DIRECTIVE

Regarding urban planning and construction management

In recent years, there have been positive changes in urban planning and construction management, but many shortcomings still exist: Detailed planning is still insufficient and fails to meet investment development and urban management requirements; the quality of planning projects generally remains limited; urban construction management has not yet effectively controlled urban development; administrative procedures are still cumbersome; there are cases of chaotic construction without permits or in violation of regulations, disrupting planning; cultural, historical sites, and landscapes are being violated; the urban environment is polluted; infrastructure is lacking and not synchronized; order in architecture and urban construction has not been established.

To address the aforementioned issues, the Prime Minister instructs ministries, sectors, provincial People's Committees under the central government, and each level of urban administration to implement the following tasks:

1. The Chairpersons of provincial People's Committees under the central government and each level of urban administration shall organize the dissemination, propaganda, and mobilization of cadres and people to thoroughly understand the viewpoints, goals, and path of urban development during the period of industrialization and modernization; actively participate in campaigns to build green, clean, beautiful cities, and maintain civilized lifestyles.

The Ministry of Construction shall take the lead, coordinate with relevant ministries, sectors, and localities to implement the movement for excellence in "Sustainable Urban Development" to develop many exemplary urban models for the whole country to learn from and follow.

2. The Ministry of Construction shall organize the collection of opinions from related ministries and sectors to complete and issue the Framework Program for Implementing the Orientation of Overall Urban Development Planning in Vietnam until 2020, which has been approved by the Prime Minister, in 1999. Based on this, it shall organize the implementation of overall planning for the system of urban areas in key regions and urbanized areas, submit them to the Prime Minister for approval, and serve as the basis for formulating programs and plans suitable for each stage of development.

Provincial People's Committees under the central government shall base themselves on the Overall Economic-Social Development Plan and the Orientation of Overall Urban Development Planning throughout the country until 2020 to direct the establishment and approval of the overall planning for the system of urban areas and rural residential zones within their provinces and cities after obtaining unified opinions from the Ministry of Construction, the Ministry of Planning and Investment, and related ministries and sectors.

The Ministry of Construction and the Government Organization-Cadre Department shall study and draft the Decree on Urban Classification and Urban Management Levels; amend and supplement the criteria for evaluating and classifying urban areas and urban management levels to be submitted to the Government for consideration and decision-making, serving as the basis for continuing to guide the arrangement of urban systems across the country.

3. Based on the Overall Economic-Social Development Plan for regions and the Orientation of Overall Urban Development Planning throughout the country until 2020, the Ministry of Construction and provincial People's Committees under the central government shall review and adjust urban construction planning projects until 2020 according to the spirit of Directive No. 32/1998/CT-TTg dated September 23, 1998, issued by the Prime Minister.

The Ministry of Planning and Investment and the Ministry of Construction shall coordinate with related ministries and sectors to guide localities in building annual and five-year survey and design planning programs to ensure that planning work has practical and effective impacts.

The Ministry of Planning and Investment shall take the lead, coordinate with the Ministry of Finance to plan annual funding for planning work, while jointly with the Ministry of Construction to study mechanisms for generating funds for planning; accelerate the progress of detailed planning and specialized construction planning preparation and review.

The Ministry of Construction shall take the lead, coordinate with related ministries and sectors to continue reforming planning and reviewing construction planning work to improve the quality of construction planning projects, meeting economic-social development requirements, environmental protection, disaster prevention, flood control, and ensuring security and defense.

4. In accordance with the Government's Work Program for 1999 and the Law and Ordinance Drafting Program for the Tenth National Assembly Session, ministries, sectors, and localities shall organize the review, amendment, and drafting of new regulatory legal documents and policies on urban management and development. The Ministry of Justice shall plan inspections and guidance to properly implement these tasks.

5. To proactively mobilize investment capital for urban development, the Ministry of Planning and Investment and the Ministry of Construction shall coordinate with relevant ministries, sectors, and localities to develop an urban infrastructure development investment program until 2005 and beyond, including projects for constructing production infrastructure, technical infrastructure, social infrastructure, and environmental protection and urban sanitation works to be submitted to the Prime Minister for approval to serve as the basis for attracting investment capital and guiding the implementation of urban construction projects effectively.

The Ministry of Planning and Investment shall take the lead, coordinate with the Ministry of Finance to review and supplement policies and mechanisms to encourage and provide preferential treatment for investment.

The Ministry of Finance shall establish mechanisms and policies to mobilize various sources of capital, especially capital from the public; form urban development funds; increase revenue from urban services; use housing and land funds efficiently to create capital for urban renovation and development.

6. To implement the task of restoring architectural and urban construction order, actively controlling urban development according to planning, plans, and laws, the Ministry of Construction and provincial People's Committees under the central government shall promptly issue Construction Management Regulations based on approved planning. By the fourth quarter of 2000, the Ministry of Construction shall submit to the Prime Minister for approval the Orientation of Architectural Development in Vietnam until 2020.

The Ministry of Transport and the Ministry of Construction shall direct and guide the establishment of planning, determination of traffic safety corridors, and effective measures to strengthen construction management along water and road transportation axes; stop spontaneous construction causing congestion, compromising traffic safety, and illegal use of agricultural land.

The National Land Administration shall take the lead and coordinate with the Ministry of Construction to focus on directing urban land management and usage; accelerate the progress of surveying, registration, and issuance of certificates for land use rights and house ownership.

Provincial People's Committees and municipal authorities at all levels must regularly organize inspections and audits according to their respective powers and responsibilities, and take decisive measures to address violations of laws and planning; quickly restore urban architectural, construction, and traffic order.

7. In order to enhance the effectiveness of state management in cities, the Government Organization and Cadre Affairs Commission shall take the lead and coordinate with relevant ministries and sectors to study the delegation of tasks, powers, and urban administrative structures towards strengthening the powers and responsibilities of urban authorities at each level in deciding issues related to urban management, particularly regarding planning and investment plans for public areas; infrastructure management and utilization; budget revenue and expenditure; organization and personnel; administrative procedure reform; resolution of complaints and lawsuits; and handling of administrative cases related thereto.

The Prime Minister requests that ministers, heads of ministerial-level agencies, and provincial and municipal people's committee chairpersons under the central government pay utmost attention and develop plans to strictly implement this Directive.

The Ministry of Construction shall take the lead and coordinate with relevant ministries, sectors, and provincial and municipal people's committees to monitor, guide, and periodically report to the Prime Minister on the implementation of this Directive.
