PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

includes the Component of Planning for the Development of the 110 kV Power System and the Detailed Component of Planning for the Development of Medium and Low Voltage Distribution Networks after 110 kV Substations.

The Component of Planning for the Development of the 110 kV Power System

Article 2. Applicability

(hereinafter referred to as Component 1) includes planning for 220 kV transformer substations supplying power to the province, planning for the 110 kV power grid, various sources of medium and small-scale power generation, total length (in kilometers) of medium voltage transmission lines, total capacity (in kVA) of distribution substations.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. The Detailed Component of Planning for the Development of Medium and Low Voltage Distribution Networks after 110 kV Substations (hereinafter referred to as Component 2) includes detailed planning for medium voltage distribution networks after 110 kV substations for districts, cities, and towns directly under the province, list of medium voltage transmission lines, list of medium voltage substations.

2. Planning for the development of medium and small hydropower is planning for the development of medium and small hydropower in provinces with installed capacity of up to 50 MW.

3. Article 4. Principles for Determining Costsi 1. The cost levels specified in this Circular are the maximum levels, serving as the basis for determining costs for the preparation, review, publication, adjustment, and management of the Planning. 2. In cases where the basic salary changes according to the provisions of the law, the cost for preparing the Planning will be adjusted accordingly based on the coefficient K (the adjustment coefficient according to the basic salary is stipulated in Appendix V attached to this Circular).3. The cost standards specified in this Circular include the following expenses: a) Labor costs for preparing the Planning;

4. b) Management costs of the consulting unit for the Planning;commission c) Material costs, office supplies, printing of documents, depreciation of machinery and equipment; d) Expenses for meetings, conferences, and reports;

đ) Environmental impact assessment costs for the Planning project (environmental impact assessment content is part of the Planning project);

e) Training and professional development costs of the consulting unit;

g) Insurance costs (social insurance, health insurance, unemployment insurance, professional liability insurance);

h) Prepaid income tax of the consulting unit according to regulations.

4. Costs not included in the Planning cost standards:

a) Costs related to travel expenses;

b) Surveying, mapping, purchasing maps, and basic investigation materials costs;

c) Costs for negotiating construction sites for the Planning;

Costs specified in Clause 4 of this Article must be budgeted and submitted for approval by the competent authority and must be included in the Planning preparation budget documentation.

e) Training and professional development costs of the consulting unit;

g) Insurance costs of various types (social, health, unemployment, professional liability);

h) Prepaid taxable income of the consulting unit in accordance with regulations;

4. Costs not included in the planning cost standard:

a) Costs related to travel expenses;

b) Surveying, mapping, purchasing maps and basic investigation materials costs;

c) Costs for agreeing on the construction site of the Plan;

d) Value-added tax.

The costs specified in Clause 4 of this Article must be budgeted and submitted to the competent authority for approval and shall be included in the planning budget preparation dossier.

Chapter II

SPECIFIC PROVISIONS

Article 5. Determination of Planning Preparation Costs

1. The level of planning preparation costs shall be determined based on the cost standards specified in Appendix I and Appendix II issued together with this Circular and the scale, capacity, and volume of the planning according to the following formula:

a) G: Level of planning preparation costs.

b) Cqhi: Cost standard for the i-th project category (VND/unit) as determined in Appendix I and Appendix II issued together with this Circular.

- To be filed: VT, K.TTH (3b).i: Capacity, volume of the i-th project category (kVA, MW, km).

d) i = 1,2,3... n: Types of products included in the planning according to the cost standard categories.

đ) K: Adjustment factor based on the basic wage level as stipulated in Appendix V of this Circular.

2. The cost standards for planning set out in Appendix I and Appendix II issued together with this Circular apply to major product categories in the planning dossier. In cases where the planning includes specific product contents not covered or not suitable for the provisions of this Circular, the investor and the consulting unit shall prepare a budget estimate and submit it to the competent authority for approval.

Article 6. Adjustment Factors for Planning Cost Standards

1. The adjustment factors for planning cost standards based on the length of power transmission lines and the volume of medium voltage substations are specified in Appendix III issued together with this Circular.

2. For multi-circuit power transmission lines, from the second circuit onwards, the cost standard shall be calculated by multiplying the standard in Appendix I issued together with this Circular by a factor of 0.5.

3. For high-voltage substations with more than two units, from the second unit onwards, the cost standard shall be calculated by multiplying the standard in Appendix I issued together with this Circular by a factor of 0.5.

4. For underground cable power transmission line projects, the cost standard shall be calculated by multiplying the standard in Appendix I issued together with this Circular by a factor of 1.05.

5. For planning projects established in island regions and mountainous areas with special difficulties as prescribed, the cost standard shall be calculated by multiplying the standard in Appendix I issued together with this Circular by a factor of 1.1.

6. Cost standards for renovation and expansion projects:

a) For substations, the cost standard shall be calculated at 30% of the cost standard for building new substations with corresponding voltage levels and scales.

b) For power lines, the cost standard shall be calculated at 40% of the cost standard for building new power lines with corresponding voltage levels and lengths.

7. For the volume of power line and substation projects with 220 kV and 110 kV voltages in planning schemes approved in previous phases but not implemented, when transferred to calculate and establish planning schemes in subsequent phases, the cost standard shall be calculated by multiplying the new construction cost standard by a factor of 0.3.

8. For the volume of medium voltage grid projects in planning schemes approved in previous phases but not implemented, when transferred to calculate and establish planning schemes in subsequent phases, the cost standard shall be calculated by multiplying the new construction cost standard by a factor of 0.3.

Article 7. Cost Standards for Certain Tasks Related to the Process of Establishing and Approving Planning Schemes

1. Costs for preparing planning tasks, reviewing planning schemes, managing and announcing planning shall be calculated as a percentage of the estimated planning preparation costs as specified in Appendix IV issued together with this Circular.

2. In cases where the length of power transmission lines, total transformer capacity, and estimated planning preparation costs (pre-tax) fall between two price ranges or cost standards, related costs shall be determined using interpolation methods.

Where:

a) Y: Cost standard or adjustment coefficient relevant to the scale being calculated. Unit of measurement is % or coefficient.

b) X: Scale of the cost standard or adjustment factor being calculated. Unit of measurement is length scale, capacity, or value.

c) X1, X2: Corresponding scales of the lower and upper limits of the value being calculated. Unit of measurement is length scale, capacity, or value.

d) Y1, Y2: Cost standards or adjustment coefficients corresponding to the lower and upper limits of the value being calculated. Unit of measurement is percent (%) or coefficient.

In cases where the scale exceeds the scale specified in Appendix IV issued together with this Circular, the planning preparation costs shall be determined by preparing a cost estimate.

Article 8. Standard for Planning Adjustment Costs

1. In cases where the Power Development Plan is adjusted outside the regular cycle (partial plan adjustment), the planning adjustment cost shall be determined by preparing a budget estimate based on the content of the work, scale, key parameters of the project to be adjusted, the approved planning tasks by the competent authority, and the planning cost standards stipulated in this Circular.

2. For cases where the Power Development Plan is adjusted within the five-year cycle (comprehensive plan adjustment), the planning adjustment cost shall be determined by preparing a budget estimate according to the following principles:

a) Adjusting the component of the 110 kV Power System Development Plan for the five-year cycle (Component 1): not exceeding a maximum of 50% of the cost of preparing a new planning proposal based on the remaining construction volume of the planning phase and the corresponding planning cost standards stipulated in this Circular.

b) Adjusting the detailed development plan for medium and low voltage distribution networks after 110 kV substations for the five-year cycle (Component 2): not exceeding a maximum of 40% of the cost of preparing a new planning proposal based on the remaining construction volume of the planning phase and the corresponding planning cost standards stipulated in this Circular.

Chapter III

MANAGEMENT AND IMPLEMENTATION

Article 9. Management of Planning Preparation Costs

The cost of hiring consultants to prepare planning proposals is determined based on the results of bidding and managed through consulting contracts. The content of the consulting contract for preparing planning proposals must comply with relevant laws on contracts.

Article 10. Transitional Provisions

1. For planning proposals that have signed contracts before this Circular takes effect, payment and settlement of planning preparation costs must be based on the terms of the signed contract. If the contract includes an agreement to adjust prices when the State changes the planning cost standards, the parties involved need to specifically determine the unfinished workload to adjust accordingly with the provisions of this Circular.

2. For planning proposals where bidding results have been approved but contracts have not yet been signed, the competent authority approving the planning proposal preparation costs decides to apply the provisions of this Circular.

Article 11. Effective Date

This Circular takes effect from November 2, 2015, replacing Decision No. 3836/2005/QĐ-BCN dated November 22, 2005, issued by the Minister of Industry on the issuance of standard planning costs for power development./.
