CIRCULAR NO. 3011-VH/TT OF OCTOBER 28, 1985 ON THE GRADATION OF MANAGEMENT FOR THE PRESERVATION AND REPAIR OF HISTORICAL AND CULTURAL HERITAGES
In the past thirty years, the Party, State, and people have paid attention to preserving and promoting the historical and cultural heritage of the nation. Many heritages have been preserved, repaired, and are playing an important role in the education of patriotic traditions and socialist ideology in the cultural life of our people.
However, the general condition of these heritages continues to deteriorate, with many being severely damaged, some even becoming ruins including those from the revolutionary struggle period such as Con Dao, Tan Trao, Dien Bien Phu, etc. This situation has caused public opinion to express many concerns, the main reasons for the deterioration of heritages being:
- The funds, materials, equipment, and specialized personnel allocated for the repair of heritages are insufficient, failing to meet even urgent requirements.
- Heritages are not regularly maintained, and in some cases, they are violated; damages are not promptly addressed, repair plans are not implemented synchronously and timely.
- The gradation of management is unclear, the Central Government relies on localities, localities rely on the Central Government, and the people entrust the State.
To better preserve and effectively promote the invaluable cultural heritage of the nation, to fully implement the Ordinance on the Protection and Utilization of Historical and Cultural Heritages and Scenic Spots issued by the State Council, the Ministry of Culture proposes temporary regulations on the gradation of management for the preservation and repair of heritages as follows:
1. The Ministry of Culture directly manages special and important heritages of national significance in terms of planning, investment, and technical repair according to a list determined by the Council of Ministers.
Funds for repairing these types of heritages will be drawn from the annual state budget.
The Ministry of Culture is responsible for submitting to the Council of Ministers plans, proposals, solutions, and repair and restoration projects; it either directly implements or guides their implementation.
The Ministry of Culture assigns the People's Committees of provinces and cities where these heritages are located the responsibility for regular maintenance and emergency repairs. Annually, based on local proposals, the Ministry will allocate some funds for this purpose, drawn from the operational budget.
Following the principle of "Central and Local Governments, State and People working together," local authorities and people with special and important heritages need to plan investments in funds and human resources to accelerate repair and restoration work.
2. Other heritages recognized by the Ministry of Culture are managed comprehensively by the People's Committees of provinces and centrally-administered cities. Funds for repairing these heritages are drawn from local budgets. In necessary cases, based on the proposals of provincial and city committees, the Ministry of Culture will request the Council of Ministers to allocate part of the funds and specialized materials.
The Ministry of Culture reviews plans and proposals, provides guidance on the business and technical aspects of repairing these heritages.
3. To implement the management of national-scale special and important heritages, heritage management boards under the Provincial Departments of Culture and Information shall be established.
For large heritages under provincial and municipal management, similar organizations shall be established. The Ministry of Culture will provide detailed guidelines and regulations on this matter.
4. Heritage management boards are tasked with researching, protecting, maintaining, repairing, and organizing the promotion and exploitation of heritages.
Under current conditions, when heritages have not been thoroughly researched and surveyed, lack overall planning, and face shortages of funds, materials, and manpower, priority should be given to:
- Urgently implementing emergency maintenance and reinforcement to prevent collapse and preserve the original condition of heritages;
- Promptly conducting comprehensive surveys, establishing scientific files, formulating repair plans and designs, and economic and technical justifications and repair and restoration proposals.
Any repair, restoration, and enhancement of heritages must comply with legal provisions and follow the professional procedures of the cultural sector.
5. For special historical heritages during the revolutionary and resistance periods, emphasis should be placed on installing plaques and monuments to record historical events and strongly impact visitors.
The construction of grand monuments must be carried out carefully, based on thorough artistic research and consideration of costs versus benefits; wastefulness and reduction in heritage value must be avoided.
Monument projects planned at heritages under provincial and municipal management are reviewed by the Ministry of Culture.
Monument projects planned at heritages managed by the Ministry of Culture are reviewed by the Council of Ministers.
In exceptional cases, such as the construction of a monument to President Ho Chi Minh, approval from the Political Bureau of the Central Committee of the Party is required.
6. When formulating repair plans and proposals, consideration must also be given to the potential educational and aesthetic impacts on the people and the economic exploitation of heritages through tourism and services.
The active utilization of heritages is one of the decisive factors ensuring their long-term survival.
