VIETNAM NATIONAL BRAND PROGRAM

On the basis of Law on Government Organization dated June 19, 2015;

On the basis of Law on Foreign Trade Management dated June 12, 2017;

Decree No. Decree No. 98/2017/ND-CP dated August 18, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Decree No. Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government detailing the Law on Foreign Trade Management regarding certain measures to develop foreign trade; The Prime Minister issues this Decision on the Regulations on the construction, management, and implementation of the Vietnam National Brand Program.

At the proposal of the Minister of Industry and Trade;

These Regulations are promulgated together with this Decision.

Article 1. This Decision takes effect from December 1, 2019.

CONSTRUCTION, MANAGEMENT, AND IMPLEMENTATION OF THE VIETNAM NATIONAL BRAND PROGRAM

REGULATIONS

(Issued together with Decision No. 30/2019/QD-TTg dated October 8, 2019 of the Prime Minister)
Article 1. These Regulations prescribe the construction, management, and implementation of the Vietnam National Brand Program (hereinafter referred to as the Program).

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Programs for building and developing brand sectors of Vietnam shall be implemented in accordance with Articles 16, 17, and 19 of Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government detailing the Law on Foreign Trade Management regarding certain measures to promote trade and develop foreign trade.

Article 2. Principles of Construction, Management, and Implementation of the Program

1. Promoting the development of foreign trade, promoting the image of the country and the Vietnam National Brand through products recognized as Vietnam National Brands, based on consistency and synchronization with the economic and social development strategy in each period.

2. Ensuring resources for implementation in line with the objectives and organizational capacity for implementation from central to local levels; encouraging the active participation and contributions of the community in the planning and organization of the Program.

3. Ensuring transparency in management and execution of activities to implement the Program.

Article 3. Program Management Authority and Units in Charge of Proposing Projects under the Program

1. The Ministry of Industry and Trade is the authority managing the Program.

2. Units in charge of proposing projects are ministries and agencies assigned the task of implementing projects under the Program according to Chapter II of these Regulations.

Article 4. Funding for Implementing the Program

1. Funding for implementing the Program is formed from the following sources:

a) Annual state budget allocation;

b) Contributions from participating organizations and enterprises;

d) Other lawful funding sources as prescribed by law.

2. State budget funding for implementing the Program is allocated in the annual state budget estimate of the Ministry of Industry and Trade to ensure costs for the following activities:

c) Sponsorship from domestic and foreign organizations and individuals;

a) Contents prescribed in Article 5 of these Regulations;

b) Program management activities;

c) Other contents not falling within the cases prescribed in points a and b of this clause, subject to approval by the Prime Minister.

b) Activities related to managing the Program;

c) Other contents not falling within the cases specified in points a and b of this Clause shall be examined and decided by the Prime Minister.

Chapter II
CONSTRUCTION AND IMPLEMENTATION OF THE

Section 1. BUILDING THE PROGRAM

Article 5. Contents of the Program's Activities

1. Building objectives, strategies, and the Program for each period.

2. Building a system of criteria for the Program.

3. Protecting the emblem and the brand identity system of the Vietnam National Brand both domestically and internationally.

4. Supporting enterprises to develop products that meet the Vietnam National Brand criteria including activities:

a) Studying and evaluating the demand and capacity of enterprises to apply Vietnam National Brand criteria;

b) Disseminating and providing information;

c) Organizing training, workshops, and consulting for enterprises to develop products.

5. Supporting enterprises to build, develop, and protect their brands both domestically and internationally including activities:

a) Consulting enterprises on building and developing their brands;

b) Consulting enterprises on protecting intellectual property rights both domestically and internationally;

c) Organizing events, seminars, conferences, training, and workshops.

6. Information and communication activities for the Program both domestically and internationally including activities:

a) Hiring organizations and experts both domestically and internationally to build and promote the Vietnam National Brand;

b) Market research to guide information and communication activities;

c) Promoting and advertising about the Program and enterprises with products achieving the Vietnam National Brand at diplomatic, economic, trade, investment promotion, and tourism events and through media channels;

d) Producing and distributing informational products; building and maintaining multilingual websites and applications for the Program;

đ) Organizing seminars, conferences, forums to promote the Program both domestically and internationally;

e) Organizing the Vietnam National Brand Week both domestically and internationally;

g) Organizing the Ceremony to Announce Enterprises with Products Achieving the Vietnam National Brand.

7. The contents stipulated in Clause 1, Clause 2, Clause 3; Point e, Point g Clause 6 of this Article shall be led by the Ministry of Industry and Trade, in coordination with relevant ministries and sectors.

8. The contents stipulated in Clause 4; Point a, Point c Clause 5 shall be implemented by units leading the support project to help enterprises meet the selection criteria of the Program.

9. The contents stipulated in Point b Clause 5; Point a, Point b, Point c, Point d, Point đ Clause 6 of this Article shall be implemented by units leading the support project to assist enterprises with products achieving the Vietnam National Brand.

Article 6. Procedures for Building, Approving, Supplementing, and Adjusting Projects under the Program

1. The leading unit builds the project according to the procedures specified in Clause 1; Point a, Point b Clause 2 and Clause 3 of Article 10 of Decree No. 28/2018/NĐ-CP.

2. The Ministry of Industry and Trade is responsible for reviewing projects proposed by leading units based on:

a) The approved development strategy for foreign trade activities in the industry or sector;

b) Specific annual or periodic guidance from the Vietnam National Brand Council;

c) The needs of organizations and enterprises.

3. Based on the Vietnam National Brand Council's opinions on the list of projects proposed by leading units, the Minister of Industry and Trade decides to approve the list of projects according to the procedures specified in Clause 6 of Article 10 of Decree No. 28/2018/NĐ-CP before July 15 of the year preceding the planning year.

4. Adding projects outside the approved list of projects under the Program shall be carried out according to the procedures specified in Clauses 1, 2, and 3 of this Article.

5. Adjusting approved projects shall be carried out according to the procedures specified in Article 13 of Decree No. 28/2018/NĐ-CP.

6. The Ministry of Industry and Trade reviews the progress, content, and budget of projects to adjust, recover unused funds, approve additional supplements, and adjust projects implementing the Program.

Section 2. IMPLEMENTATION OF THE PROGRAM

Article 7. Organization to Implement the Program

1. Based on the Decision approving the Project issued by the Minister of Industry and Trade, the signing of contracts for the assignment of tasks to implement the Project and the reporting on the implementation of the Project shall be carried out according to the procedures stipulated in Articles 12 and 14 of Decree No. 28/2018/NĐ-CP.

2. The leading unit of the project signs contracts with organizations and individuals to carry out the works within the scope of the project.

3. To organize the implementation of the Program, the Minister of Industry and Trade establishes and issues the Operation Regulation of the Vietnam National Brand Council, the Secretariat, and the Expert Board of the Program.

4. The Vietnam National Brand Council, chaired by the Minister of Industry and Trade, with Vice Chairmen and Members being leaders of relevant ministries, sectors, and organizations, has the following functions and responsibilities:

a) Directing the development of objectives and strategies for implementing the Program during each period;

b) Providing opinions on the list of projects proposed within the framework of the Program by the leading units of the projects;

c) Providing opinions on the list of products recognized as Vietnam National Brands.

5. The Secretariat, headed by the leader of the state management agency for trade promotion under the Ministry of Industry and Trade, has the following functions and responsibilities:

a) Assisting the Vietnam National Brand Council and the Program management agency in organizing the implementation of the Program;

b) Reporting on the organization and implementation of the Program to the Vietnam National Brand Council and the Program management agency.

6. The Expert Board consists of members representing relevant ministries, sectors, organizations, and independent experts, having the following functions and responsibilities:

a) Carrying out advisory activities with specialized nature within the Program;

b) Participating in selecting products recognized as Vietnam National Brands at the request of the Program management agency.

Article 8. Selection of Products Recognized as Vietnam National Brands

1. The selection of products recognized as Vietnam National Brands is organized biennially every two years in even-numbered years.

2. Enterprises submit three sets of registration files for the selection of products recognized as Vietnam National Brands before March 31 of the selection year to the Ministry of Industry and Trade through one of the following methods:

a) By postal service;

b) At the headquarters of the Ministry of Industry and Trade;

c) Through the online public service portal of the Ministry of Industry and Trade.

3. The registration file for the selection of products recognized as Vietnam National Brands includes the following documents and materials that do not require certification:

a) Registration form for participation in the selection of products recognized as Vietnam National Brands according to Model No. 01 attached to this Regulation;

b) A copy of the Notification from the tax authority confirming that the enterprise has fulfilled all tax obligations for two consecutive years prior to the selection year;

c) A copy of the Notification from the social insurance authority regarding the results of social insurance contributions made by the enterprise for two consecutive years prior to the selection year;

d) A copy of the collective labor agreement in effect that has been registered with the state management agency for labor affairs;

đ) A copy of the periodic environmental monitoring report in accordance with the law for two consecutive years prior to the selection year;

e) A copy of the audited financial statements of the enterprise for two consecutive years prior to the selection year;

g) A copy of the intellectual property protection certificate of the product being selected that remains valid, issued by the competent authority;

h) A copy of the quality certification documents of the product being selected that remain valid in accordance with the law;

i) A copy of the ISO 9001 Quality Management System Certification or a copy of the equivalent system certification;

k) A copy of the ISO 14001, ISO 22000, ISO 17025, SA 8000, OHSAS 18001, HACCP, GMP, VietGap, Global Gap certifications and copies of the periodic audit evaluation reports or equivalent (if available);

l) Copies of certificates for quality awards and brand reputation awards (if available).

4. Within seven working days from the date of receipt of the enterprise's file, if the file does not meet the requirements set forth in Clause 3 of this Article, the Program management agency is responsible for notifying the enterprise in writing (according to Model No. 02 attached to this Regulation) to supplement and complete the file. The enterprise is responsible for submitting a complete supplementary file before May 1 of the selection year.

5. Before September 30 of the selection year, the Program management agency is responsible for notifying enterprises about the results of the selection of products recognized as Vietnam National Brands (according to Model No. 03 attached to this Regulation). 6. The results of the selection of products recognized as Vietnam National Brands take effect for two years from the date the Minister of Industry and Trade issues the decision recognizing the list of products as Vietnam National Brands.

7. Before November 15 each year, enterprises with products recognized as Vietnam National Brands are responsible for reporting to the Ministry of Industry and Trade on compliance with the regulations and provisions of the Vietnam National Brand Program via email or paper sent by postal service or submitted directly to the headquarters of the state management agency for trade promotion of the Ministry of Industry and Trade according to Model No. 04 attached to this Regulation.

Article 9. National Brand Emblem of Vietnam

1. Enterprises with products recognized as the National Brand of Vietnam shall be permitted to use the National Brand Emblem of Vietnam and the National Brand recognition system of Vietnam.

2. The Minister of Industry and Trade shall issue the Regulation on management and use of the National Brand Emblem of Vietnam.

Article 10. Revocation of Recognition for Products Achieving the National Brand of Vietnam

The Ministry of Industry and Trade shall consider revoking the recognition for products achieving the National Brand of Vietnam of enterprises in the following cases:

1. Fraud or forgery of documents during the process of building and submitting applications for participation in the Program.

2. Causing negative impacts on the reputation, image, and National Brand of Vietnam both domestically and internationally.

3. Exploiting the image and National Brand of Vietnam for personal gain or violation of laws.

4. Violation of the regulations stipulated in Clause 2 of Article 9 of this Regulation.

5. Being subject to criminal prosecution or administrative penalties with aggravating circumstances applied.

6. Dissolution or bankruptcy.

Chapter III
IMPLEMENTATION

Article 11. Responsibilities of the Ministry of Industry and Trade

1. The Ministry of Industry and Trade shall be responsible for performing the following tasks:

a) Organizing the development of objectives, strategies, and Programs of the National Brand of Vietnam for each period, to be submitted to the Prime Minister for approval;

b) Leading and coordinating with relevant ministries, sectors, and organizations in developing the criteria system for the Program;

c) Directly developing and implementing projects under the Program within its functions, tasks, and authority granted;

d) Guiding the development of projects, receiving, examining, approving, and signing agreements with the leading units implementing the projects according to the provisions of this Regulation;

đ) Summarizing, preparing the budget for managing and implementing the Program, and incorporating it into the overall budget of the Ministry of Industry and Trade, to be submitted to the competent authority in accordance with the State Budget Law;

e) Leading and coordinating with relevant agencies in inspecting, supervising the implementation of projects under the Program and compliance with Program regulations by participating enterprises;

g) The Minister of Industry and Trade shall decide on establishing and issuing the Operation Regulation of the National Brand Council of Vietnam, the Secretariat, and the Expert Board of the Program. The Trade Promotion Agency shall be responsible for assisting the Minister of Industry and Trade in implementing this content;

h) The Minister of Industry and Trade shall decide on recognizing the list of products achieving the National Brand of Vietnam. The Trade Promotion Agency shall be responsible for assisting the Minister of Industry and Trade in receiving and processing administrative procedures stipulated in Article 8 of this Regulation;

i) Before December 25th each year, summarizing and evaluating the results, reporting to the Prime Minister through the electronic document system about the implementation of the Program in the year according to Model No. 05 attached as an appendix to this Regulation;

k) Coordinating with organizations and individuals to mobilize resources to serve the activities of the Program;

l) Managing and using funds according to the current financial regime.

2. Leading and coordinating with ministries, ministerial-level agencies, provincial People's Committees under the central government, and related organizations and enterprises to implement this Regulation.

Article 12. Responsibilities of Ministries, Sectoral Agencies, People's Committees of Provinces and Central Cities

1. The Ministry of Finance

a) The Ministry of Finance shall take the lead and coordinate with the Ministry of Industry and Trade to guide the preparation of budgets, allocation, utilization, and settlement of accounts for funds implementing the Program in accordance with the provisions of the law;

b) Provide specific guidance on procedures and formalities related to tax and customs as stipulated in point g, Clause 3, Article 18 of Decree No. 28/2018/NĐ-CP.

2. Ministries and agencies at the ministerial level

a) Within their respective functions and tasks, they are responsible for proposing, developing, and coordinating the implementation of projects in accordance with the content of the Program;

b) Before November 15 each year, submit reports to the Ministry of Industry and Trade through the electronic document system as specified in Model No. 06 attached to this Regulation regarding the implementation of projects as prescribed in Clause 1, Article 7 of this Regulation.

3. People's Committees of provinces and centrally governed cities shall develop and implement activities in line with the orientation of the Program using local financial resources./.
