DECISION OF THE PRIME MINISTER

Regarding the establishment of the Management Board for Industrial Zones of Cà Mau Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

At the request of the Chairman of the People's Committee of Cà Mau Province and the Minister of Home Affairs,

DECISION:

Article 1. The Management Board for Industrial Zones of Cà Mau Province is established under the People's Committee of Cà Mau Province to manage industrial zones within the territory of Cà Mau Province.

The Management Board for Industrial Zones of Cà Mau Province has legal personality, has its own bank account, office premises, and seal with the national emblem; it serves as the budget planning focal point of the People's Committee of Cà Mau Province, and is allocated construction capital from the state budget separately. The staffing and operating expenses of the Management Board are included in the staffing and state budget allocated to Cà Mau Province.

Article 2. Tasks and Powers

The Management Board for Industrial Zones of Cà Mau Province is responsible for performing tasks and exercising powers related to managing industrial zones as stipulated in Article 27 of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government.

Article 3. Organizational Structure and Staffing

b) The Management Board for Industrial Zones of Cà Mau Province shall have an assisting administrative apparatus as specified in Article 28 of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government, specifically including: - Office; - Inspectorate; - Specialized Departments.

c) The Infrastructure Development Company of Cà Mau Province Industrial Zone (operating under the mechanism of a service unit with income). Depending on the specific development requirements of industrial zones in each phase, the Director of the Management Board for Industrial Zones of Cà Mau Province shall submit organizational structure proposals to the Chairman of the People's Committee of Cà Mau Province for decision within their authority.

2. Staffing: The staffing of the Management Board for Industrial Zones of Cà Mau Province includes the Director, Deputy Directors specializing in management, and the staffing of the Office, Inspectorate, and specialized departments, which are civil service management staff. The staffing of the Management Board for Industrial Zones of Cà Mau Province shall be decided by the Chairman of the People's Committee of Cà Mau Province in accordance with Decree No. 71/2003/NĐ-CP dated June 19, 2003 of the Government on decentralization of civil service management staffing and Decree No. 112/2004/NĐ-CP dated April 8, 2004 of the Government on the management mechanism for staffing of state-owned service units.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Cà Mau Province, and the Director of the Management Board for Industrial Zones of Cà Mau Province are responsible for implementing this Decision./.
