JOINT CIRCULAR No. 30/2000/TTLT-BLDTBXH-BTC OF THE MINISTRY OF LABOR - INVALIDS AND SOCIAL AFFAIRS AND THE MINISTRY OF FINANCE ON DECEMBER 29, 2000 GUIDING THE SUBSIDY REGIME FOR WORKING AT SEA FOR WORKERS AND OFFICIALS OF ENTERPRISES IN THE FISHERIES SECTOR AND METEOROLOGY-HYDROLOGY
Pursuant to Decision No. 611/TTg dated September 4, 1996 of the Prime Minister and the opinion of the Prime Minister in Document No. 854/CP-VX dated August 14, 1999 of the Government regarding the subsidy regime for working at sea for workers and officials of public enterprises, after exchanging opinions with relevant ministries and sectors, the Joint Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance guide the implementation of the subsidy regime for working at sea for workers and officials in certain special occupations in public enterprises in the Fisheries sector and Meteorology-Hydrology as follows:
I. APPLICABLE OBJECTS
1. The subjects applying the subsidy regime when going to sea as prescribed in this Circular are workers and officials belonging to the ship's crew of marine research vessels under public enterprises in the Fisheries sector and Meteorology-Hydrology.
2. The provisions of this Circular shall not apply to the following subjects:
- Staff measuring data and conducting marine research in the Meteorology-Hydrology sector (receiving benefits according to Decision No. 819/TTg dated December 14, 1995 of the Prime Minister);
- Inspectors and Control Officers protecting fishery resources; staff and sailors belonging to the crew working on inspection vessels for fishery resources (also known as fisheries patrol boats) in the Fisheries sector (receiving benefits according to Decision No. 913/1997/QĐ-TTg dated October 25, 1997 of the Prime Minister).
II. BENEFITS TO BE RECEIVED
1. Rationed meal system:
a. The subjects mentioned above in Section I shall apply the rationed meal system level II attached as an appendix to Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.
b. The method of calculating the rationed meal system is stipulated in Point 3, Section I, Circular No. 06/LB-TT dated February 28, 1997 of the Joint Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance guiding Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.
c. Public enterprises shall not pay in cash but must organize meals to ensure the standard rationed meal system by physical goods for the subjects as prescribed. In exceptional cases (subjects working in dispersed areas), if it is impossible to organize meals, they shall be granted the standard rationed meal system in cash for workers and officials to organize their own meals.
d. Subjects receiving the rationed meal system must pay 30% of the stipulated rationed meal system cost, the remaining 70% of the rationed meal system cost shall be paid by the unit from the annual regular budget mission of the unit (for units under state budget planning) or included in the value of the project.
e. Subjects receiving the rationed meal system shall not enjoy the hazardous and dangerous subsidy in physical goods; mid-shift meals; travel expenses according to current regulations; and shall not be included in the wage rate.
2. Freshwater shortage system:
a. The aforementioned subjects shall apply the freshwater shortage system as stipulated in Point 2, Article 1 of Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.
b. The method of determining the freshwater shortage area and the calculation of costs for purchasing and transporting freshwater is stipulated in Joint Circular No. 06/LB-TT dated February 28, 1997 of the Joint Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance guiding the implementation of Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.
c. Public enterprises have the responsibility to ensure the supply of clean water for daily use for workers and officials as prescribed, and shall not pay in cash for workers and officials to arrange their own.
d. The difference between the actual purchase and transportation costs of daily water and the water costs already included in wages shall be paid from the annual regular budget mission of the unit (for units under state budget planning) or included in the value of the project.
III. IMPLEMENTATION
This Circular takes effect from January 1, 2000.
During the implementation process, if there are any difficulties, please reflect them to the Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance for study and resolution.
