DECISION

REGARDING THE ISSUANCE OF REGULATIONS ON THE OPERATIONS OF THE TASK FORCE

ON INTERNATIONAL ECONOMIC INTEGRATION IN THE INDUSTRY SECTOR

THE MINISTER OF INDUSTRY

Pursuant to the Government Decree No. 74/CP dated November 1, 1995 on the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to Decision No. 771/QĐ-HTQT dated April 11, 2001 of the Minister ofIndustry on the establishment of the Task Force on International EconomicIntegration in the Industry Sector;

At the proposal of the Director of the Department for International Cooperationand the Head of the Task Force on International Economic Integration in theIndustry Sector,

DECISION:

Article 1. These Regulations on the operations of the Task Force on International EconomicIntegration in the Industry Sector are hereby promulgated together with thisDecision.

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

The Heads of the Ministry's Office, Directors of Departments, Heads of agenciesand enterprises related to the Task Force on International Economic Integrationin the Industry Sector shall be responsible for implementing this Decision./.

REGULATION

OPERATIONS OF THE TASK FORCE ON INTERNATIONAL ECONOMIC INTEGRATION

IN THE INDUSTRY SECTOR

(PROMULGATED TOGETHER WITH DECISION NO. 31/2001/QĐ-BCN DATED MAY 25, 2001OF THE MINISTER OF INDUSTRY)

PART I

GENERAL PROVISIONS

Article 1These regulations apply to the Task Force on International Economic Integrationin the Industry Sector (hereinafter referred to as the International EconomicIntegration Task Force - IEITF), established pursuant to Decision No. 771/QĐ-HTQT dated April 11, 2001 of the Minister of Industry.

Article 2.The IEITF is tasked with coordinating with relevant functional departments,general corporations, companies, units, and organizations within the industrysector to implement the tasks stipulated in Article 1 of Decision No. 771/QĐ-HTQT dated April 11, 2001 of the Minister of Industry.

PART II

ASSIGNMENT OF RESPONSIBILITIES

Article 3RESPONSIBILITIES OF THE HEAD OF THE TASK FORCE.    

1-Based on the directives of the National Committee for International EconomicCooperation, taking into account the capacity for international economicintegration of specific industrial products, within the framework of medium- andlong-term plans of those industries, prepare advice to submit to the leadershipof the Ministry for formulating directions and specific activities regardinginternational economic integration of the industry sector, monitor theimplementation of international economic integration commitments of theMinistry of Industry.

2-Convene regular or extraordinary meetings of the Task Force and summarizeissues discussed or the situation of international economic integration workraised at the Task Force to report to the Ministry's leadership.

3-Assign tasks to Deputy Heads and members, urge and inspect the implementationof assigned tasks by members.

Article 4.RESPONSIBILITIES OF DEPUTY HEADS.

1-Assist the Head of the Task Force in the tasks outlined in

2-Perform the responsibilities of the Head of the Task Force when the Head isoccupied with other matters.

Article 5.RESPONSIBILITIES OF MEMBERS.

1-Report and seek opinions from the leadership of relevant functionaldepartments, general corporations, and companies on issues assigned to them.

2-Master knowledge and practical experience of international economic law andregulations on the operations of international economic organizations andfinancial institutions, and multilateral agreements signed.

3-Accept instructions, master policies and guidelines for international economicintegration of the Government through the National Committee for Internationaleconomic Cooperation and the guidance of the Ministry of Industry's leadership.

4-Master production and business conditions, especially import and exportactivities, as well as development orientations according to medium- and long-term plans of their respective industries.

5-Provide advice, propose adjustments, or offer initiatives concerning issuesrelated to their respective industries or products during policy-making, guidelinemanagement, or international economic integration activities to the leadershipof their units and the Head of the IEITF. For important proposals or initiatives,the IEITF will present them to the Ministry for submission to the NationalCommittee for International Economic Cooperation and the Government tocontribute to national negotiation strategies for international organizations ormember countries thereof.

6-Monitor and promptly identify issues arising during the implementation ofinternational economic integration commitments for their respective industries(such as dumping, trade fraud, violations of framework agreements, etc.) toreport to the leadership of their units and the Head of the IEITF for submissionto the Ministry before presenting to the National Committee for Internationaleconomic Cooperation to develop appropriate and timely countermeasures.

7-Members of the IEITF are responsible for keeping confidential information oneconomic cooperation during the negotiation preparation phase until the Ministryof Industry and the National Committee for International Economic Cooperationpublicly announce it.

8-Attend all IEITF meetings fully and carry out all assignments given by theHead.

Article 6COMMISSION SECRETARIAT.

Members belonging to the staff of the Department for International Cooperationat the Ministry of Industry, in addition to their duties like other members, arealso responsible for assisting the Head in secretarial work.

CHAPTER III

WORKING REGIME

Article 7.MEETING PROCEDURES.

In addition to extraordinary meetings convened by the Head, the Task Force willregularly meet before or after meetings of the National Committee forInternational Economic Cooperation (on average once per quarter). Depending onthe content, importance, and necessity of the work, the Task Force may requestthe Ministry's leadership to send groups on urgent missions to localities orabroad.

The Secretariat assists the Head in preparing meeting agendas and compilingreports after each meeting to be submitted to the Ministry of Industry'sleadership.

Meeting reports are stored in the Secretariat.

PART IV

EXPENSES FOR OPERATIONS AND DOCUMENTS, INFORMATION

Article 8.OPERATIONAL EXPENSES.

When attending Task Force meetings and traveling on official business, membersare provided travel expenses by general corporations, companies, and unitsaccording to current travel expense regulations.

Expenses for Task Force activities are funded from state budget allocations tothe Ministry and mobilized from other sources of funding, including generalcorporations, companies, and production and business units. Expenses for urgentoverseas trips are covered by the delegation's budget, allocated by the state tothe Ministry or by the unit, depending on which organization the member iscurrently affiliated with.

Article 9DOCUMENTS AND INFORMATION.

Members are entitled to receive documents and information related to their TaskForce duties for study, reference, proposal, and retention.

In addition to receiving and providing information related to the Task Force, theHead and members also have the responsibility to disseminate information andbasic knowledge about international economic integration, permitted forpublication, to their units upon permission from the unit's head.

CHAPTER V

IMPLEMENTING PROVISIONS

Article 10The Head of the IEITF is responsible for organizing and supervising theimplementation of these Regulations; periodically summarizing the situation andproposing decisions to the Ministry for amending and improving the Regulations./.
