Vietnamese); it serves as the focal point for coordination between relevant sectors and levels within the country and diplomatic agencies of Vietnam abroad regarding overseas Vietnamese affairs, and is the link between the Government and overseas Vietnamese.

Article 2. - The State Committee for Overseas Vietnamese has the following tasks and powers:

1. Studying and grasping all aspects of the overseas Vietnamese community, coordinating with Ministries, ministerial-level agencies, government-affiliated agencies, and relevant organizations to propose to the Government negotiations and signing of international agreements with governments of countries where overseas Vietnamese reside to protect their legitimate rights and interests;

2. Formulating policies, directions, and methods of information dissemination and mobilization suitable to help overseas Vietnamese understand the situation of the homeland, promote patriotic traditions and national identity, widely unite and create favorable conditions for overseas Vietnamese to contribute to building their hometowns and the country, assist relatives living in the country; coordinating with the Vietnam Fatherland Front in mobilizing relatives of overseas Vietnamese within the country;

3. Drafting and submitting to the Government relevant policies concerning overseas Vietnamese and overseas Vietnamese affairs; independently issuing or jointly issuing with relevant sectors guidelines for implementing Government regulations related to overseas Vietnamese, overseas Vietnamese affairs, and monitoring and inspecting the implementation of issued documents;

4. Strengthening relations with intellectuals, financiers, and businesspeople who are overseas Vietnamese, and coordinating with relevant agencies and organizations to organize economic, scientific, technological, cultural-exchange, educational, and other forms of cooperation between overseas Vietnamese and within the country;

5. Supporting overseas Vietnamese in preserving national cultural identity and learning the Vietnamese language;

6. Coordinating with the Ministry of Home Affairs, the Ministry of Foreign Affairs, and Vietnamese representative offices abroad to handle entry, exit, residence, travel, employment, and repatriation procedures for overseas Vietnamese according to laws and regulations of the State;

7. Drafting and submitting to the Government plans for foreign-related activities concerning overseas Vietnamese affairs and organizing the implementation of such plans;

8. Training specialized staff for overseas Vietnamese affairs;

9. Managing organizational structure, staffing, and assigned facilities.

Article 3. - The organizational structure of the State Committee for Overseas Vietnamese includes:

- Office,

- Regional Affairs Division,

- Information and Culture Division,

- Economic Relations and Science and Technology Division,

- Information and Documentation Center.

Specific functions, tasks, and staffing of units within the Committee shall be stipulated by the Chairman of the State Committee for Overseas Vietnamese.

Article 4. - The State Committee for Overseas Vietnamese is headed by the Chairman; assisting the Chairman are Deputy Chairmen. The Chairman is responsible to the Prime Minister for all assigned work, and Deputy Chairmen are responsible to the Chairman for assigned tasks. The Chairman and Deputy Chairmen are appointed and relieved from office by the Prime Minister.

Article 5. - Establish the State Committee for Overseas Vietnamese directly under the People's Committee of Ho Chi Minh City. The establishment of State Committees for Overseas Vietnamese in other centrally governed cities and provinces shall be guided by the Minister, Head of the Government Organization-Cadre Department, and the Chairman of the State Committee for Overseas Vietnamese. In places with a large number of overseas Vietnamese but without a State Committee for Overseas Vietnamese, specialized staff for overseas Vietnamese affairs shall be assigned to the People's Committee Office or another agency of the centrally governed city or province People's Committee.

Abroad, overseas Vietnamese affairs are overseen by the head of Vietnamese diplomatic agencies. In key areas, there are specialized staff for overseas Vietnamese affairs.

The State Committee for Overseas Vietnamese is responsible for guiding policies and operational procedures for overseas Vietnamese affairs for provincial and centrally governed city organizations for overseas Vietnamese affairs and Vietnamese diplomatic agencies abroad.

Article 6. - This Decree replaces Government Decree No. 84-HĐBT dated July 28, 1983, and takes effect from the date of issuance. Previous regulations contrary to this Decree are abolished.

The Chairman of the State Committee for Overseas Vietnamese, Ministers, Heads of ministerial-level agencies, government-affiliated agencies, and Chairmen of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
