 JOINT CIRCULAR

Guidelines on coordinating the implementation of legal education and dissemination work in schools

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 93/2008/NĐ-CP dated August 22, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Resolution No. 61/2007/NQ-CP dated December 7, 2007 of the Government on continuing the implementation of Directive No. 32-CT/TW dated December 9, 2003 of the Secretariat of the Central Committee of the Communist Party of Vietnam (9th tenure) on strengthening the leadership of the Party in legal education and dissemination work, raising awareness of law observance among cadres, civil servants, and people;

Pursuant to Decision No. 1928/QĐ-TTg dated November 20, 2009 of the Prime Minister approving the Project "Improving the Quality of Legal Education and Dissemination Work in Schools";

The Ministry of Education and Training and the Ministry of Justice issue guidelines on coordinating the implementation of legal education and dissemination work in schools,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. These joint circulars provide guidelines for coordinating the implementation of legal education and dissemination work in schools, including: objectives, requirements, contents of coordination; responsibilities of relevant agencies and units in coordinating the implementation of legal education and dissemination work in schools.

2. These joint circulars apply to the Ministry of Education and Training, Departments of Education and Training, District Education and Training Offices (collectively referred to as educational management agencies); the Ministry of Justice, Departments of Justice, Judicial Offices (collectively referred to as judicial agencies); primary schools, secondary schools, high schools, general schools with multiple levels, universities, colleges, vocational colleges, and continuing education centers (collectively referred to as schools).

Article 2. Objectives and Requirements of Coordination

1. Objectives of Coordination

a) To enhance the quality and effectiveness of legal education and dissemination work in schools, contributing to raising legal awareness among staff, teachers, and students;

b) To supplement and improve conditions ensuring legal education and dissemination work in schools;

c) To promptly adjust and supplement programs, plans, and guidance for legal education and dissemination work in schools when there are amendments, supplements, or new promulgation of related regulatory documents.

2. Requirements for Coordination

a) To be consistent with the functions and tasks of each agency and unit and ensure uniformity from central to local levels;

b) To have specific and practical content, not to be ostentatious or formalistic, and to be conducted regularly, with focus and priority;

c) To leverage the proactive role of each agency and unit in coordination.

Chapter II

CONTENTS OF COORDINATION

Article 3. Development of Programs and Plans for Legal Education and Dissemination in Schools

1. Development of programs and plans for legal education and dissemination by educational management agencies and judicial agencies in schools.

2. Determining inter-agency programs and plans for legal education and dissemination between educational management agencies and judicial agencies at the same level.

Programs and plans for legal education and dissemination include annual, long-term, or thematic programs suitable for different groups within schools.

Article 4. Building and utilizing a team of teachers, lecturers, and legal propagandists for legal education and dissemination in schools

1. Surveying and evaluating the situation of teachers teaching ethics, civic education, and law courses; staff responsible for legal dissemination work in the education sector; and legal propagandists in the education sector.

2. Developing programs, materials, and organizing training and capacity building on legal dissemination and education for the subjects mentioned in Clause 1 of this Article.

3. Organizing training, guidance, and innovation in teaching methods according to textbooks and school curricula for law courses, ethics courses, and civic education courses suitable for age groups, school conditions, and regions.

4. Mobilizing cadres from judicial agencies and legal propagandists at all levels to participate in legal dissemination and education work in schools.

Article 5. Coordinating the compilation of programs, textbooks, and materials on legal dissemination and education; developing a list of equipment serving legal dissemination and education work

1. Developing and perfecting programs, textbooks, and school curricula for law courses, ethics courses, and civic education courses.

2. Compiling guidebooks and reference materials to serve the teaching and learning of law courses, ethics courses, and civic education courses.

3. Developing, compiling, and issuing materials and lists of equipment serving legal dissemination and education work in schools.

Article 6. Coordinating the construction of legal libraries, establishing research and legal advisory centers

1. Guiding the construction, management, and utilization of legal libraries in schools according to the provisions stipulated in Decision No. 06/2010/QĐ-TTg dated January 25, 2010, of the Government's Prime Minister;

2. Guiding research and legal advisory centers according to the provisions stipulated in Decision No. 1928/QĐ-TTg dated November 20, 2009, of the Government's Prime Minister.

Article 7. Coordinating scientific research on legal dissemination and education, organizing student excellence competitions and teacher excellence competitions in civic education and law courses

1. Conducting scientific research on legal dissemination and education, prioritizing the study of the need to understand laws and incorporating appropriate legal dissemination and education content into all educational levels and training programs.

2. Developing content and organizing student excellence competitions and teacher excellence competitions in civic education and law courses.

3. Organizing contests to enhance understanding of laws among administrative staff, educators, and learners at all educational levels and training programs.

4. Surveying practical legal dissemination and education activities in the education sector; sharing domestic and international information related to legal dissemination and education work in schools.

5. Reforming teaching and learning methods for law in a way that enhances the initiative and positivity of learners and the practicality of lectures given by teachers and lecturers.

Article 8. Coordinating inspections, mid-term reviews, and final summaries of legal dissemination and education work

1. Establishing inter-sectoral inspection teams to inspect legal dissemination and education work in schools.

2. Regularly conducting mid-term reviews, final summaries, and evaluations of effective legal dissemination and education forms in schools; rewarding outstanding performance in legal dissemination and education work in schools.

3. Holding annual coordination meetings on legal dissemination and education work in schools between educational management agencies and judicial agencies at the same level.

Chapter III

 RESPONSIBILITIES OF EDUCATIONAL MANAGEMENT AGENCIES, JUDICIAL AGENCIES, AND SCHOOLS

Article 9. Responsibilities of the educational management agency

1. Take the lead in developing programs, plans, organizing implementation, interim review, and final assessment of cooperative contents within the scope of authority stipulated in Chapter II of this Joint Circular.

2. Participate in developing programs and plans for the dissemination and education on laws by judicial agencies at the same level.

3. Utilize effectively the resources to serve the work of disseminating and educating laws in schools supported by judicial agencies.

4. Propose commendation or commend according to authority for agencies, units, judicial officers who have many achievements in the work of disseminating and educating laws in schools.

Article 10. Responsibilities of the judicial agency

1. Cooperate with the educational management agency at the same level to organize the implementation of activities within the scope of authority stipulated in Chapter II of this Joint Circular.

2. Take the lead in performing the following tasks:

a) Guide the content of law dissemination and education in the program and plan of inter-sectoral cooperation between both parties;

b) Propose the content of training programs, materials, and knowledge enhancement on laws and dissemination and education on laws;

c) Guide and support the construction, exploitation, and management of legal bookshelves in schools.

3. Incorporate the content of law dissemination and education in schools into regular activities in the annual plan for law dissemination and education of the judicial agency.

4. Direct and guide subordinate judicial agencies to actively participate in implementing cooperative activities for law dissemination and education in schools.

5. Assign responsible officials to monitor and participate in coordinating the implementation of law dissemination and education in schools.

6. Propose commendation or commend according to authority for agencies, units, schools, individuals in the education sector who have many achievements in the work of law dissemination and education.

Article 11. Responsibilities of the school

1. Effectively implement programs and plans for cooperative law dissemination and education according to functions, tasks, and contents stipulated in this Joint Circular.

2. Proactively contact judicial agencies in organizing cooperative work. Proactively identify and propose contents that need to be coordinated for law dissemination and education in schools with competent management agencies.

3. Report on cooperative work for law dissemination and education in schools together with periodic and ad hoc reports on law dissemination and education.

Chapter IV

IMPLEMENTATION

Article 12. Allocation of responsibilities

The Legal Affairs Department of the Ministry of Education and Training and the Department of Law Dissemination and Education of the Ministry of Justice shall assist the Minister of Education and Training and the Minister of Justice in coordinating the implementation of this Joint Circular.

Article 13. Implementation funds

Agencies involved shall allocate funds from the State budget allocated to the agencies and units to carry out assigned tasks.

Article 14. Effective Date

1. This Joint Circular takes effect from December 31, 2010.

2. The Heads of the Office of the Ministry of Education and Training, the Office of the Ministry of Justice, the Director of the Legal Affairs Department of the Ministry of Education and Training, the Director of the Department of Law Dissemination and Education of the Ministry of Justice, the Directors of Departments of Education and Training, the Directors of Departments of Justice, the Directors of universities and academies, the Principals of universities and colleges, the heads of relevant agencies and units under the Ministry of Education and Training and the Ministry of Justice are responsible for implementing this Joint Circular.
