This Circular stipulates the implementation of integration among cadastral surveying, mapping, or revising cadastral maps; land registration, registration of assets attached to land, issuance of Certificates of Land Use Rights, House Ownership Rights and Other Assets Attached to Land (hereinafter referred to as Certificate); construction of cadastral files, cadastral database.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs2. This Circular applies in the following cases:ona) Communes, wards, towns (hereinafter collectively referred to as commune) implement synchronously all tasks from cadastral surveying, mapping, or revising cadastral maps to land registration, registration of assets attached to land; issuance of new or replacement Certificates; construction of cadastral files, cadastral database; b) Communes have completed cadastral surveying, mapping, or revising cadastral maps, now implement partially or entirely remaining tasks regarding land registration, registration of assets attached to land; issuance of new or replacement Certificates; construction of cadastral files, cadastral database.1. State management agencies; specialized agencies on natural resources and environment and other relevant agencies; commune land officials. Number of employees and workers directly involved in the joint venture and association activities of the organization over the last 03 years2. Land users, owners of houses and other assets attached to land.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation

Article 3. Conditions for ensuring integrated implementation
1. Investment projects or economic and technical feasibility studies or technical designs and budgets approved must include all stages required to be implemented as follows:
a) In cases where cadastral surveying, mapping, or revising cadastral maps is required, the following stages must be carried out: cadastral surveying, mapping, or revising cadastral maps; land registration, registration of assets attached to land, issuance of Certificates; construction of cadastral files, cadastral database;
Article 2. Applicability
b) In cases where cadastral surveying, mapping, or revising cadastral maps has been completed but land registration and issuance of Certificates have not been completed, the following stages must be carried out: land registration, registration of assets attached to land, issuance of Certificates; construction of cadastral files, cadastral database.
2. Implementation plans must be developed and implemented uniformly for all participating forces including environmental resource agencies; land registration offices at provincial and district levels; People's Committees at commune level and consulting units (if any); which must clearly specify specific contents of each stage to be implemented; contents that need to be integrated between stages; deployment and completion times, inspection and acceptance times for each content of each stage; forces responsible for each specific content.
3. Funds for implementing the stages specified in Clause 1 of this Article must be fully allocated, ensuring sufficient time for implementation of each content and stage according to the approved plan.
4. Professional forces at commune, district, and provincial levels and consulting units (if any) directly participating in implementation in each commune must be organized into a unified force in a working group in each commune and district; clear responsibilities must be assigned to each member or group of members participating and a commitment to perform tasks must be signed between implementing forces, ensuring time according to the agreed plan.
CONTENTS OF INTEGRATED IMPLEMENTATION
a) In cases where cadastral maps need to be surveyed and established or corrected, the following steps must be carried out: surveying and establishing or correcting cadastral maps; registering land and property attached to the land, issuing Certificates of Land Use Rights; building cadastral files and cadastral databases;
b) In cases where cadastral maps have been completed but land registration and issuance of Certificates of Land Use Rights have not yet been completed, the following steps must be carried out: registering land and property attached to the land, issuing Certificates of Land Use Rights; building cadastral files and cadastral databases.
2. The implementation plan must be developed and implemented uniformly for all participating forces including natural resource and environment agencies; land registration offices at provincial, district levels; People's Committees at commune level and consulting units (if any); it must include detailed contents of specific tasks for each step that needs to be carried out; contents that need to be integrated between steps; deployment and completion times, inspection and acceptance times for each task within each step; the force implementing each specific task.
3. Funds for carrying out the steps specified in Clause 1 of this Article must be fully allocated, ensuring sufficient time for the implementation of each content and step according to the approved plan.
4. Professional forces at commune, district, provincial levels and consulting units (if any) directly participating in implementation at each commune must be organized into a unified force in a working group at each commune and district; there must be clear division of responsibilities for each member or group of members participating, and commitments to carry out tasks between implementing forces must be signed, ensuring the time according to the agreed plan.
Chapter II
CONTENTS TO BE INTEGRATED INTO IMPLEMENTATION
Article 4. Implementing the integration of land registration, registration of property attached to land, issuance of Certificates of Land Use Right into the process of surveying and preparing or amending cadastral maps.
For communes and districts that implement from the stage of surveying and preparing or amending cadastral maps, the contents of land registration, registration of property attached to land, and issuance of Certificates of Land Use Right shall be integrated into the surveying process according to the following regulations:
1. During the preparation for implementing surveying and preparing or amending cadastral maps, it is necessary to integrate preparatory work for organizing land declaration and registration, including property attached to land, such as collecting, checking, and evaluating cadastral files; compiling lists of cases requiring land declaration and registration, first-time issuance of Certificates of Land Use Right, cases requiring replacement of Certificates of Land Use Right, and cases requiring registration of land changes.
2. During the implementation of determining land plot boundaries and detailed surveying of cadastral maps on-site, it is necessary to integrate work serving land registration and issuance of Certificates of Land Use Right, including collecting information about current land use purposes, current land users; land use origin; land use disputes; changes in land plot boundaries and areas compared to land use right documents (if any).
3. During the process of delivering survey results of cadastral land plots to land users, it is necessary to integrate the issuance and guidance for filling out forms and registering applications for first-time issuance of Certificates of Land Use Right, applications for replacement of Certificates of Land Use Right, and applications for registration of land changes (hereinafter referred to as registration applications).
4. During the process of reviewing, verifying, and amending cadastral maps based on feedback from land users, it is necessary to guide land users to re-declare and register according to the results of map amendments and completion.
Article 5. Implementing the integration of inspection and review of registration applications by the Land Registration Office at the district level and the People's Committee at the commune level.
During the process where the People's Committee at the commune level conducts inspections and confirms registration applications of households, individuals, and community groups, the Land Registration Office at the district level needs to coordinate with the commune to perform the following tasks:
1. Coordinate with the People's Committee at the commune level to jointly inspect the completeness, clarity, and consistency of received declaration and registration files; classify registration files to serve the verification and confirmation by the People's Committee at the commune level and the approval for issuance of Certificates of Land Use Right by the People's Committee at the district level, including:
a) First-time registration and issuance of Certificates of Land Use Right, classified according to each type of land use origin;
b) Replacement of Certificates of Land Use Right;
c) Registration of land changes, classified according to each type of change.
2. Guide the People's Committee at the commune level to conduct verification and confirmation of registration applications of households, individuals, and community groups according to the provisions of the Land Law for each administrative procedure.
3. Review the confirmation results of the People's Committee at the commune level for each registration application of households, individuals, and community groups immediately after confirmation.
4. Determine conditions for issuing Certificates of Land Use Right, conditions for registering land changes, and property attached to land, and record the opinions of the Land Registration Office at the district level in each registration application according to the分级授权规定对每种行政程序的权限。
Article 6. Implementing the integration of land record dossier preparation and land information database construction with the process of land surveying, map creation or revision, and registration and issuance of Certificates.
The preparation of land record dossiers and land information databases must be integrated with the processes of land surveying, map creation or revision, and registration and issuance of Certificates as follows:
1. During the preparatory work for land surveying, map creation or revision, and registration and issuance of Certificates, it is necessary to integrate preparatory work related to human resources, materials, equipment, tools, software, and the collection of previously established land record dossiers to serve the construction of land record dossiers and land information databases.
2. During the process of land surveying and map creation or revision, it is necessary to integrate the construction of spatial land information data with the internal processing work of the land surveying and map creation or revision process.
3. During the process of registration and issuance of Certificates, it is necessary to integrate the construction of attribute land information data while completing spatial land information data according to the following provisions:
a) Implement the entry and standardization of attribute land information data regarding the history of land parcels (from land records or registration files before mapping) into the land information database during the organization of land registration declaration.
b) Implement the entry and standardization of attribute land information data into the land information database for each registration file immediately after the Land Registration Office has reviewed and provided comments on the application form as prescribed.
After the competent authority approves the issuance of the Certificate, it is necessary to scan and store the Certificate before handing it over; update supplementary information about the issued Certificate; revise attribute land information data when there are changes in the Certificate data compared to the declared registration data.
c) Implement the revision and completion of spatial land information data during the organization of land registration declaration when there are reflections indicating errors in the survey results and after verification confirms these reflections are correct.
In cases where the spatial land parcel data differs from the survey results after the competent authority issues the Certificate, the spatial land information data must be revised and completed to align with the issued Certificate.
4. During the processes of land surveying, registration, issuance of Certificates, and construction of land information databases, it is necessary to integrate the preparation of land record dossiers as follows:
a) Make copies of the Certificate for storage before handing it over to the land user;
b) Collect, organize, and number the registration procedure files linked to the review and approval process of the Certificate at various levels for management and storage as prescribed;
c) For districts and provinces that have not yet constructed land information databases, it is necessary to prepare land record dossiers linked to the review process of registration files and issuance of Certificates, and print land maps, land registers, land item lists, and Certificate issuance registers on paper for use at various levels as prescribed by the Ministry of Natural Resources and Environment.
For provinces and districts that have already constructed land information databases but some communes and districts still lack conditions to utilize and update the databases, it is necessary to print and copy land maps, land registers, land item lists, and Certificate issuance registers for those communes and districts to use and update changes as prescribed.
Chapter III
IMPLEMENTATION
Article 7. Effective Date
This Circular takes effect from November 29, 2013.
Article 8. Responsibilities for Implementation
1. The General Department of Land Management shall be responsible for monitoring, inspecting, and guiding the implementation of this Circular.
2. Provincial People's Committees and municipal people's committees directly under the central government shall be responsible for directing the implementation of this Circular in their respective localities.
3. Departments of Natural Resources and Environment shall assist provincial and municipal people's committees directly under the central government in disseminating, guiding the implementation, and organizing the direction of people's committees at all levels of districts and communes, district-level natural resources and environment offices, and land registration offices at all levels, and consulting units (if any) to closely cooperate in the implementation at each commune to ensure the integration of stages as stipulated in this Circular.
Any difficulties or obstacles encountered during the implementation should be promptly reported to the Ministry of Natural Resources and Environment for consideration and decision./.
