Amending and supplementing some articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012

of the Minister of Transport on training, examination, and issuance of motor vehicle driver's licenses

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Transport Department,

The Minister of Transport hereby promulgates this Circular amending and supplementing some articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012 of the Minister of Transport on training, examination, and issuance of motor vehicle driver's licenses.

Article 1. Amending and supplementing some articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012 of the Minister of Transport on training, examination, and issuance of motor vehicle driver's licenses

1. Amend Point b Clause 12 Article 5 as follows:

"b) Owned by the driving school. May be leased for a term of at least one year with a quantity not exceeding 30% of the owned vehicles of the same category of the driving school; for training vehicles of category FC, leasing may be done for a term and quantity suitable to the training needs."

2. Amend Clause 2 of Article 8 as follows:

"2. Of age (as of the date of the driving license examination), health, and educational level as prescribed; for persons learning to upgrade their driving license categories, they may study ahead but can only take the examination when they meet the age requirement as prescribed."

3. Amend Clause 4 Article 8 as follows:

"4. Persons learning to upgrade their driving license categories must have sufficient time in practice and safe driving distance as follows:

a) From B1 to B2: at least one year of practice and 12,000 kilometers of safe driving;

b) From B2 to C, from C to D, from D to E; from categories B2, D, E to F respectively: at least three years of practice and 50,000 kilometers of safe driving;

c) From C, D, E to FC: at least one year of practice and 50,000 kilometers of safe driving;

d) From B2 to D, from C to E: at least five years of practice and 100,000 kilometers of safe driving.”

4. Amend Clause 1 Article 26 as follows:

"1. Duration of training

a) From B1 to B2: 94 hours (theory: 44, practical driving: 50);

b) From B2 to C: 192 hours (theory: 48, practical driving: 144);

c) From C to D: 192 hours (theory: 48, practical driving: 144);

d) From D to E: 192 hours (theory: 48, practical driving: 144);

đ) From B2 to D: 336 hours (theory: 56, practical driving: 280);

e) From C to E: 336 hours (theory: 56, practical driving: 280);

g) From B2, D, E to F respectively: 192 hours (theory: 48, practical driving: 144);

h) From C, D, E to FC: 272 hours (theory: 48, practical driving: 224)."

5. Amend Clause 3 Article 26 as follows:

"3. Training program and allocation of training time

6. Amend Clause 4 Article 27 as follows:

"4. Upgrading driving license training

Note (*): The driving practice course can only be conducted after students have passed the requirements for the courses: Road Traffic Law and New Knowledge about Elevator Vehicles.

7. Amend Clause 2 of Article 34 as follows:

"2. Investment in motor vehicles used for driver testing must meet the following conditions:

a) Testing vehicles in simulated environments belonging to organizations or individuals with examination centers must have valid safety technical inspection certificates and compulsory liability insurance certificates. For category FC testing vehicles in simulated environments, contractual vehicles may be used according to the needs of the examination.

b) Testing vehicles on roads must comply with traffic participation conditions stipulated by the Road Traffic Law; they must have auxiliary braking systems installed on the examiner's seat, which are sturdy, convenient, safe, and effective during use; they must be equipped with two "TESTING VEHICLE" signs manufactured and installed according to the specifications set out in Point i, Clause 12, Article 5 of this Circular. For category FC testing vehicles on roads, contractual vehicles may be used according to the needs of the examination."

Article 2. Effective Date

This Circular takes effect from September 1, 2015.

Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Administration, the Directors of Provincial and Municipal Departments of Transport under the Central Government, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
