THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 4 of Decree No. 119/2006/NĐ-CP dated October 16, 2006 of the Government on the organization and operation of forest protection;

Pursuant to Decision No. 06/2007/QĐ-BNN dated January 23, 2007 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Forest Protection Department;

At the proposal of the Director of the Forest Protection Department and the Head of the Cadre and Civil Servant Affairs Department.

DECISION:

Article 1. Position and Functions

1. a safety and occupational health department The Forest Protection Agency Region II shall be established under the Forest Protection Department based on restructuring the Technical Center for Forest Protection No. II.

2. The Forest Protection Agency Region II shall perform specialized management functions regarding forest protection, fire prevention, and firefighting within the assigned region.

3. The Forest Protection Agency Region II shall have legal personality, its own seal, and shall receive funds from the state budget as provided by law, and shall be allowed to open bank accounts according to the provisions of the law.

The headquarters of the Forest Protection Agency Region II shall be located in Thanh Hoa City.

4. The scope of activities of the Forest Protection Agency Region II includes the provinces and centrally governed cities (hereinafter referred to as provinces): Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Da Nang City, Quang Nam, Binh Dinh, Quang Ngai, Phu Yen, Khanh Hoa, Dak Nong, Dak Lak, Gia Lai, and Kon Tum.

Article 2. Tasks and Authorities

1. Perform certain specialized management tasks regarding forest protection and ensure compliance with laws on forest protection and development within the assigned region as follows:

a) Participate in developing programs, projects, standards, procedures, technical regulations on forest protection, fire prevention, firefighting, nature conservation, biodiversity, wildlife and plant management.

b) Guide, urge, and inspect the implementation of legal normative documents, programs, projects, standards, technical procedures on forest protection, fire prevention, firefighting, nature conservation, biodiversity, wildlife and plant management by provincial Forest Protection Agencies.

c) Guide, urge regional shifting cultivation production, forest allocation, and forest protection contracts.

d) Guide and inspect the implementation of measures to prevent illegal logging and other unlawful acts that harm forests and forestry land.

e) Guide and inspect the performance of state management responsibilities over forests and forestry land by forest owners in the region.

2. Carry out fire prevention and firefighting activities:

a) Organize fire risk forecasting; develop plans, projects, and programs for fire prevention and firefighting in the region.

b) Coordinate and support provincial Forest Protection Agencies in fire prevention and firefighting activities.

c) Inspect activities related to forest protection, fire prevention, and firefighting.

d) Organize forces and coordinate with local authorities to stand guard and fight fires in national priority areas.

3. Participate in training and professional development for forest rangers and forest protection forces.

4. Participate in research, application of scientific and technological progress, and international cooperation according to the program and plan of the Forest Protection Department. Coordinate with forest protection agencies in the region to organize professional training and technical skill development for forest rangers and forest protection forces.

5. Participate in publicizing knowledge, disseminating laws on forest protection, fire prevention, firefighting, nature conservation, biodiversity, wildlife and plant management.

6. Manage organizational structure, staff, finance, and assets allocated according to regulations.

7. Implement administrative reform, comply with information reporting and periodic reports as stipulated by the Forest Protection Department.

8. Perform other tasks assigned and delegated by the Director of the Forest Protection Department in accordance with the law.

Article 3. Organizational Structure

1. Leadership of the Forest Protection Agency Region II shall consist of a Director and Deputy Directors appointed and relieved of duty by the Director of the Forest Protection Department according to regulations and the分级管理权限的规定。

The Director shall be responsible to the Director of the Forest Protection Department and the law for the tasks assigned.

The Deputy Directors shall assist the Director, and be responsible to the Director and the law for the tasks assigned by the Director.

2. Management machinery:

a. Administrative and General Affairs Office;

b. Forest Protection Technology Office;

c. Mobile Forest Ranger and Firefighting Team;

The Director of the Forest Protection Department is authorized to define the duties of the management machinery specified in Clause 2 of this Article and to allocate personnel quotas for the Forest Protection Agency Region II according to the quota assigned by the Ministry to the Department.

The Director of the Forest Protection Department shall manage the recovery and submission of seals of the Technical Center for Forest Protection No. II to the competent authority issuing the seal registration certificate according to regulations.

Article 4. Effectiveness and Responsibility for Implementation

This Decision shall take effect fifteen days after its publication in the Official Gazette. Decisions previously issued by the Ministry of Agriculture and Rural Development that conflict with this Decision are hereby abolished.

2. The Director of the Forest Protection Department shall instruct the Director of the Technical Center for Forest Protection No. II to hand over the Technical Center in its current condition to the Director of the Forest Protection Agency Region II.

3. The Chief of the Office, Heads of Departments, Director of the Forest Protection Department, Heads of relevant agencies and units under the Ministry, and the Director of the Forest Protection Agency Region II shall be responsible for implementing this Decision./.
