Pursuant to the Measurement Ordinance dated October 6, 1999;
Pursuant to Article 18 of Decree No. 06/2002/NĐ-CP dated January 14, 2002 of theGovernment detailing the implementation of the Measurement Ordinance;
Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks,powers, and organizational structure of the Ministry of Science, Technology, andEnvironment;
At the proposal of the Director of the General Bureau of Standards, Metrology andQuality;
DECISION:

1.General Provisions
1.1 These regulations stipulate the requirements for measurements of mass (weighing)and volume (measuring) in retail commerce; methods for inspecting these weighingand measuring operations.
1.2 Sellers must ensure that the goods sold to customers are weighed or measuredaccording to the agreed quantity and facilitate conditions for customers to witnessand check the quantity of goods.
1.3 The General Bureau of Standards, Metrology and Quality (hereinafter referred toas the General Bureau) shall be responsible for organizing and implementinginspections of weighing and measuring operations in retail commerce to ensurecompliance with the measurement requirements set forth herein.
2. Measurement Requirements
2.1 The weight of goods sold to customers when weighed may not be less than thepermitted limit specified in Table 1 below:

2.2 The volume of goods sold to customers when measured may not be less than thepermitted limit specified in Table 2 below:

2.3 Measuring instruments used for weighing and measuring during sales must meet thefollowing requirements:
a) They must have been calibrated and remain within their legal usage period;
b) Scales must have an accuracy class of 4 or higher; measuring containers musthave an accuracy from 0.5% to 1% and have a measurement range suitable for theweight or volume being measured.
2.4 Sellers must weigh or measure before the customer. In cases where goods havebeen weighed or measured previously (but not pre-packaged), sellers must clearlyindicate the quantity of goods weighed or measured on the packaging and must beready to reweigh or remeasure if requested by the customer.
2.5 Buyers have the right to request sellers to reweigh or remeasure goods at theplace of sale using the seller's measuring instrument or to self-inspect at designatedweighing and measuring points (if available) or through legally recognized measuringinstruments of others.
3.Inspection of Weighing and Measuring Operations in Retail Commerce
3.1 Inspections are conducted at the place of purchase and sale.
3.2 Scales and measuring containers used for inspection (referred to as inspectionequipment) must satisfy the following requirements:
a) They must have been calibrated and remain within their legal usage period;
b) Have a measurement range appropriate for the weight or volume being inspected;
c) Scales must have an accuracy corresponding to the provisions in Table 3 below:

d) Measuring containers must have an accuracy from 0.1% to 0.5%.
3.3 Inspection Procedure and Content:
3.3.1 Inspection of the Seller's Measuring Instruments
a) Inspection of the legality of the measuring instruments: seals, calibrationcertificates, tamper-evident seals, lead seals, validity period of calibration...
b) Inspection of the operation of the measuring instruments:
For scales: The scale must be properly positioned, all components must functionnormally, the initial indication must be at zero; after lightly pressing thescale, the indication must return to zero (perform three times).
For measuring containers: The measuring container must not be deformed, bent,or altered in shape or contain residual goods affecting its capacity.
3.3.2 Inspection of the Seller's Weighing and Measuring Operations
a) For goods that have been weighed or measured previously: Take no fewer than tenrandom packages, perform weighing or measuring on the inspection equipment. Theinspection results compared to the seller's previous weighing or measuringquantities must not exceed the permitted shortage limits specified in Tables 1 or2 of these regulations.
If three or more results do not meet the requirements, it is concluded that theseller's weighing or measuring operations do not meet the required standards. Ifone or two results do not meet the requirements, a second sample should be takenand rechecked. If the second check still has one result that does not meet therequirements, the overall conclusion will be that the requirements are not met.
b) For direct weighing or measuring: Require the seller to perform weighing ormeasuring of at least three different quantities of goods; the inspector performsrechecking on the inspection equipment. If one result does not meet therequirements, the inspection should be repeated. If this inspection still has oneresult that does not meet the requirements, it is concluded that the seller'sweighing or measuring operations do not meet the required standards.
4. Inspection Report
The inspection results are recorded in the Inspection Report for Measurement accordingto the model provided in the annex to these regulations.
