CIRCULAR

REGULATIONS ON THE IMPORT OF SUPPLEMENTARY SUGAR UNDER THE SECOND ROUND OF CUSTOMS DUTY QUOTA IN 2010

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries;
To implement the guidance of the Prime Minister in Official Letter No. 1241/TTg-KTTH dated July 21, 2010 concerning the supplementation of customs duty quotas for sugar imports;
After consultation and agreement with the Ministry of Agriculture and Rural Development and the Ministry of Finance;
The Minister of Industry and Trade hereby stipulates the regulations on the supplementary import of sugar under the customs duty quota for 2010 as follows:

Article 1. Quantity of Supplementary Quota

Supplementing the customs duty quota for importing sugar in 2010 with an additional 100,000 tons of refined sugar and raw sugar (HS Code 1701).

Article 2. Recipients of Customs Duty Quota for Sugar Imports

1. Import of raw sugar for refining: 25,000 tons of raw sugar allocated to Biên Hòa Joint Stock Company for refining to supply for production and consumption.

2. Import of sugar for production purposes: 50,000 tons of refined sugar and raw sugar allocated to traders directly using sugar as raw material for production.

3. Import of sugar for commercial trade: 25,000 tons of refined sugar allocated to certain traders who have been assigned tasks to stabilize the market by relevant ministries and localities and who were previously allocated customs duty quotas for sugar imports in February 2010 to participate in stabilizing the market.

Article 3. Effectiveness

This Circular takes effect from the date of issuance until December 31, 2010.
