Pursuant to the Tourism Law dated June 19, 2017;

Pursuant to the Law on Enterprises dated June 17, 2020;

the Director at the proposal of the Director of the Ministry's Office; REGULATIONS ON THE MANAGEMENT OF FOREIGN REGISTERED MOTOR VEHICLES BROUGHT INTO VIETNAM FOR TOURISM

Chapter 1. Scope of Regulation for This Decree regulates the management of foreign registered motor vehicles (hereinafter referred to as foreign motor vehicles), driven by foreigners to participate in traffic in Vietnam for tourism purposes; the responsibilities of organizations and individuals related thereto.

 

PART I

Article 1. Scope of ApplicationThe decision to switch the issuance of coats, overcoats, windbreakers, and down jackets to other uniforms for civil servants working at the National Market Management and Development Agency is decided by the Minister of Industry and Trade.NG

 

ArticleonThis Decree applies to organizations and individuals in Vietnam, and foreign individuals related to foreign motor vehicles driven by foreigners to participate in traffic in Vietnam for tourism purposes.

Article 2. Obligations of Domestic and Foreign Organizations and Individuals

Article 2. Applicability

Domestic and foreign organizations and individuals related to foreign motor vehicles driven by foreigners to participate in traffic in Vietnam for tourism purposes must comply with the provisions of this Decree and other relevant legal documents. In cases where international treaties to which the Socialist Republic of Vietnam is a party provide different provisions, such treaty provisions shall apply.

Article 3. Interpretation of Terms

Definitions 1. Foreign motor vehicle means vehicles:

In this Decree, the following terms are understood as follows:

a) Passenger cars with right-hand drive or left-hand drive including: up to nine seats, mobile house cars;

b) Two-wheeled motorcycles.

2. Force majeure refers to situations where foreign individuals and foreign motor vehicles cannot leave Vietnam's territory due to unforeseeable and unavoidable events that cannot be immediately overcome despite the application of all necessary measures within the permitted capabilities.

REGULATIONS ON THE ENTRY OF FOREIGN MOTOR VEHICLES INTO TRAFFIC IN VIETNAM

 

Chapter II

Article 4. Conditions for Foreign Motor Vehicles

and Foreign Individuals Driving Foreign Motor Vehicles to Enter Traffic in Vietnam Article 4. General Conditions for Foreign Motor Vehicles and Foreign Individuals Driving Them to Enter Vietnam

 

1. General conditions for foreign motor vehicles and foreign individuals driving them to enter Vietnam a) Must go through a Vietnamese international travel service company to handle procedures to obtain approval to organize for foreign tourists to bring foreign motor vehicles into traffic in Vietnam; b) Have an approval document issued by the Ministry of Public Security allowing foreign tourists to bring foreign motor vehicles into traffic in Vietnam. person 2. Conditions for Foreign Motor Vehicles

a) Must be a road motor vehicle as defined in Clause 1, Article 3 of this Decree;

b) Must have a Vehicle Registration Certificate and license plate issued by the competent authority of the country of registration and still valid;

c) Must have a Safety Technical Inspection Certificate or equivalent document issued by the competent authority of the country of registration and still valid (for passenger cars);

d) For foreign motor vehicles with right-hand drive: Must have a diplomatic note from the diplomatic mission, consular office, or representative office of an intergovernmental international organization in Vietnam sent to the Ministry of Public Security requesting permission and stating the reasons for the vehicle to participate in traffic in Vietnam;

e) Must complete customs procedures for temporary import and re-export at the entry and exit border gates according to customs laws;

f) Can only temporarily import and re-export through international border gates by land, sea, inland waterways, rail, and air; must temporarily import and re-export through the approved border gate by the Ministry of Public Security;

g) The maximum time allowed to participate in traffic in Vietnam is 45 days. In case of force majeure, they may stay in Vietnam for an additional period not exceeding 10 days and must comply with the provisions of Clause 4, Article 5 of this Decree.

3. Conditions for Foreign Individuals Driving Foreign Motor Vehicles

a) Must be a foreigner;

b) Must have a passport or other international travel document and visa or residence permit in Vietnam, except in cases exempted from visa requirements under the Law on Entry into, Exit from, Transit through, and Residence of Foreigners in Vietnam. In cases where foreigners enter Vietnam under unilateral visa exemption, their passports must be valid for at least six months; foreigners using electronic visas must enter through international border gates decided by the Government;

c) Must have a valid driver's license issued by a foreign country corresponding to the type of vehicle being driven;

d) Must comply with entry and exit procedures for foreigners in Vietnam as stipulated by the Law on Entry into, Exit from, and Residence of Foreigners in Vietnam.

a) Is a foreign national;

b) Holds a passport or other international travel document and visa, or residence permit in Vietnam, except where visa exemption applies pursuant to the Law on Entry into, Exit from, Transit through, and Residence of Foreigners in Vietnam. In cases where foreign nationals enter under unilateral visa-free entry, their passports must be valid for at least six months; foreign nationals using electronic visas must enter through international border gates designated by the Government;

c) Possesses a driving license issued by a foreign country that corresponds to the type of vehicle being operated and remains valid;

d) Must comply with the procedures for entry and exit stipulated in the Law on Entry into, Exit from, and Residence of Foreigners in Vietnam.

Article 5. Procedures for approving international travel service enterprises to organize foreign tourists bringing their motor vehicles to participate in traffic in Vietnam amended and supplemented by Law No. 87/2025/QH15; organizing for foreign tourists to bring their motor vehicles category from foreign countries to participate in traffic in Vietnam

1. An international travel service enterprise of Vietnam shall submit to the Ministry of Public Security one set of documents in one of the following forms: directly, online, or by postal service. The documents include the following papers:

a) A letter requesting approval to organize for foreign tourists to bring their motor vehicles from foreign countries to participate in traffic in Vietnam according to Model No. 01 attached as an appendix to this Decree;

b) A list of drivers according to Model No. 02 attached as an appendix to this Decree;

c) A copy of the license for operating international travel services (applicable to enterprises applying for approval for the first time to organize for foreign tourists to bring their motor vehicles from foreign countries to participate in traffic in Vietnam).

2. Within no more than five working days from the date of receipt of complete documents as stipulated in Clause 1 of this Article, the Ministry of Public Security shall issue a document approving or not approving (with reasons stated) the participation of foreign motor vehicles in traffic in Vietnam. The approval document follows Model No. 03, while the non-approval document follows Model No. 07 attached as an appendix to this Decree and shall be delivered directly, online, or by postal service.

3. The approval document for organizing for foreign tourists to bring their motor vehicles from foreign countries to participate in traffic in Vietnam issued by the Ministry of Public Security shall be notified to the Ministry of Culture, Sports and Tourism, the Ministry of Foreign Affairs, the Ministry of Transport, the Ministry of National Defense, the Ministry of Finance, and the People's Committees of provinces and centrally-run cities related to management coordination.

4. In cases of force majeure as provided for in Clause 2 of Article 3 of this Decree

a) The international travel service enterprise must send a report to the Ministry of Public Security regarding the reason for the delay in departure of the vehicle beyond the time specified in the Ministry of Public Security’s approval document according to Model No. 04 attached as an appendix to this Decree, which can be sent directly, online, or by postal service;

b) Upon receiving the report from the international travel service enterprise, the Ministry of Public Security shall issue a response to the enterprise and simultaneously notify the Ministry of Culture, Sports and Tourism, the Ministry of Foreign Affairs, the Ministry of Transport, the Ministry of National Defense, the Ministry of Finance, and the People's Committees of provinces and centrally-run cities related to management coordination according to Model No. 05 attached as an appendix to this Decree.

Article 6. Provisions on persons driving and foreign vehicles when participating in traffic in Vietnam subject, organization, unit under the People's Committee of the commune level category 1. There must be a lead vehicle to guide traffic for foreign motor vehicles during their participation in traffic in Vietnam. The traffic guidance vehicle is an automobile (if the tourist drives an automobile) or a motorcycle (if the tourist drives a motorcycle), arranged by the Vietnamese international travel service enterprise and must display the logo or flag with the emblem of that enterprise.

2. They may only participate in traffic on routes within the administrative boundaries of provinces and the duration of circulation on Vietnamese territory must comply with the provisions of the approval document issued by the Ministry of Public Security.

3. When driving foreign motor vehicles to participate in traffic, the driver must comply with the regulations of Vietnamese road traffic laws; carry and present the following documents when requested by competent authorities:

a) Passport or other international travel documents, and relevant residence documents in Vietnam;

b) Valid foreign driver's license appropriate to the type of vehicle being driven;

c) Certificate of technical safety inspection and environmental protection for motor vehicles or equivalent documents issued by the competent authority of the country where the vehicle is registered and still valid (for automobiles);

d) Vehicle registration certificate issued by the competent authority of the country where the vehicle is registered and still valid;

đ) Certificate of compulsory civil liability insurance for motor vehicle owners valid in Vietnam;

e) Customs declaration form for temporary import and re-export of road transport vehicles.

Article 7. Handling violations by foreign drivers persons of vehicles subject, organization, unit under the People's Committee of the commune level category foreign

A foreign driver of a motor vehicle who violates Vietnamese laws and international treaties to which the Socialist Republic of Vietnam is a party shall be subject to handling according to relevant laws.

 

Chapter III

RESPONSIBILITIES OF RELATED AUTHORITIES

AND ENTERPRISES OPERATING INTERNATIONAL TOURISM SERVICES

IN VIETNAM

 

Article 8. Responsibilities of the Ministry of Public Security

1. Organizing the implementation of approval for Vietnamese enterprises operating international tourism services to organize for foreign tourists to bring foreign motor vehicles into traffic in Vietnam.

2. Handling violations of this Decree and other related laws.

3. Cooperating with the Ministry of National Defense and the Ministry of Finance in handling temporary import and re-export procedures for foreign motor vehicles entering traffic in Vietnam.

4. Cooperating with People's Committees of provinces and centrally governed cities to manage, monitor, and inspect the participation of foreign motor vehicles in traffic in Vietnam.

5. In certain special cases to ensure traffic order, safety, and national security, the Ministry of Public Security may decide to refuse, suspend operations, or require changes in time, route, or speed for foreign motor vehicles participating in traffic in Vietnam for tourism purposes.

Article 9. Responsibilities of the Ministry of Culture, Sports and Tourism

1. Guiding organizations and individuals involved in bringing foreign motor vehicles into traffic in Vietnam in accordance with this Decree.

2. Cooperating with the Ministry of Public Security, the Ministry of Transport, the Ministry of Foreign Affairs, the Ministry of National Defense, and the Ministry of Finance to organize and manage the activities of foreign motor vehicles participating in traffic in Vietnam.

3. Issuing permits and managing the activities of international travel companies, especially those directly implementing foreign motor vehicle tourism in Vietnam; cooperating with units, localities, and enterprises to research and develop road tours, routes, and movement paths for foreign tourists to diversify tourism products and ensure the safety of their movements.

Article 10. Responsibilities of the Ministry of Foreign Affairs

Cooperating with the Ministry of Public Security, the Ministry of Transport, the Ministry of Culture, Sports and Tourism in managing foreign motor vehicles participating in traffic in Vietnam.

Article 11. Responsibilities of the Ministry of Finance

Leading and coordinating with the Ministry of Public Security and the Ministry of National Defense in handling temporary import and re-export procedures for foreign motor vehicles participating in traffic in Vietnam in accordance with customs laws.

Article 12. Responsibilities of the Ministry of Transport

Cooperating with the Ministry of Public Security, the Ministry of Foreign Affairs, the Ministry of National Defense, the Ministry of Finance, and the Ministry of Culture, Sports and Tourism in organizing and managing the activities of foreign motor vehicles participating in traffic in Vietnam.

Article 13. Responsibilities of the Ministry of National Defense

Leading the organization of border control inspections at border gates managed by the Ministry of National Defense; implementing border procedures, issuing, amending, supplementing, canceling visas, and issuing temporary residence certificates for foreigners entering the country in accordance with laws on entry and exit; cooperating with specialized state management agencies at border gates to supervise vehicles in performing temporary import and re-export procedures in accordance with this Decree.

Article 14. Responsibilities of the People's Committee ;, central city

1. Direct local functional agencies to implement management and inspection of the activities of foreign motor vehicles participating in traffic in Vietnam in accordance with the provisions of this Decree.

2. Notify the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, the Ministry of Foreign Affairs, and the Ministry of Transport about incidents related to foreign motor vehicles and foreigners when participating in traffic in Vietnam.

Article 15. Responsibilities of Vietnamese international travel service enterprises

1. Comply with regulations on entry and exit for persons and vehicles.

2. Organize the implementation of bringing foreign motor vehicles into participation in traffic in Vietnam and removing foreign motor vehicles from Vietnamese territory in accordance with regulations.

3. Adhere to regulations on ensuring security, order, and safety during the participation of foreign motor vehicles in traffic in Vietnam. Manage foreigners' activities according to the registered program; coordinate temporary residence declarations when tourists stay overnight on vehicles.

4. Within ten days from the end of the tour, submit a report in writing to the Ministry of Public Security regarding the organization of bringing foreign tourists with foreign motor vehicles into Vietnam for tourism in accordance with Model No. 06 attached as an appendix to this Decree.

5. Be responsible for handling and resolving costs arising from violations caused by the drivers of foreign motor vehicles during their participation in traffic in Vietnam.

6. Be responsible for the accuracy and legality of documents and information of the drivers and foreign motor vehicles in letters sent to the Ministry of Public Security and documents specified in Clause 3, Article 6 of this Decree.

 

Chapter IV

ARTICLE IMPLEMENTATION CLAUSE

 

Article 16. Effective Date

1. This Decree takes effect from May 1, 2024.

2. Decree No. 152/2013/NĐ-CP dated November 4, 2013, concerning the management of motor vehicles brought into Vietnam by foreigners for tourism, and Decree No. 57/2015/NĐ-CP dated June 16, 2015, amending and supplementing certain articles of Decree No. 152/2013/NĐ-CP dated November 4, 2013, of the Government concerning the management of motor vehicles brought into Vietnam by foreigners for tourism shall cease to be effective from the date this Decree takes effect.

3. Approval documents issued by the Ministry of Transport before the effective date of this Decree allowing foreign tourists to bring foreign motor vehicles into participation in traffic in Vietnam shall remain valid until the approved content ends.

Article 17. Responsibility for Implementation

Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and central city People's Committees, and relevant organizations and individuals are responsible for implementing this Decree./.
