DECREE
Regarding the adjustment of pension levels for those who retired before April 1993
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Labor Code on June 23, 1994 and the Law Amending and Supplementing Certain Articles of the Labor Code on April 2, 2002;
Pursuant to Resolution No. 17/2003/QH11 dated November 4, 2003 "on the state budget estimate for 2004" and Resolution No. 19/2003/QH11 dated November 26, 2003 "on tasks for 2004" of the National Assembly, Session XI;
At the proposal of the Minister of Labor, War Invalids and Social Affairs and the Minister of Finance,
DECREE
Article 1. As of January 1, 2004, increase the current pension level for those who retired under Decree No. 218/CP dated December 27, 1961, Decree No. 161/CP dated October 30, 1964 of the Government, and Decree No. 236/HĐBT dated September 18, 1985 of the Council of Ministers (now the Government). The adjustment amounts will be calculated based on the current pension level as stipulated in Decree No. 03/2003/NĐ/CP dated January 15, 2003 of the Government as follows:
1. For workers and civil servants who have retired:
Increase the current pension level by 7% for those who retired under Decree No. 218/CP dated December 27, 1961 of the Government and Decree No. 236/HĐBT dated September 18, 1985 of the Council of Ministers (now the Government).
2. For officers, non-commissioned officers, professional military personnel, and those receiving salaries according to the pay scale of the armed forces who have retired:
a) Increase the current pension level by 7% for those who retired under Decree No. 161/CP dated October 30, 1964 of the Government and Decree No. 236/HĐBT dated September 18, 1985 of the Council of Ministers (now the Government).
b) For those holding leadership positions receiving salaries according to their rank when retiring under Decree No. 161/CP dated October 30, 1964 of the Government and Decree No. 236/HĐBT dated September 18, 1985 of the Council of Ministers (now the Government), in addition to the 7% increase specified in point a above, they shall also receive an additional increase of 2% of the current pension level.
The additional pension funds applicable to the subjects specified in Clauses 1 and 2 of this Article shall be provided from the state budget.
Article 2. This Decree shall take effect fifteen days after its publication in the Official Gazette.
Article 3. The Minister of Labor, War Invalids and Social Affairs shall take the lead and coordinate with the Ministry of Finance and the Ministry of Defense to guide the implementation of this Decree.
Article 4. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
