BASED ON THE LAW ON ENACTING LEGAL REGULATORY DOCUMENTS dated November 12, 1996;

Pursuant to Decree No. 81/CP dated November 8, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;

To enhance the effectiveness of state management over the organization of beauty pageants, while encouraging people to strive for beauty and appreciate high aesthetic beauty;

Considering the proposal of the Director of the Department of Cultural Information at the Grassroots Level;

Pursuant to …;

Article 1. The accompanying Decision promulgates the Regulations on Beauty Pageants (Miss, First Miss);

Article 2. These Regulations on Beauty Pageants (Miss, First Miss), attached to this Decision, shall take effect 15 days from the date of signature and replace the Regulations on Organizing Beauty Pageants No. 46/VH-QĐ dated September 18, 1989 issued by the Ministry of Culture.

Article 3. AThe Heads of the Ministry's Office, the Inspectorate, the Department of Cultural Information at the Grassroots Level, Directors of Provincial Departments of Culture and Information, Heads of units under the Ministry of Culture and Information, and related organizations and individuals are responsible for implementing these Regulations attached to this Decision.

REGULATIONS
BEAUTY PAGEANTS (MISS, FIRST MISS)

PART I

GENERAL PROVISIONS

Article 1:

Article 1: These regulations govern the organization of beauty pageants to select Miss Vietnam, First Miss Vietnam, or Miss International, First Miss International held in Vietnam.

Article 2: Talent contests in various fields in Vietnam or international talent contests held in Vietnam are not within the scope of these regulations.

Article 2:

Clause 1: Units organizing national beauty pageants include state agencies, political social organizations, and social organizations at the central level and provincial level.

Clause 2: Units organizing international beauty pageants in Vietnam include state agencies, political social organizations, and social organizations at the central level.

Article 3:

Clause 1: Beauty pageants must ensure order, safety, civility, and be consistent with Vietnamese customs and traditions.

Clause 2: The venue for the pageant must provide adequate sound, lighting, stage performance areas, dressing rooms, and other necessary conditions for contestants.

Clause 3: Beauty pageants may not be organized at locations for religious activities or historical sites.

Clause 4: It is strictly prohibited to exploit the organization of beauty pageants for commercial purposes or to commit illegal acts through such events.

Chapter II

ORGANIZATION OF BEAUTY PAGEANTS

Article 4:

Clause 1: Any unit wishing to organize a beauty pageant in Vietnam or an international beauty pageant in Vietnam must obtain permission from the competent authority as stipulated in Article 5 of these regulations. The application package includes:

a/ Application for permission to organize the pageant

b/ Plan for organizing the pageant including:

+ Time of organization;

+ Location of organization;

+ List of proposed Organizing Committee and Jury members;

+ Financial sources;

+ Ticket prices;

+ Sponsorship solicitation plan;

+ Advertising program.

c/ Rules of the pageant, working regulations of the Organizing Committee and the Jury.

Clause 2: For international beauty pageants organized in Vietnam, in addition to complying with the provisions of Clause 1 of this Article, written opinions from the Central Propaganda and Ideology Board, the Ministry of Public Security, and the Ministry of Foreign Affairs are required.

Article 5: Competent authorities to issue permits for organizing beauty pageants are as follows:

Clause 1: Provincial Departments of Culture and Information directly under the central government issue permits for beauty pageants at the provincial level.

Clause 2: The Ministry of Culture and Information issues:

a/ Permits for beauty pageants at the regional, national, inter-provincial levels directly under the central government.

b/ Permits for international beauty pageants in Vietnam.

Clause 3: Within 15 days from the receipt of complete valid applications for domestic beauty pageants, the competent authority must issue the permit, if denied, a written explanation of the reasons must be provided.

Clause 4: Within 30 days from the receipt of complete valid applications for international beauty pageants in Vietnam, the competent authority must issue the permit, if denied, a written explanation of the reasons must be provided.

Clause 5: Permits for domestic beauty pageants are valid for one year, permits for international beauty pageants in Vietnam are valid for two years from the date of issuance. If the permitted entity has not organized the event within that period, they must reapply for permission when organizing it.

Article 6:

The entity applying for permission to organize the pageant is responsible for establishing the Organizing Committee and bearing legal responsibility for all activities of the pageant. The Organizing Committee establishes a Jury and a secretariat to assist in the judging process.

Article 7:

The Jury of the pageant should include the following members:

Clause 1: Experts in anthropometry and aesthetics;

Clause 2: Performing artists in visual arts, stage, and photography;

Clause 3: Social science and humanities researchers;

Clause 4: Social activists;

Article 8:

Clause 1: Contestants participating in national beauty pageants must meet the following requirements:

a/ Be Vietnamese citizens with a permanent residence address in Vietnam;

b/ Age between 16 and 27 years old;

c/ Height of 1.60 meters or more;

d/ Educational level of secondary school or higher;

e/ Not married and have not given birth;

g/ In good health, free from infectious diseases, and have good morals;

h/ Have participated in preliminary selection contests at the grassroots level for the First Miss contest at the provincial level, and have participated in preliminary selections at the provincial level, regional, or national level for the national selection contest.

Clause 2: Contestants participating in international beauty pageants organized in Vietnam must meet the following requirements:

a/ Have an invitation from the Organizing Committee of the pageant;

b/ Hold a certificate of winning a national beauty title from their home country, with the time of winning in their home country not exceeding one year before the international beauty pageant in Vietnam;

c/ Be allowed to participate by their home country;

d/ Be granted permission to enter and exit Vietnam.

Clause 3: Contestants must comply with the pageant regulations, laws, and Vietnamese customs and traditions; violations will result in disqualification from the competition.

Article 9:

The pageants proceed according to the following sequence:

Clause 1: Preliminary selection to choose beauties for the final round:

a/ Body selection:

This process is conducted by a female anthropometric doctor under the supervision of a female member of the Board of Judges;

b- Perform traditional áo dài costume, evening gown, or self-selected costume, one-piece swimsuit;

c- Participate in the talent portion.

2- Final round to select Miss - First Runner-Up, Miss - Second Runner-Up:

The sequence follows the provisions set forth in points b and c of Clause 1 of this Article.

Article 10:

The titles awarded to contestants who win the competition are specified as follows:

1- The title of Miss - First Runner-Up is granted to the winner of the national or international level competition;

2- The titles of Miss - Second Runner-Up are granted to the winners of the provincial, centrally governed city, region, or area level competitions;

3- Any sponsors wishing to award other titles to contestants must obtain the approval of the Organizing Committee.

Article 11:

Individuals holding the titles of Miss - First Runner-Up, Miss - Second Runner-Up who violate the law and negatively impact the reputation of these titles will have their titles revoked by the competition organizing authority.

Chapter III

IMPLEMENTING PROVISIONS

Article 12:

1- The Department of Cultural Information at the Ministry of Culture and Information is responsible for guiding, monitoring, and inspecting the implementation of this Regulation nationwide.

2- The Provincial Department of Culture and Information is responsible for guiding, monitoring, and inspecting the implementation of this Regulation in their respective localities.

Within fifteen days from the end of the competition, the organizing unit must submit a report on the results to the approving authority.

Article 13:

Organizations and individuals violating the provisions of this Regulation shall be subject to legal sanctions according to the nature and severity of the violation.

Article 14:

This Regulation takes effect fifteen days from the date of signature and replaces the Regulation on the Organization of Beauty Pageants No. 46/VH-QĐ dated September 18, 1989 issued by the Ministry of Culture.
