Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 114/2003/NĐ-CP dated October 10, 2003 of the Government on cadres and civil servants at commune, ward, and town levels;

Pursuant to Decision No. 03/2004/QĐ-TTg dated January 7, 2004 of the Prime Minister approving the Orientation Plan for the Training and Capacity Building of Cadres and Civil Servants at Commune, Ward, and Town Levels until 2010;

Considering the proposal of the Minister of Home Affairs,

DECISION:

Article 1. Approves the Training and Capacity Building Program for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels for the Period 2006-2010, which includes the following main contents:

1. Objectives.

To equip necessary knowledge about state administration, management methods, and skills to enhance the capacity of Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels in organizing and implementing assigned tasks, powers, and responsibilities during the process of building a professional and modern administrative system that meets the requirements of administrative reform and the construction of a socialist rule-of-law state by the people, for the people, and with the people.

2. Training and Capacity Building Recipients.

Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels.

3. Training and Capacity Building Programs, Contents, and Methods.

a) Training and Capacity Building Programs.

Develop and perfect training and capacity building programs and contents for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels towards enhancing administrative management knowledge and skills, focusing on skills and methods for handling and resolving situations in management and operation by Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels.

There will be separate programs for each category, including:

- Training and Capacity Building Program for Chairpersons of People's Councils and Chairpersons of People's Committees at Ward and Town Levels;

- Training and Capacity Building Program for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune Levels in Plain Areas;

- Training and Capacity Building Program for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune Levels in Midland and Mountainous Areas and Areas with Ethnic Minority Populations.

b) Training and Capacity Building Contents.

The training and capacity building contents include three parts:

- Basic knowledge about the state, laws, and ethics for cadres and civil servants;

- State management in various fields within the scope and authority of People's Committees and People's Councils at Commune, Ward, and Town Levels. Tasks, powers of Chairpersons of People's Committees and Chairpersons of People's Councils in various fields;

- Management and operation skills and methods for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels. Computer knowledge. Ethnic languages (for communes with ethnic minority populations).

c) Training and Capacity Building Methods.

Apply new training and capacity building methods to promote the initiative and positivity of learners, combining classroom teaching with increased seminars, exchanges among trainees, problem-solving exercises, practical work, and field surveys.

4. Training and Capacity Building Forms: centralized training (with certification upon completion of the course).

5. Duration of Training and Capacity Building.

a) For those who have already been trained at university or intermediate administrative levels, the duration of training and capacity building is two months;

b) For those who have not yet received administrative management training, the duration of training and capacity building is three months.

6. Training and Capacity Building Locations and Organizing Agencies.

In 2006, the National Academy of Public Administration (under the Ministry of Home Affairs) will organize training sessions for local instructors and pilot classes in three regions (urban, plain, mountainous and midland areas) to ensure that provinces and centrally-administered cities can organize training and capacity building for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels in subsequent years.

7. Funding for Program Development, Textbook Compilation, Instructor Training, and Training Classes for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels shall be sourced from the central budget and local budgets according to the provisions of the Budget Law.

Article 2. Implementation

1. The Ministry of Home Affairs is responsible for:

a) Uniformly manage the content of training and capacity building programs, textbooks, and materials for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels; organize compilation, review, issuance, and monitoring of program implementation.

b) Develop plans and direct the organization of training and capacity building for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels according to the approved contents in this decision.

c) Take the lead and coordinate with the Ministry of Finance and the Ministry of Planning and Investment to develop plans and targets for funding the annual training and capacity building for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels, and submit them to the competent authority for approval.

d) Guide and monitor provincial People's Committees and centrally-administered city People's Committees in developing and implementing training and capacity building plans for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels.

e) Coordinate with the Ministry of Education and Training to study and organize undergraduate public administration training for Chairpersons of People's Councils and Chairpersons of People's Committees specifically and for the cadre and civil servant team at Commune, Ward, and Town Levels generally.

2. The Ministry of Planning and Investment shall coordinate with the Ministry of Home Affairs and the Ministry of Finance to aggregate and balance annual training and capacity building plans for cadres and civil servants, including targets for training and capacity building for Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels, and submit them to the competent authority for approval.

3. The Ministry of Finance shall take the lead and coordinate with the Ministry of Home Affairs to study and issue appropriate policies and regulations for trainees who are Chairpersons of People's Councils and Chairpersons of People's Committees at Commune, Ward, and Town Levels, aiming to provide preferential treatment, create favorable conditions, and encourage learning.

4. The Ministry of Education and Training shall study and innovate the training program and cultural supplementation for the secondary school system taught to Chairpersons of People's Councils and Chairpersons of People's Committees at commune, ward, and town levels, so that provincial People's Committees can develop plans to enhance cultural education for those Chairpersons of People's Councils and Chairpersons of People's Committees who have not completed secondary school to meet the required educational standards as stipulated.

5. Provincial People's Committees and municipal People's Committees directly under the Central Government shall develop annual plans and implement the training and enhancement programs for Chairpersons of People's Councils and Chairpersons of People's Committees at commune, ward, and town levels in accordance with Clause 6, Article 1 of this Decision.

Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial People's Committees and municipal People's Committees directly under the Central Government are responsible for enforcing this Decision./.
