Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Based on the Ordinance on Livestock Breeds and Decree No. 47/2005/NĐ-CP dated April 8, 2005 on administrative penalties in the field of livestock breeds;
Based on the Ordinance on Veterinary Services and Decree No. 129/2005/NĐ-CP dated October 17, 2005 on administrative penalties in the field of veterinary services;
Based on Circular No. 1686/TTg-NN dated November 1, 2005 of the Prime Minister;
Considering the proposal of the Director of the Department of Agriculture, the Director of the Department of Veterinary Services,
DECISION:
Article 1. This Decision promulgates regulations on conditions for raising poultry, incubating eggs, transporting, slaughtering, trading poultry and poultry products.
Article 2. This Decision takes effect from the date of signature.
Article 3. The Head of the Ministry's Office, the Director of the Department of Agriculture, the Director of the Department of Veterinary Services, the Directors of Provincial Departments of Agriculture and Rural Development under central cities and provinces, and the Heads of relevant units shall be responsible for implementing this decision.

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. These provisions apply in the fields of raising poultry, incubating eggs, transporting, slaughtering, trading poultry and poultry products.
Article 2. Organizations and individuals within and outside Vietnam engaged in activities related to raising poultry, incubating eggs, transporting, slaughtering, trading poultry and poultry products on the territory of Vietnam.
Article 2. Interpretation of Terms
Terms used in these provisions are understood as follows:
1. Chickens including chickens, ducks, geese, guinea fowls, pigeons, quails, ostriches, ornamental birds.
2. Poultry products including fresh and semi-processed meat, eggs, and other by-products.
3. Small-scale household poultry farming refers to dispersed and opportunistic farming with less than 200 poultry at any given time.
4. Backyard poultry farming refers to commercial production but not meeting the criteria for a farm, with a regular number of poultry ranging from 200 to less than 2,000.
5. Poultry farm refers to farming with a regular number of 2,000 or more poultry (according to the criteria for economic farms).
6. Incubation facility includes manual hatcheries and industrial incubation stations.
Chapter II
Poultry Farming AND PROHIBITED ACTIVITIES
Article 3. Conditions for safe disease control in poultry farming
Clause 1. Organizations and individuals engaged in poultry farming must register with the veterinary authority for assessment of sanitary conditions. Only when they meet the sanitary conditions confirmed by the veterinary authority and other conditions stipulated in the Ordinance on Livestock Breeds and the Ordinance on Veterinary Services can they commence production and business operations.
Clause 2. For small-scale household poultry farming, the housing must be separated from residential areas; for backyard and farm-scale poultry farming, it must be located far from residential areas, hospitals, schools, markets, and public offices to ensure sanitary conditions and biosecurity.
Clause 3. The farming area must be surrounded by walls or fences; the housing must be constructed appropriately for each type of poultry; poultry must not be mixed with livestock, sick poultry with healthy ones. There must be sufficient clean water; entry and exit points to the farming area must have disinfection pits; for farm-scale poultry farming, there must be disinfection equipment for people and transport vehicles.
Clause 4. The poultry breeds used must be included in the list of permitted breeds for production and trade as specified in Decision No. 67/2005/QĐ-BNN dated October 31, 2005 of the Ministry of Agriculture and Rural Development; the breeds must have clear origins from self-incubation or purchase from breeding facilities that have been quarantined and vaccinated against dangerous diseases as prescribed by veterinary authorities, particularly avian influenza.
Clause 5. Farming tools must be cleaned and disinfected after each use. The housing and surrounding areas must be regularly cleaned, disinfected, and decontaminated, and measures to prevent and control diseases must be implemented according to the guidelines of the veterinary authority.
Clause 6. The farming facility must have isolation areas for treating sick and dead poultry, waste disposal, following the guidance of the veterinary authority.
Altering, forging, borrowing, renting, and exchanging Certificates of Eligibility for Environmental Monitoring Services.
1. Raising poultry in the inner city (central cities and provincial cities), inner town (towns under provinces, towns under districts), new urban areas, industrial zones, and areas near schools and hospitals.
2. Free-range poultry and waterfowl running loose in fields.
3. Causing environmental pollution and failing to maintain veterinary hygiene.
4. Failing to report disease outbreaks proactively, spreading and disseminating sources of disease, selling diseased, sick, and dead poultry and poultry products.
Chapter III
INCUBATING EGGS OF POULTRY AND PROHIBITED ACTIVITIES
Article 5. Conditions for Incubating Eggs
1. Organizations and individuals engaged in incubating poultry eggs must register with veterinary authorities for sanitary inspection. Only when they meet the veterinary hygiene conditions confirmed by the veterinary authority in their locality and other conditions stipulated in the Animal Breeding Ordinance and the Veterinary Ordinance may they produce and operate.
2. Eggs must originate from registered breeding farms and be inspected by veterinary authorities.
3. The location of manual egg incubation facilities must be separate from residential areas, while industrial egg incubation facilities must be far from residential zones, schools, hospitals, markets, and government offices to ensure veterinary hygiene and biological safety.
4. There must be walls or fences surrounding the egg incubation facility.
5. Adequate clean water supply must be available; entry and exit points of the egg incubation facility must have disinfection pits; there must be disinfection equipment for people and transportation vehicles.
6. Egg incubation equipment must be cleaned, disinfected, and sterilized before and after each use. Inside and outside the egg incubation factory must be regularly cleaned, disinfected, and sterilized, and disease prevention measures must be implemented according to veterinary authority regulations.
7. There must be a place to handle dead chicks, defective eggs, eggshells, and other waste as directed by the veterinary authority.
Article 6. Prohibited Acts
1. Incubating eggs within urban or town centers.
2. Incubating eggs for producing breeding stock during prohibited periods.
3. Incubating eggs of unknown origin or taken from poultry farms affected by disease or unregistered farms.
4. Selling un-inspected breeding poultry.
Chapter IV
TRANSPORTATION OF POULTRY AND POULTRY PRODUCTS AND PROHIBITED ACTIVITIES
Article 7. Transporting Live Poultry
Live poultry can only be transported if the following conditions are met:
1. Healthy poultry from breeding farms and households in non-disease areas.
2. A health certificate issued by the veterinary authority when transporting out of the district, province, or city as required.
3. For poultry that require avian influenza vaccine injections, in addition to the provisions of Clauses 1 and 2 of this Article, the following must also be ensured:
a) Transporting poultry between areas where avian influenza vaccines have been administered;
- A vaccination certificate issued in accordance with regulations.
- For poultry not fully vaccinated or not yet at the age for vaccination, when transported to another area for continued rearing, the veterinary authority at the point of sale must inform the receiving veterinary authority to organize monitoring and vaccination as required.
b) Transporting poultry from non-vaccinated areas to vaccinated areas:
- The receiving veterinary authority must manage and monitor the poultry in its jurisdiction.
- For breeding poultry, the receiving veterinary authority must organize vaccinations and issue vaccination certificates.
Article 8. Transporting Poultry Meat
Poultry meat can only be transported if the following conditions are met:
1. Originating from healthy poultry with a health certificate from the veterinary authority.
2. Slaughtered at a slaughterhouse certified to meet veterinary hygiene conditions by the competent veterinary authority.
3. Must bear a slaughter inspection stamp on the carcass or have a veterinary hygiene label to be sold on the market. The meat must be packaged and stored in compliance with veterinary hygiene requirements.
4. A health certificate issued by the veterinary authority when transporting out of the district, province, or city.
Article 9. Transport of Poultry Eggs
Poultry eggs may only be transported if the following conditions are met:
1. They originate from breeding facilities or poultry farmers in areas free from disease outbreaks.
2. They must be contained in containers that have been cleaned, disinfected, and sterilized both before and after transportation.
3. They must have a veterinary health certificate when transported outside the district, province, or city.
For poultry farmers who sell fresh eggs locally within their commune or district, they are responsible for ensuring the quality and safety for consumers and preventing the spread of poultry diseases.
Article 10. Transport of Feathers
Feathers may only be transported if the following conditions are met:
1. The feathers are taken from poultry according to the provisions of Clauses 1 and 2 of Article 7.
2. They must be packaged and disinfected before transportation.
3. They must have a veterinary health certificate when transported outside the district, province, or city.
Article 11. Means of Transport for Poultry and Poultry Products
Means of transport for poultry and poultry products must:
1. Meet hygiene requirements to prevent the spread of dead poultry, feces, feathers, live poultry waste, blood and fluids from slaughtered poultry, and poultry products into the external environment.
2. Be cleaned and disinfected before and after each transportation.
Article 12. Prohibited Acts
1. Transporting live poultry on public passenger-carrying vehicles.
2. Transporting poultry of unknown origin without a veterinary health certificate.
3. Transporting and spreading diseased or dead poultry; unprocessed poultry feathers and feces.
Chapter V
SLAUGHTERING OF POULTRY AND PROHIBITED ACTS
Article 13. Requirements for Slaughtered Poultry
1. Healthy poultry with no signs of disease, originating from disease-free areas; possessing a veterinary health certificate as prescribed.
2. At least 28 days after receiving avian influenza vaccine injections.
Article 14. Conditions for Poultry Slaughtering Facilities
1. Centralized poultry slaughtering facilities must meet the following conditions:
a) The location of the slaughtering facility must comply with local government planning, ensuring veterinary hygiene and environmental protection conditions;
b) Entry and exit points of the slaughtering facility must have disinfection pits; there must be a disinfection system ensuring veterinary hygiene;
c) The slaughtering area must have separate dirty and clean zones;
d) There must be workshops, equipment, tools, and storage facilities meeting veterinary hygiene conditions;
đ) There must be facilities for staff to wash, shower, and change clothes;
e) Slaughtering staff must undergo regular health check-ups and be provided with protective gear as prescribed;
g) There must be sufficient clean water meeting standards for slaughtering;
h) There must be isolation zones for sick poultry, treatment zones for diseased poultry and unsanitary poultry products;
i) There must be a system for treating waste and wastewater to ensure veterinary hygiene and environmental sanitation;
k) Daily cleaning and disinfection of equipment, tools, and the slaughtering facility must be carried out according to the guidelines of the veterinary authority.
2. Slaughtering poultry at markets outside urban centers must meet the following conditions:
a) Permission from local authorities and veterinary supervision during slaughtering;
b) Located in a separate area at the end of the market, with a dedicated entrance for poultry entry;
c) Separated from other goods, adjacent areas must be enclosed by walls or other complete barriers;
c) Cooperate with relevant agencies to strictly control the importation of poultry breeds according to current regulations.
2. Department of Animal Health
a) Directly lead the prevention and control of avian influenza nationwide;
b) Direct veterinary agencies to strictly control the transportation, sale, slaughter, and processing of poultry and poultry products;
c) Organize inspections of veterinary hygiene conditions at breeding, slaughtering, processing, and trading facilities for poultry and poultry products.
Article 19. Responsibilities of the Department of Agriculture and Rural Development
1. Focus on directing avian influenza prevention and control work within its jurisdiction.
2. Organize the implementation of regulations concerning breeding conditions, egg incubation, transportation, slaughtering, and trading of poultry for organizations and individuals within its jurisdiction.
3. Direct the Veterinary Service Agency and veterinary stations.
a) Strictly control the production, transportation, and trade of live poultry and poultry products within the managed area and those exported out of the province or city;
b) Inspect the veterinary hygiene conditions of breeding facilities, egg incubation sites, slaughterhouses, processing plants, and trading places for poultry and poultry products within the managed area;
c) Coordinate with competent agencies to handle organizations and individuals violating the provisions set forth in this Decision and other laws regarding veterinary matters.
4. Based on the provisions of the Ministry of Agriculture and Rural Development, the Department of Agriculture and Rural Development shall advise the People's Committee of the province or centrally-administered city to issue regulations and policies supporting breeding, slaughtering, transportation, and trading of poultry that are suitable to local conditions in line with modernizing the poultry farming system.
Chapter VI
HANDLING VIOLATIONS
Article 20. Organizations and individuals violating the breeding conditions, egg incubation, transportation, slaughtering, and trading of poultry and poultry products as stipulated in these provisions will be subject to penalties under Decree No. 47/2005/NĐ-CP dated April 8, 2005, on administrative sanctions in the field of livestock breeding, Decree No. 129/2005/NĐ-CP dated October 17, 2005, on administrative sanctions in the field of veterinary medicine, and other relevant laws./.
