THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 4 of Decree No. 119/2006/NĐ-CP dated October 16, 2006 of the Government on the organization and operation of forest protection;

Pursuant to Decision No. 06/2007/QĐ-BNN dated January 23, 2007 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Forest Protection Department;

At the proposal of the Director of the Forest Protection Department and the Head of the Cadre and Civil Servant Organization Department.

DECISION:

Article 1. Position and Functions

1. Establishing the Forest Protection Agency Region I under the Forest Protection Department based on restructuring the Technical Center for Forest Protection No. I.

2. The Forest Protection Agency Region I shall perform the specialized management function regarding forest protection, fire prevention, and firefighting within the assigned region.

3. The Forest Protection Agency Region I has legal personality, its own seal, and receives funding from the state budget as prescribed by law, and is entitled to open bank accounts according to the law.

The headquarters of the Forest Protection Agency Region I is located in Ha Long City, Quang Ninh Province.

4. The scope of activities of the Forest Protection Agency Region I includes provinces and centrally governed cities (hereinafter referred to as provinces): Ninh Binh, Ha Nam, Nam Dinh, Ha Tay, Hanoi City, Hoa Binh, Son La, Dien Bien, Lai Chau, Lao Cai, Yen Bai, Ha Giang, Tuyen Quang, Phu Tho, Vinh Phuc, Thai Nguyen, Bac Kan, Cao Bang, Lang Son, Bac Giang, Bac Ninh, Quang Ninh, Hai Duong, Hai Hung, Thai Binh, and Hai Phong.

Article 2. Tasks and Authorities

1. Implement certain specialized management tasks regarding forest protection and ensuring compliance with laws on forest protection and development within the assigned region as follows:

a) Participate in developing programs, projects, standards, procedures, and technical regulations on forest protection, fire prevention and firefighting, nature conservation, biodiversity, and wildlife and plant management.

b) Guide, urge, and inspect the implementation of legal normative documents, programs, projects, standards, and technical procedures on forest protection, fire prevention and firefighting, nature conservation, biodiversity, and wildlife and plant management by provincial Forest Protection Agencies.

c) Guide and urge regional zoning for shifting cultivation; forest allocation; forest protection contracts.

d) Guide and inspect the implementation of measures against illegal logging and other unlawful acts that harm forests and forestry land.

đ) Guide and inspect the performance of state management responsibilities over forests and forestry land by forest owners in the region.

2. Carry out fire prevention and firefighting tasks:

a) Organize fire risk forecasting; develop plans, projects, and programs for fire prevention and firefighting in the region.

b) Coordinate and support provincial Forest Protection Agencies in fire prevention and firefighting.

c) Inspect activities related to forest protection, fire prevention, and firefighting.

d) Organize forces and coordinate with localities to stand guard and fight fires in national key areas.

3. Perform the following tasks when localities do not have Forest Protection Agencies responsible for them:

a) Manage and use forest inspection hammers.

b) Manage and use special forest product permits.

c) Advise on administrative violation handling and criminal prosecution of acts violating laws on forest management, forest protection, and forest product management.

4. Participate in training and professional development for forest officials and forest protection forces.

5. Participate in scientific and technological research and international cooperation as per the program and plan of the Forest Protection Department. Coordinate with regional Forest Protection Agencies to organize professional training and technical skill training for forest officials and forest protection forces.

6. Participate in publicizing knowledge, educating about laws on forest protection, fire prevention and firefighting, nature conservation, biodiversity, and wildlife and plant management.

7. Manage organizational structure, staff, finance, and assets allocated according to regulations.

8. Implement administrative reform, comply with information and reporting systems regularly and urgently as prescribed by the Forest Protection Department.

9. Perform other tasks assigned and delegated by the Director of the Forest Protection Department in accordance with the law.

Article 3. Organizational Structure

1. The leadership of the Forest Protection Agency Region I consists of a Director and Deputy Directors appointed and relieved of their positions by the Director of the Forest Protection Department according to regulations and the cadre management authority of the Minister of Agriculture and Rural Development.

The Director is responsible before the Director of the Forest Protection Department and the law for the tasks assigned.

Deputy Directors assist the Director, are responsible before the Director and the law for the tasks assigned by the Director.

2. Management structure:

a. Administrative and General Affairs Office;

b. Forest Protection Technology Office;

c. Mobile Forest Protection and Firefighting Team.

Delegate the Director of the Forest Protection Department to define the tasks of the management structure as stipulated in Clause 2 of this Article and allocate staffing for the Forest Protection Agency Region I according to the staffing quota assigned by the Ministry.

Entrust the Director of the Forest Protection Department to manage the recovery and submission of the seal of the Technical Center for Forest Protection No. I to the competent authority issuing the registration certificate for seal models as prescribed.

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days after its publication in the Official Gazette. Abolish previous decisions of the Ministry of Agriculture and Rural Development that conflict with this Decision.

2. The Director of the Forest Protection Department instructs the Director of the Technical Center for Forest Protection No. I to hand over the Technical Center in its original condition to the Director of the Forest Protection Agency Region I.

3. The Chief of the Office, Heads of the Cadre and Civil Servant Organization Department, the Director of the Forest Protection Department, Heads of relevant agencies and units under the Ministry, and the Director of the Forest Protection Agency Region I are responsible for implementing this Decision./.
