Guidelines for Implementing Subsidies for Workers and Administrative Civil Servants in Public Services and Social Policy Beneficiaries
In accordance with Decision No. 129/HĐBT dated April 20, 1991 of the Council of Ministers on subsidies for workers and administrative civil servants in public services, military forces, and social policy beneficiaries, after exchanging opinions with the Vietnam General Confederation of Labor, the Ministry of Labor - War Invalids and Social Affairs - Finance jointly issues these guidelines for implementation as follows:
1. Recipients, Calculation Method, and Source of Payment: This subsidy shall be implemented as prescribed in Circulars No. 9/TT-LB dated September 10, 1990 and No. 1/TT-LB dated January 9, 1991 of the Ministry of Labor - War Invalids and Social Affairs - Finance guiding the implementation of Decisions No. 319-HĐBT dated September 4, 1990 and No. 449-HĐBT dated December 31, 1990 of the Council of Ministers.
The 40% advance subsidy and the 15% current subsidy shall not be added to the base salary (rank or position), living allowance, scholarship, or other allowances when calculating additional allowances.
Military forces have separate circulars guiding this matter.
2. Subsidy Level: The recipients mentioned in Point 1 above, in addition to the current 40% subsidy, from May 1, 1991, will receive an additional monthly subsidy of 15% of their rank or position salary, pension, social insurance benefit, initial retirement benefit, disability benefit, living allowance, termination benefit, etc., recalculated according to Decision No. 203-HĐBT dated December 28, 1988 of the Council of Ministers.
If the calculated 15% subsidy does not reach 4,000 dong per month, it will be supplemented to reach 4,000 dong per month (see attached annex).
This subsidy will be recorded in the corresponding chapter, category, section, and subcategory, item 70 of the current State Budget Manual.
3. Dependents of martyrs, those who contributed to the revolution, and caregivers of Class 1/4 war invalids or Class 1/3 disabled veterans (if applicable) receiving a living allowance, also receive a subsidy of 22,500 dong per month plus the 40% subsidy (according to Circular No. 11/CĐ dated February 7, 1991 of the Ministry of Labor - War Invalids and Social Affairs) and fall under the scope of this circular's provisions.
4. For workers and civil servants in production and business areas, this subsidy only applies when settling social insurance benefits, termination benefits, and is included in product costs or circulation fees.
5. This circular takes effect from May 1, 1991. For cases of relocation, if the transfer document is signed before May 1, 1991, the new unit receiving them will pay the subsidy according to the above regulations. If the transfer document is signed after May 1, 1991, the old unit issuing the transfer document must pay the May 1991 subsidy to the recipient.
In places where higher additional subsidy levels have been self-determined compared to the Council of Ministers' decision, they must be reduced to match the subsidy level stipulated in Article 1 of Decision No. 129-HĐBT dated April 20, 1991 of the Council of Ministers. The State budget will only settle accounts for the salaries and subsidies of the aforementioned recipients according to the level specified in Article 1 of Decision No. 129-HĐBT dated April 20, 1991 of the Council of Ministers.
During the implementation process, if there are any difficulties, please report them to the Ministry for research and resolution.
