MINISTRY OF SCIENCE, TECHNOLOGY AND ENVIRONMENT

Pursuant to the Measurement Ordinance dated October 6, 1999;

Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment;

At the proposal of the Director General of the Standard Measurement Quality Administration,

 

DECISION:

Article 1.Issued herewith is the "Regulation on Measurement for Pre-Packaged Goods with Quantities Stated by Weight or Volume."

Article 2.The Director General of the Standard Measurement Quality Administration shall be responsible for guiding and supervising the implementation of this Decision.

Article 3.THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 4.The Standard Measurement Quality Administration, local standard measurement quality bureaus, and related organizations and individuals shall be responsible for implementing this Decision.

1. General Provisions

1.1. These regulations stipulate requirements for measurement of goods that are labeled and packaged with uniform predetermined quantities by weight or volume (hereinafter referred to as pre-packaged goods) and are used to inspect pre-packaged goods listed in the State Management Catalogue for Measurement issued by the Ministry of Science, Technology, and Environment.

This document may also be referenced for application to pre-packaged goods not included in the aforementioned Catalogue.

1.2. Organizations and individuals producing, importing, repackaging (bottling), packaging, and trading in pre-packaged goods listed in the aforementioned Catalogue (hereinafter referred to as enterprises) must ensure that pre-packaged goods comply with the quantity specifications set forth herein.

1.3. The Standard Measurement Quality Administration shall be responsible for organizing inspections of pre-packaged goods. Inspections of pre-packaged goods shall be carried out at enterprises.

1.4. Terms used in these regulations shall be understood as follows:

1.4.1. Pre-packaged goods are goods that are quantified and packaged without customer witnessing.

1.4.2. Predetermined quantity (Qn) of a unit of pre-packaged goods is the quantity of goods indicated on the packaging.

1.4.3. Actual contained quantity (QF) of a unit of pre-packaged goods is the actual quantity of goods contained within the packaging; in the case of packaging by weight, it is the net weight, and in the case of packaging by volume, it is the net volume.

1.4.4. Minimum permissible contained quantity (QMaximum Downhill Gradient) of a unit of pre-packaged goods is the difference between the predetermined quantity (Qn) and the permissible shortage limit (T) specified in Table 1.

1.4.5. Non-conforming unit of pre-packaged goods (hereinafter referred to as non-conforming unit) is a unit of pre-packaged goods with an actual contained quantity (QF) less than the minimum permissible contained quantity (QMaximum Downhill Gradient).

1.4.6. Lot of pre-packaged goods (hereinafter referred to as lot) is a collection of units of pre-packaged goods with the same predetermined quantity packaged under the same conditions.

1.4.7. Lot size (N) is the number of units of pre-packaged goods in a lot.

At enterprises engaged in repackaging (bottling), packaging, the lot size is calculated based on the number of units of pre-packaged goods in a single warehouse entry but not exceeding 10,000 units. At production enterprises, the lot size is calculated based on the production output of the packaging line in one hour; in this case, the lot size may exceed 10,000 units.

1.5. Pre-packaged goods must be labeled in accordance with current laws on product labeling.

2. Measurement Requirements

2.1 Permissible Shortage Limit

The permissible shortage limit for units of pre-packaged goods with a predetermined quantity Qnis specified in the table below:

2.2 Average Value

2.2.1 When inspecting 100% of a lot of pre-packaged goods, the average actual contained quantity Qtbof the lot of pre-packaged goods must not be less than the predetermined quantity Qn.

2.2.2 When inspecting a lot of pre-packaged goods using sampling methods, the average actual contained quantity Xtb of the sample must not be less than the value specified below:

2.3 Number of Non-Conforming Units

2.3.1 When inspecting 100% of a lot of pre-packaged goods, the number of non-conforming units in the lot must not exceed 2% of the lot size (N); none of the pre-packaged goods in the lot should have a shortage greater than twice the permissible shortage limit.

2.3.2 When inspecting a lot of pre-packaged goods using sampling methods, the number of non-conforming units in the sample must not exceed the permissible number of non-conforming units depending on the sampling method.

3. Conducting Inspections

3.1 For pre-packaged goods with quantities stated by weight:

Determine the net weight of each unit of pre-packaged goods by weighing the total weight and then subtracting the weight of the packaging.

3.2 For pre-packaged goods with quantities stated by volume:

Determine the net volume of each unit of pre-packaged goods using direct or indirect methods.

Direct Method: Measure liquid volume using measuring containers (measuring jugs, graduated tubes).

Indirect Method: Determine the volume of goods by weighing to determine the weight and specific gravity of the goods.

3.3 Sampling methods for inspecting pre-packaged goods are prescribed by the Standard Measurement Quality Administration./.
