Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies; Decree No. 101/2020/NĐ-CP dated August 28, 2020 amending and supplementing certain articles of Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

BASED ON DECREE NO. 81/2022/NĐ-CP dated October 14, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

At the proposal of the Minister of Foreign Affairs,

The Prime Minister issues this Decision to stipulate the functions, tasks, powers, and organizational structure of the National Committee for Overseas Vietnamese under the Ministry of Foreign Affairs.

Article 1. Position and Functions

Article 1. The National Committee for Overseas Vietnamese (hereinafter referred to as the Committee) is a general department under the Ministry of Foreign Affairs, assisting the Minister of Foreign Affairs in performing state management functions regarding overseas Vietnamese affairs.

Article 2. The Committee has legal personality, bears the State Emblem seal, and is entitled to open an account at the State Treasury in accordance with the law, with its headquarters located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

Clause 1. To advise and assist the Minister of Foreign Affairs in presenting to the Government, the Prime Minister, and competent authorities:

a) Draft laws, draft resolutions of the National Assembly; draft ordinances and draft resolutions of the Standing Committee of the National Assembly; draft decrees and resolutions of the Government; draft decisions and directives of the Prime Minister concerning overseas Vietnamese affairs;

b) Strategies, long-term plans, national target programs; action programs, important projects of the Government concerning overseas Vietnamese affairs.

Clause 2. To submit to the Minister of Foreign Affairs for consideration and decision:

a) Draft circulars, decisions, directives, and other documents concerning overseas Vietnamese affairs;

b) Long-term, medium-term, and annual plans concerning overseas Vietnamese affairs.

Clause 3. To implement policies, laws, strategies, plans, programs, projects concerning overseas Vietnamese affairs after they have been issued or approved by competent authorities.

Clause 4. To provide professional guidance on state management functions concerning overseas Vietnamese affairs within its authority.

Clause 5. To take the lead in researching, compiling, evaluating, and proposing strategic issues related to the situation of overseas Vietnamese communities.

Clause 6. To support and create favorable conditions for overseas Vietnamese to stabilize their lives, integrate into host societies, preserve and promote Vietnamese cultural identity, language, and fine traditions; to carry out national solidarity work among overseas Vietnamese; to mobilize and support the development of overseas Vietnamese resources for national development; to organize, support, and guide overseas Vietnamese organizations and individuals in their connections with the homeland; to support innovation and creativity.

Clause 7. To disseminate Party guidelines, state policies and laws, national situations, international treaties to which Vietnam is a party, to overseas Vietnamese.

Clause 8. To implement international cooperation related to overseas Vietnamese affairs in accordance with the law.

Clause 9. To manage social organizations related to overseas Vietnamese in accordance with the law.

Clause 10. To implement commendation activities in overseas Vietnamese affairs.

Clause 11. To coordinate with the Inspectorate of the Ministry to inspect and check the implementation of legal provisions in the field of overseas Vietnamese affairs within its jurisdiction.

Clause 12. To implement tasks related to administrative reform, digital transformation, application of technology for electronic government and digital government, information security, and safety in accordance with the programs and plans of the Ministry of Foreign Affairs and the law.

Clause 13. To manage organizational structures, staffing, job positions; to implement salary systems, training, capacity building, incentive awards, disciplinary measures, and other policies for civil servants and employees under the Committee's jurisdiction in accordance with the law and the delegation of the Minister of Foreign Affairs.

Clause 14. To manage finances and assets assigned and to implement the state budget allocated in accordance with the law.

Clause 15. To organize citizen reception, complaints, and denunciations; to prevent and combat corruption and negative practices in accordance with the law.

Clause 16. To perform other tasks and powers delegated by the Minister of Foreign Affairs or stipulated by the law.

Article 3. Organizational Structure

Item 1. Research and Synthesis Department.

Item 2. Information and Culture Department.

Item 3. Economy, Science, and Technology Department.

4. Office;

The issuance of the Work Regulation and specific decisions on the functions, tasks, powers, and organizational structure of units under the Committee shall be carried out in accordance with the law and the delegation of the Minister of Foreign Affairs.

Article 4. Leadership of the Committee

1. The Committee has a Director and not more than four Deputy Directors.

2. The Minister of Foreign Affairs assigns one Deputy Minister to be the Director of the Committee. The Director of the Committee is responsible to the Minister of Foreign Affairs and to the law for all activities of the Committee.

3. The Deputy Directors of the Committee are appointed and relieved of their duties by the Minister of Foreign Affairs upon the proposal of the Director of the Committee. The Deputy Directors of the Committee are responsible to the Director of the Committee and to the law for the areas of work assigned to them.

4. The appointment and relief from duty of the heads and deputies of the heads of units under the Committee shall be carried out in accordance with the provisions of the law and the delegation of authority by the Minister of Foreign Affairs.

Article 5. Transitional Provisions

1. The Legal Affairs - Inspection Department and the Homeland Magazine continue to perform their functions and tasks until the Minister of Foreign Affairs issues a Decision stipulating the functions, powers, responsibilities, and organizational structure of the units directly under the Committee.

2. The Ministry of Foreign Affairs is responsible for directing the organization to implement the reassignment, restructuring of functions, tasks, personnel, finance, assets, and handling of related issues concerning units directly under the Committee within thirty days from the date this Decision takes effect.

Article 6. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from February 10, 2024;

2. This Decision replaces Decision No. 11/2019/QĐ-TTg dated February 18, 2019 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the National Committee for Vietnamese Overseas under the Ministry of Foreign Affairs.

3. The Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairpersons of provincial People's Committees under the central government, the Director of the National Committee for Vietnamese Overseas, and relevant agencies and organizations are responsible for implementing this Decision.
