REGULATING THE SUSPENSION OF EXPORT LICENSES FOR IMPORTED FERTILIZERS AS PROVIDED IN CIRCULAR NO.
04/2006/TT-BTM dated April 6, 2006, OF THE MINISTRY OF TRADE (NOW THE MINISTRY OF INDUSTRY AND TRADE)

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
BASED ON DECREE NO. 12/2006/NĐ-CP dated January 23, 2006, OF THE GOVERNMENT PROVIDING GUIDELINES FOR THE IMPLEMENTATION OF THE COMMERCE LAW REGARDING INTERNATIONAL GOODS TRADING ACTIVITIES AND FOREIGN TRADE AGENCY PURCHASE, SALE, PROCESSING, AND TRANSIT ACTIVITIES;
THE MINISTER OF INDUSTRY AND TRADE REGULATES THE EXPORT OF IMPORTED FERTILIZERS AS PROVIDED IN DECREE NO. 12/2006/NĐ-CP dated January 23, 2006, OF THE GOVERNMENT PROVIDING GUIDELINES FOR THE IMPLEMENTATION OF THE COMMERCE LAW REGARDING INTERNATIONAL GOODS TRADING ACTIVITIES AND FOREIGN TRADE AGENCY PURCHASE, SALE, PROCESSING, AND TRANSIT ACTIVITIES AS FOLLOWS:
ARTICLE 1. REGULATIONS ON THE EXPORT OF IMPORTED FERTILIZERS
1. TEMPORARILY SUSPEND THE IMPLEMENTATION OF THE ISSUANCE OF EXPORT LICENSES FOR IMPORTED FERTILIZERS AS PROVIDED IN POINT a, CLAUSE 4, SECTION IV OF CIRCULAR NO. 04/2006/TT-BTM DATED APRIL 6, 2006, OF THE MINISTRY OF TRADE (NOW THE MINISTRY OF INDUSTRY AND TRADE) GUIDING CERTAIN PROVISIONS OF DECREE NO. 12/2006/NĐ-CP.
2. TRADERS WHO WISH TO EXPORT IMPORTED FERTILIZERS SHALL PROCEDURE EXPORT AT CUSTOMS AUTHORITIES IN ACCORDANCE WITH THE REGULATIONS, WITHOUT NEEDING TO APPLY FOR PERMISSION FROM THE MINISTRY OF INDUSTRY AND TRADE. THE RECEIPT OF PAYMENT FOR EXPORTED FERTILIZER MUST BE CONDUCTED THROUGH BANKS USING FREELY CONVERTIBLE FOREIGN CURRENCY.
Article 2. Effective Date
This Circular takes effect 45 days from the date of signature.
