PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Action Program on Prevention and Control of Narcotics for the period 1998-2000;

Considering the proposal of the Chairman of the National Committee for Prevention and Control of Narcotics,

DECISION:

Article 1: The Fund for Prevention and Control of Narcotics shall be established at the central level and in provinces and centrally-administered cities to support prevention and control activities against narcotics; and to reward outstanding collectives and individuals in such activities.

Article 2: The Fund for Prevention and Control of Narcotics shall be formed from the following sources:

1) Vietnamese currency, foreign currency, assets, and confiscated items (excluding narcotics) obtained from cases of drug-related crimes after judgments and decisions become legally effective.

2) Donations from domestic and foreign individuals and organizations.

Article 3:

1- The Central Fund for Prevention and Control of Narcotics shall be managed and directed by the Chairman of the National Committee for Prevention and Control of Narcotics.

2- The local Fund for Prevention and Control of Narcotics shall be managed and directed by the Chairman of the People's Committee of the province or centrally-administered city.

Article 4: The Fund for Prevention and Control of Narcotics shall be used for the following purposes:

1- Supporting units directly combating narcotics; purchasing equipment for prevention and control of narcotics.

2- Supporting relatives of those who have been sacrificed; those who have been injured or fallen ill due to direct participation in combating drug-related crimes, eradicating and replacing narcotic plants, and organizing drug rehabilitation.

3- Rewarding units and individuals with achievements in prevention and control of narcotics.

4- Supporting other activities related to prevention and control of narcotics.

Article 5:

1- The amount of money collected from drug-related cases as stipulated in Clause 1 and Clause 2 of Article 2 of this Decision shall be allocated as follows:

a- In cases where the case is tried by the Supreme People's Court:

- Allocate 30% to support and reward units and individuals directly involved in detecting and investigating the cases.

- Allocate 70% to the Central Fund for Prevention and Control of Narcotics.

b- In cases where the case is tried by the People's Court at provincial, district, county, town, or city-level courts:

- Allocate 30% to support and reward units and individuals directly involved in detecting and investigating the cases.

- Allocate 60% to the Provincial Fund for Prevention and Control of Narcotics where the case is tried;

- Allocate 10% to the Central Fund for Prevention and Control of Narcotics.

2- The donations from organizations and individuals as stipulated in Clause 2 of Article 2 of this Decision shall be used as follows:

a) In cases where the donation has a designated recipient, the donation shall be transferred according to the address specified by the donor in accordance with current laws.

b) For other donations, they shall be transferred to the Central Fund for Prevention and Control of Narcotics for management and use in accordance with this Decision.

Article 6:

1- The Ministry of Finance shall take the lead in coordinating with the Ministry of Public Security to guide the management and use of the Fund for Prevention and Control of Narcotics.

2- The Ministry of Finance shall take the lead in coordinating with the National Committee for Prevention and Control of Narcotics and the Ministry of Defense to guide the management and use of funds obtained from drug-related cases tried by military courts at all levels in accordance with the provisions of this Decision.

Article 7: This Decision shall take effect fifteen days from the date of signature.

Article 8: The Chairman of the National Committee for Prevention and Control of Narcotics, Ministers, Heads of Ministries equivalent to ministries, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision.
