DIRECTIVE

OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

On the Review of Forests Before Submitting for Approval of Logging Design

To continue to improve the quality of logging designs and meet new requirements according to Directive 462-TTg dated September 11, 1993 of the Prime Minister, starting from 1994, the Ministry decides to conduct a review of all forests in each locality and unit's annual logging design before submitting it to the Ministry for approval.

The purpose and requirements of the forest review aim to enhance the authenticity of the forest areas intended for logging, prevent indiscriminate logging and logging that does not comply with the specified forest types.

 

I. CONTENTS OF FOREST REVIEW

The forest review is not a replacement for the approval of logging designs but must be conducted by localities and units prior to submitting the logging design dossier to the Ministry for approval. The review shall be carried out by specialized agencies designated by the Ministry and include the following contents:

1. Review of the forest types designed for logging:

The forest designed for logging must be production forests, not protective or special-use forests recognized by a decision of the Government or the Chairman of the provincial People's Committee.

It must be rich or medium-quality forests meeting the following criteria:

Having a volume greater than 120 m3/ha for evergreen forests in the South, where the volume of trees with a diameter greater than 35 cm must account for more than 80% of the total volume.

Having a volume exceeding 90 m3/ha for acacia forests.

Having a volume exceeding 80 m3/ha for evergreen forests in the North.

Having a volume exceeding 60 m3/ha for commercial timber forests.

For concentrated plantations, they must be harvested at the correct age.

Initially, the review will only cover natural forests selected for harvesting, nurturing harvesting areas, and plantation areas reaching the harvesting age (financed by state budget, aid, or loans).

Regarding place names: Verify whether the small district code and plot code match those planned according to the approved forest management plan.

In cases where there are changes in resources (increase or decrease) compared to the published forest inventory data, the forest owner must proactively request the Ministry to amend the approved forest management plan.

If there are changes in small districts or plots that do not conform to the planning of the forest management plan, the forest owner must submit a report along with the logging design dossier. The forest review agency will review based on the new place names, which the provincial department and central association will consolidate and report to the Ministry’s logging design approval council.

2. Review of quantitative indicators related to logging including:

The area of forest designed for logging;

Volume;

Yield;

Types of wood;

The amount of transportation, loading, unloading, storage... required to ensure the implementation of the logging process across the entire logging area.

3. Review whether newly designed logging areas overlap with areas that have been logged and are currently closed during a logging cycle.

 

II. RESULTS OF FOREST REVIEW

The results of the forest review are confirmation certificates issued by the forest review agency for each forest owner regarding the above contents according to a unified national form (attached as Appendix I and Appendix II).

Annually, the schedule for the Ministry’s logging design approval council is from mid-July (for the Northern region) and mid-August (for the Southern region) to complete the approval nationwide by September.

By October, sufficient files and data should be compiled to submit to the Government.

Based on this schedule, forest owners (at the provincial level and directly affiliated associations under the Ministry) must complete their logging designs in time for the forest review agencies to have enough time to conduct reviews.

Specifically:

1. For forest owners:

Northern units: Must complete the logging design dossier by May 15 each year.

Southern units: Must complete the logging design dossier by June 15 each year.

2. For forest review units:

Northern units: Must complete the confirmation certificate of the forest review by June 30 each year.

Southern units: Must complete the confirmation certificate of the forest review by July 31 each year.

Localities and units must organize implementation according to the schedule provided above and strictly adhere to the Ministry's general time frame.

 

III. UNITS ASSIGNED TO CONDUCT FOREST REVIEWS

The agency assigned to conduct forest reviews is the Institute of Forest Inventory and Planning. The person responsible before the Ministry for forest reviews is the Director of the Institute of Forest Inventory and Planning.

The workforce to carry out forest reviews is mobilized by the Director of the Institute of Forest Inventory and Planning, including investigation teams and planning teams from the Institute and localities through economic contracts.

When the reviewing unit is also the logging design unit, it is essential to have a local forest protection team accompany the review and sign off on the confirmation certificates with the seal of the local forest protection bureau.

 

IV. REGARDING COSTS FOR FOREST REVIEWS

The cost of forest reviews is included in the cost of harvested timber.

The Institute of Forest Inventory and Planning bases this directive to establish standards and pricing for forest reviews of different types of forests in various regions, to be submitted to the Ministry for approval as the basis for signing review contracts with forest owners.

The Institute of Forest Inventory and Planning develops a method for forest reviews to be submitted to the Ministry for approval.

 

V. RESPONSIBILITIES OF THE LOGGING DESIGN APPROVAL COUNCIL
LOGGING DESIGN

The Ministry’s logging design approval council can only approve dossiers of forest owners who have received confirmation certificates of forest reviews. Logging designs will not be approved without a confirmation certificate of forest review.

Upon receipt of this directive, the Directors of Forestry Departments, Agriculture and Forestry Departments of directly affiliated associations under the Ministry, relevant Bureaus, Departments, and the Institute of Forest Inventory and Planning are requested to implement it urgently.
