 Pursuant to Decree No. 102/SL-L004 dated May 20, 1957 on the right to establish Associations;

Pursuant to the Government's Decree No. 45/2003/NĐ-CP dated May 9, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Government Decree No. 88/2003/NĐ-CP dated July 30, 2003 on organization, operation, and management of Associations;

Considering the proposal of the Association for Southeast Asian Studies and the Director of the Department of Non-Governmental Organizations, Ministry of Home Affairs,

 DECISION:

Clause 4 of Article 6Approves the Charter of the Association for Southeast Asian Studies of Vietnam which was adopted at the Second General Assembly on December 21, 2004.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Chairman of the Association for Southeast Asian Studies of Vietnam, the Director of the Department of Non-Governmental Organizations, and the Head of the Office of the Ministry of Home Affairs are responsible for implementing this Decision./.

CHARTER (Amended)

 

The Association for Southeast Asian Studies of Vietnam

(Pursuant to Decision No. 30/2005/QĐ-BNV dated March 4, 2005 signed by the Minister of Home Affairs approving the Charter of the Association for Southeast Asian Studies of Vietnam)

NAME - AIMS - OBJECTIVES

PART I

Name of the Association: The Association for Southeast Asian Studies of Vietnam (referred to as the Southeast Asian Science Association - Vietnam).

Article 1. - International name: Southeast Asian Research Association of Vietnam

- Abbreviation (SEARAV).

- The Association for Southeast Asian Studies of Vietnam is a social-professional organization of Vietnamese citizens engaged in scientific research activities and performing specialized and professional work on Southeast Asia.

Article 2.

- The purpose of the Association is to gather and unite those involved in scientific research, teaching, applying science and technology, economics, society, and those interested in common areas related to Southeast Asia and ASEAN - aiming to assist each other in conducting professional activities, contributing to the economic and social development of the country, and enhancing international cooperation in the Southeast Asian region and globally for a peaceful, friendly, and sustainable Southeast Asia.

The Association for Southeast Asian Studies of Vietnam has legal personality, its own seal, assets, and finances, operating nationwide. The headquarters of the Central Association is located in Hanoi. When necessary, the Association may establish representative offices in localities within the country and abroad according to the provisions of the law.

Article 3. The Association for Southeast Asian Studies of Vietnam has the following tasks:

Chapter II

TASKS

Article 4. 1. To gather scientists, experts, businesspeople, and all those who are voluntarily interested in Southeast Asia to jointly conduct research, exchange information, and cooperate in development across historical, cultural, legal, economic, scientific and technological, educational training, ecological environmental, and community health care fields (HIV/AIDS prevention, reproductive health...).

* The Association welcomes overseas Vietnamese and foreigners to collaborate with the Association in appropriate forms according to the aims and objectives of the Association as stipulated.

2. The Association serves as a center for uniting members to build extensive relationships both domestically and internationally, helping each other improve professional skills, encourage and create favorable opportunities for members to realize their creative aspirations.

3. To study relationships and trends of global integration across various dimensions, particularly the sustainable development cooperation of Vietnam with countries in the region and internationally.

4. To disseminate knowledge and information about Southeast Asia among ethnic communities in Vietnam, Southeast Asia, and the world. To train and cooperate in training with agencies, schools, educational centers in provinces, and other training institutions both domestically and abroad to enhance public awareness, community capacity, and develop human resources for national development.

5. To provide consultancy, participate in opinions, and implement social review and appraisal work on issues related to Southeast Asia and ASEAN for Party agencies, state agencies, and organizations both domestically and internationally (if required).

6. To participate in promoting and disseminating laws to members and the community. To organize and implement programs to eliminate poverty, support, and help disadvantaged groups. To implement environmental protection and sustainable development programs. To participate in other economic and social development programs according to the law.

7. To develop international cooperation with associations, non-governmental organizations, research and teaching institutions in the Southeast Asian region and other countries around the world according to current laws to foster solidarity, friendship, and coordinated action for a peaceful, stable, and sustainably developing world.

8. To protect the legitimate rights of members.

9. To carry out other service and business activities according to the law to serve members and the operations of the Association.

Vietnamese citizens engaged in scientific research, teaching, and those with expertise and professions related to Southeast Asia, who agree with the Charter of the Association and voluntarily engage in the organization's activities can be admitted as regular members of the Association.

Chapter III

MEMBERS

Article 5. Those who have made positive contributions to the Association may be admitted as honorary members or associated members of the Association.

Individuals and entities wishing to join the Association must submit an application to join the Association. Admission of members is decided by the Executive Board of the Branch or by the Executive Board of the Central Association in two forms: collective membership and individual membership.

Article 6. Regular members of the Association have the following rights:

Article 7. 1. To propose suggestions, discuss, and vote on all matters of the Association, elect and run for positions in the leadership bodies of the Association.

2. To participate in organizational structures and activities of the Association.

3. To receive support and encouragement from the Association and, under Article 4 of Chapter II, to have their legitimate rights protected.

1. To comply with the laws of the State.

Article 8. Members have the following duties:

To respect the Charter of the Association, implement directives, resolutions, and decisions of the Association.

2. To promote the influence and reputation of the Association, pay membership fees.

The structure of the Association includes the Central Association, Branches organized at the grassroots level comprising Institutes, Schools, research agencies on Southeast Asian countries, Unions, member companies directly subordinate to the Central Association. The Association has press, publishing, and educational institutions operating according to the laws of the Socialist Republic of Vietnam.

Chapter IV

Article 8. Principles of Organization

Article 9. The organization of the Association includes the Central Association, and Branch Associations established at the grassroots level comprising Institutes, Schools, scientific research agencies on Southeast Asian countries, Unions, and member companies directly subordinate to the Central Association. The Association has press, publishing, and educational institutions operating in accordance with the laws of the Socialist Republic of Vietnam.

Article 10. The highest leading body of the Association is the National Congress of Delegates of the Association, held once every five years. In cases of necessity, an extraordinary Congress may be convened if more than two-thirds of the members of the Executive Board request it, or if more than half of the Association members request it, or if state management agencies require it according to the provisions of the law.

- The National Congress of Delegates has the duty to approve the report of the Central Executive Board.

- Decide on the policy, tasks, direction of work, and organizations of the Association.

- Decide on the supplementation and amendment of the Charter of the Association.

- Elect the Central Executive Board.

Article 11. The Central Executive Board is the highest leading body of the Association between two National Congresses of Delegates: It has the duty to organize the implementation of the resolutions of the Congress, and has the right to dismiss and supplement members of the Executive Board when deemed necessary and with the approval of two-thirds of the total number of members. The number of replacement members shall not exceed one-third of the total number of members elected by the Congress.

The Central Executive Board meets twice a year, convened by the Standing Committee, and can hold extraordinary meetings when the Standing Committee deems it necessary, or if more than half of the total number of Executive Board members request it.

Article 12. The Central Executive Board elects the Standing Committee consisting of the Chairman, Vice Chairmen, Secretary General, Deputy Secretaries General, and Standing Members. The Standing Committee is the permanent body of the Central Executive Board, responsible for directing the activities of the Association between two sessions of the Executive Board.

- The Central Standing Committee assists the Chairman in managing the general affairs of the Association. The Secretary General is responsible for managing the daily operations of the Association. The Deputy Secretaries General assist the Secretary General. The members of the Secretariat are nominated by the Secretary General and appointed by the Chairman.

- Depending on the situation, the Standing Committee may establish specialized committees responsible for specific areas of work and organize service activities of the Association.

- The Inspection Board is authorized by the Congress to be elected by the Executive Board. The Inspection Board has the duty to monitor the implementation of the Charter and regulations in the activities of members, subordinate units, and propose recommendations for disciplinary measures to be decided by the Executive Board (or the Disciplinary Council established by the Executive Board) according to the Charter and the law.

Article 13.

- The Congress of Branch Associations is held once every two and a half years.

- The Congress of Branch Associations elects Branch Presidents and Vice Presidents.

Chapter V

FINANCE

Article 14. The financial resources of the Association include:

- Membership fees.

- Sponsorship from supporting agencies.

- Legal gifts from individuals, agencies, and organizations both domestically and internationally.

- Legal income generated from the activities of the Association.

Article 15. The assets of the Association include:

- Association buildings and working equipment.

- The Central Executive Board stipulates principles and regulations for the management and use of the Association's financial resources and assets. Financial resources at each level are managed by that level.

Article 16. The financial resources of the Association are managed and utilized according to the financial regulations of the State.

Chapter VI

AWARDS - DISCIPLINE

Article 17. Members or organizations that achieve outstanding results in the work of the Association are rewarded by Association agencies, or recommended for rewards by state agencies, the Vietnam Fatherland Front.

Article 18. Members or organizations who violate the law, the Charter of the Association, or engage in actions detrimental to the reputation of the Association will be subject to one of the following disciplinary measures depending on the severity of the violation: Reprimand, warning, or expulsion if they are members, warning or dissolution if they are Branch Associations or Sub-Branch Associations. Cases involving violations of the law will be referred to competent authorities for handling according to current regulations.

Chapter VII

EFFECTIVENESS AND AMENDMENT OF THE ASSOCIATION CHARTER

Article 19. Only the National Congress of Delegates has the authority to amend and supplement the Charter of the Association. When considering supplements, at least two-thirds of the delegates of the Congress must be present. Decisions to amend or supplement the Charter must be approved by the competent state authority.

Article 20. The Charter consists of 7 Chapters and 20 Articles, which were adopted by the Second National Congress of the Vietnam Association for Southeast Asian Studies on December 21, 2004./.
