JOINT CIRCULAR

Guidelines on allowances for working at sea for workers and officials of fisheries and meteorology-hydrology public service units

Pursuant to Decision No. 611/TTg dated September 4, 1996 of the Prime Minister and the opinion of the Prime Minister in Government Document No. 854/CP-VX dated August 14, 1999 regarding allowances for working at sea for workers and officials of public service units, after exchanging opinions with relevant Ministries and Departments, the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance hereby issue guidelines on allowances for working at sea for workers and officials in certain special occupations in public service units of the Fisheries and Meteorology-Hydrology sectors as follows:

I. APPLICABLE OBJECTS

1. The subjects to whom the allowance regulations stipulated in this Circular apply are workers and officials under the ship's crew of research vessels belonging to public service units of the Fisheries and Meteorology-Hydrology sectors.

2. The provisions of this Circular shall not apply to the following subjects:

- Measuring and researching staff of the Meteorology-Hydrology sector (receiving allowances according to Decision No. 819/TTg dated December 14, 1995 of the Prime Minister);

- Inspectors and controllers protecting aquatic resources; Officials and crew members under the ship's crew of inspection vessels for aquatic resources protection (also known as fishery surveillance vessels) of the Fisheries sector (receiving allowances according to Decision No. 913/1997/QĐ-TTg dated October 25, 1997 of the Prime Minister).

II. BENEFITS TO BE RECEIVED

1. Rationed meal system:

a. The subjects mentioned above shall be subject to the rationed meal system level II as specified in the annex accompanying Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.

b. The method of calculating the rationed meal system is regulated in Point 3, Section I, Circular No. 06/LB-TT dated February 28, 1997 of the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance guiding Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.

c. Public service units shall organize meals to ensure the standard rationed meal system by physical goods for the subjects as prescribed. In exceptional cases (where work is scattered), if it is impossible to organize meals, the standard rationed meal system can be paid out in cash for workers and officials to organize their own meals.

d. Subjects receiving the rationed meal system must pay 30% of the meal allowance amount as prescribed, while the remaining 70% of the cost of the rationed meal system shall be borne by the unit from the annual regular budget mission of the unit (for budgetary units) or included in the value of the project.

e. Subjects receiving the rationed meal system shall not receive hazardous and dangerous allowances in kind; mid-shift meals; travel expenses according to current regulations; and shall not be included in the wage rate.

2. Freshwater shortage allowance:

a. The aforementioned subjects shall be subject to the freshwater shortage allowance as stipulated in Point 2, Article 1, Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.

b. The determination of areas with freshwater shortages and the calculation of costs for purchasing and transporting freshwater are regulated in Joint Circular No. 06/LB-TT dated February 28, 1997 of the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance guiding the implementation of Decision No. 611/TTg dated September 4, 1996 of the Prime Minister.

c. Public service units have the responsibility to ensure the provision of clean water for daily use for workers and officials as prescribed, and shall not pay in cash for workers and officials to provide for themselves.

d. The difference between the actual cost of purchasing and transporting fresh water according to standards and the cost of fresh water already included in wages shall be covered from the annual regular budget mission of the unit (for budgetary units) or included in the value of the project.

III. IMPLEMENTATION

This Circular takes effect from January 1, 2000.

During the implementation process, if there are any difficulties, please report to the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance for study and resolution.
