Regulations on standards, responsibilities of officers performing vehicle registration duties and procedures for issuing, revoking registration certificates and license plates for various types of road motor vehicles

Pursuant to the Law on People's Police of Vietnam 2005;

BASED ON THE LAW ON TRAFFIC ON ROADS 2008;

Pursuant to Decree No. 136/2003/NĐ-CP dated November 14, 2003 stipulating functions, tasks, powers, and organizational structure of the Ministry of Public Security;

The Ministry of Public Security hereby stipulates the standards, responsibilities of officers performing vehicle registration duties and procedures for organizing the issuance, revocation of registration certificates and license plates for various types of road motor vehicles as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This Circular stipulates requirements, standards, responsibilities of officers performing vehicle registration duties and procedures for issuing, registering, and revoking registration certificates and license plates for various types of road motor vehicles (hereinafter referred to as vehicle registration).

2. Requirements, standards of officers performing vehicle registration duties

a. Requirements for officers performing vehicle registration duties

- Mastering and strictly implementing laws and regulations on road traffic, this Circular, and other relevant legal provisions;

- Strictly implementing regulations on democratic practices in ensuring traffic order and safety and the Police Force Regulations;

- When interacting with the public, they must show respect, politeness, dedication, and propriety;

- Timely detecting, preventing, and handling violations related to vehicle registration issuance according to prescribed procedures and authority under the law.

b. Standards for officers performing vehicle registration duties

- Having a police college degree or equivalent or higher;

- Working continuously in the Road Traffic Police force for at least three years;

- Proficient in using computers and computerized vehicle management programs.

3. Vehicle Registration Location

The vehicle registration location must be conveniently located, have suitable area, sufficient seating and parking space, clear signage for those coming to register vehicles; publicly display regulations on registration procedures, fees, schedules, suggestion boxes; equipped with necessary tools to meet registration requirements; display identification signs of officers performing vehicle registration duties.

4. Responsibilities of officers performing vehicle registration duties

a. Responsibilities of the Director of the Highway and Railway Traffic Police Department

- Advising the leadership of the Ministry of Public Security on drafting normative legal documents on vehicle registration and management;

- Directing, guiding, and organizing the implementation of vehicle registration and management;

- Ensuring adequate staffing meeting the standards specified in point b, clause 2 above for vehicle registration duties;

- Approving and signing documents related to vehicle registration in accordance with Circular No. 06/2009/TT-BCA(C11) dated March 11, 2009 of the Ministry of Public Security on issuing, revoking registration certificates and license plates for various types of road motor vehicles (hereinafter referred to as Circular No. 06/2009/TT-BCA(C11)); the maximum approval and signature period shall not exceed three working days;

- Providing written responses detailing reasons to vehicle owners for cases where documents related to vehicle registration are not approved or signed in accordance with Circular No. 06/2009/TT-BCA(C11).

b. Responsibilities of the Head of the Provincial Traffic Police Department (hereinafter referred to as Provincial Public Security), the Head of the County, District, City, and Town Public Security (hereinafter referred to as County-level Public Security)

- Strictly implementing vehicle registration and management in their respective localities;

- Advising and proposing solutions to difficulties and obstacles in vehicle registration and management in their respective localities to the Provincial Public Security Director;

- Ensuring adequate staffing meeting the standards specified in point b, clause 2 above for vehicle registration duties;

- Approving and signing documents related to vehicle registration in accordance with Circular No. 06/2009/TT-BCA(C11); the maximum approval and signature period shall not exceed three working days;

- Providing written responses detailing reasons to vehicle owners for cases where documents related to vehicle registration are not approved or signed in accordance with Circular No. 06/2009/TT-BCA(C11).

c. Responsibilities of the leaders of the Registration Guidance and Management Office of Motor Vehicles under the Highway and Railway Traffic Police Department (hereinafter referred to as the Office under C26), the leaders of the Registration Team under the Provincial Traffic Police Department, and the Team Leader responsible for vehicle registration under the County-level Public Security

- Strictly implementing vehicle registration and management in accordance with Circular No. 06/2009/TT-BCA(C11);

- Assigning specific tasks and reasonably allocating officers directly involved in vehicle registration and management to achieve high efficiency;

- Checking vehicle registration files and implementing the following provisions:

+ If the vehicle file is complete and meets the prescribed procedures, sign immediately on the Vehicle Registration Application Form (Form No. 02 issued together with Circular No. 06/2009/TT-BCA(C11) dated March 11, 2009 of the Ministry of Public Security) to submit to the authorized person for approval and signature of documents related to vehicle registration as stipulated in points a and b of this clause.

+ If the vehicle file does not comply with the procedures stipulated in Circular No. 06/2009/TT-BCA(C11), report to the authorized person stipulated in points a and b of this clause to provide a written response to the vehicle owner.

d. Responsibilities of officers performing vehicle registration duties

- Upon receiving vehicle registration files, check and compare the file with the vehicle; if found complete and compliant with the prescribed procedures, accept the file; if the file does not meet the prescribed procedures, provide detailed and comprehensive guidance once to the vehicle owner to supplement the file and bear responsibility for such guidance. Strictly prohibit adding additional vehicle registration procedures.

- Stamp the title "OWNER'S SELF-MANAGED FILE" (Form No. 01 issued together with Circular No. 06/2009/TT-BCA(C11)) between the pages of documents handed over to the vehicle owner for new registration, license plate issuance; transfer of ownership, change, reissue of registration certificates and license plates or previously registered files now handed back to the owner for self-management.

- Report and propose to the direct superior about the received vehicle files for examination and verification before submitting to the authorized person as stipulated in points a and b of this clause for review and decision.

- After verifying that the vehicle file complies with the regulations, issue license plates to the vehicle owner immediately; issue registration certificates, files (in case of transfer of ownership), certificate of cancellation of registration certificates and license plates (in case of cancellation of registration certificates and license plates) or reissue registration certificates and license plates within a maximum period of three working days; issue temporary registration certificates and license plates on the same day.

II. VEHICLE REGISTRATION PROCEDURES

1. Preparation work

a. Daily, staff responsible for vehicle registration must arrive 15 minutes before working hours to listen to instructions regarding requirements, tasks, and new relevant documents concerning vehicle registration work, check the operation of computers, prepare books, forms, license plates, fee receipts, tools, and other equipment necessary for vehicle registration tasks.

b. Guide vehicle owners or authorized persons (hereinafter referred to collectively as vehicle owners) to follow procedures for vehicle registration in order, ensuring orderliness and scientific process; direct vehicles to designated locations according to order.

2. Implement vehicle registration.

a. Guide vehicle owners to fill out the Vehicle Registration Application Form (according to the model).

b. Conduct actual inspection of the vehicle according to the following regulations:

b.1. Directly compare the contents in the Vehicle Registration Application Form with the actual vehicle regarding brand, type, engine number, frame number, paint color, seating capacity, load capacity, and other technical specifications of the vehicle.

b.2. Stamp the engine number and frame number and sign over the stamped engine number and frame number, clearly recording the name and date of the staff member conducting the actual inspection of the vehicle.

For police force specialized automobiles and motorcycles, in addition to implementing the above regulations, a technical safety inspection of the vehicle must be conducted in accordance with Circular No. 06/2009/TT-BCA(C11) dated March 31, 2009, which stipulates the organization of technical safety inspections and environmental protection for police force specialized automobiles and motorcycles.

c. Inspect the vehicle registration file and issue license plates.

Accept the vehicle registration file; inspect and compare the owner's documents and vehicle documents (transfer certificates, tax stamps, and origin certificates) according to regulations. If the file does not meet the requirements specified in Circular No. 06/2009/TT-BCA(C11), the staff receiving the registration file must provide detailed guidance and explanations to the owner and record the guidance content on the back of the Vehicle Registration Application Form; sign, clearly write their name, and take responsibility for the guidance provided. If the file meets the requirements specified in Circular No. 06/2009/TT-BCA(C11), the following provisions shall be implemented:

c.1. Number the file sequentially and summarize key information from the documents (Vehicle Registration Application Form, Origin Certificate of the vehicle) onto the cover of the file.

c.2. Enter the owner's name and address, as well as vehicle characteristics such as brand, type, engine number, frame number, paint color, etc., into the computer; if the vehicle is registered under the lessee's address by a financial leasing company, the address should be recorded according to the request letter.

c.3. Guide the owner to select a license plate number using the computer keyboard and record the selected license plate number on the Vehicle Registration Application Form.

c.4. Print the appointment notice according to the model.

d. Collect registration fees.

đ. Issue license plates.

e. Guide the owner to mark the license plate number, load capacity, gross weight, and owner's name on the vehicle according to regulations, except for passenger cars with nine seats or fewer.

g. Stamp the title on the vehicle registration file before classifying the files into two categories: those to be retained and those to be returned to the owner for self-management.

g.1. Stamp the title "VEHICLE REGISTERED ON ... MONTH ... YEAR ... LICENSE PLATE NUMBER ..." in the upper right corner of the Vehicle Registration Application Form and the origin certificate.

g.2. Stamp the title "OWNER'S FILE FOR SELF-MANAGEMENT" in the center of the pages of the following types of documents: tax stamp certificates; purchase, gift, or transfer certificates; owner's documents (if any) to be handed over to the owner for self-management.

h. Print the Vehicle Registration Certificate.

For police force specialized automobiles and motorcycles, if they meet technical safety standards, print an additional Certificate of Technical Safety Inspection and Environmental Protection for Motor Vehicles.

i. Report to the leadership of the C26 Department and the registration team leader for review and approval of the registration files to be signed by the competent authority according to regulations.

k. Laminate the Vehicle Registration Certificate.

l. Collect the appointment notice and return the registration file and certificate.

l.1. Guide the owner to check the registration file returned by the registration agency; request the owner to record in the "Owner's Signature Receipt of File" section of the Vehicle Registration Application Form that the file has been checked and all documents have been received, sign and clearly write their name; place the owner's self-managed documents in a bag (model 01 attached) and hand it over to the owner for safekeeping.

l.2. Return the Vehicle Registration Certificate and guide the owner to purchase compulsory motor vehicle liability insurance at an insurance agency according to regulations.

l.3. Enter the "date, month, year when the file was handed over to the owner" in the note section on the computer.

1.4. Hand over the registration file, including the origin certificate and the Vehicle Registration Application Form, to the file management staff.

m. Report the results of the vehicle registration.

3. Transfer registration within the province or centrally governed city.

a. Accept the transfer registration file and require the owner to present a valid compulsory motor vehicle liability insurance certificate.

b. Write a request form to withdraw the original file.

c. Implement the provisions set forth in point a, point b, subpoint c.1, c.2, c.4 point c, point d, subpoint g.2 point g, point h, point i, point k clause 2 Section II of this Circular.

d. Cut off the top right corner of the Vehicle Registration Certificate.

For motorcycles, electric motorcycles, and other vehicles transferred between different districts, towns, cities under provinces, the file must include a transfer registration form, along with the original file of the vehicle.

If the vehicle needs to change its license plate during the transfer, then subpoint c.3 point c and point đ clause 2 Section II of this Circular must also be implemented.

4. Transfer registration outside the province or centrally governed city.

a. Accept the transfer registration file.

b. Retrieve the license plate and registration certificate.

c. Write a request form to withdraw the original file.

d. Check and compare the Vehicle Registration Application Form for transfer, the Vehicle Registration Certificate, and the transfer certificate with the original file of the vehicle.

đ. Update the changed information about the vehicle transfer into the computer, print two transfer registration forms according to the model, and print a temporary Vehicle Registration Certificate.

e. Cut off the top right corner of the Vehicle Registration Certificate.

g. Report to the leadership for signing the Vehicle Registration Application Form for transfer, the transfer registration form, and the temporary Vehicle Registration Certificate.

h. Seal the original file with a cross-stamp. The Vehicle Registration Application Form for transfer, the transfer registration form, the Vehicle Registration Certificate, and the transfer certificate should be clipped to the outside of the sealed file bag.

i. Issue a temporary Vehicle Registration Certificate and guide the owner to affix the license plate according to regulations.

k. Return the transfer file to the owner.

l. Hand over the Vehicle Registration Application Form for transfer, the transfer registration form (retained copy) to the file management staff.

5. Temporary vehicle registration.

a. Check the vehicle owner's documents, Vehicle Registration Application Form, compare the photocopied file with the file of the vehicle that has been issued a temporary registration certificate.

b. Implement the provisions set out in sub-item c.2, points c, d, đ, h, i, k, and l, Clause 2, Section II of this Circular.

c. Return the original file to the vehicle owner, except for vehicles whose registration certificates and license plates must be recovered.

In the case of extending a Temporary Registration Certificate, recover the initial Temporary Registration Certificate, retain it in the file, and issue a new Temporary Registration Certificate (without requiring a Vehicle Registration Application Form).

6. Exchange, reissue vehicle registration certificates or license plates, or registration certificates for modified vehicles or vehicles with changed paint colors.

a. Accept the Vehicle Registration Application Form; letters from agencies, organizations, or individuals requesting to exchange, reissue vehicle registration certificates or license plates, or registration certificates for modified vehicles or vehicles with changed paint colors.

b. Inspect the actual vehicle (for modified or repainted vehicles).

c. Write a proposal to withdraw the original file, check, and compare the vehicle file.

d. Supplement the content of exchanging, reissuing vehicle registration certificates or license plates into the computer.

đ. For cases of exchanging or reissuing license plates, implement the provisions set out in sub-item c.2 and sub-item c.4, points c, d, đ, sub-item g.2, point g, points k and l. For cases of exchanging or reissuing registration certificates, implement the provisions set out in sub-item c.2 and sub-item c.4, points c, đ, sub-item g.2, point g, points h, i, k, and l, Clause 2, Section II of this Circular.

e. Stamp "Exchange, reissue the nth time" on the upper right corner of the Vehicle Registration Application Form. For cases of exchanging or reissuing registration certificates, stamp additionally on the front of the registration certificate (above the line of text "Registration Certificate").

g. If the vehicle file serves as a registration document for a complete engine or chassis to replace another vehicle, then the entire vehicle file will be used as documentation for that component (including files for registered and unregistered vehicles).

7. Register vehicles, issue civilian license plates for People's Army vehicles or register vehicles according to business requirements.

a. Register vehicles, issue civilian license plates for People's Army vehicles.

- Accept the vehicle registration file, letters requesting registration from the leadership of the Ministry of National Defense with approval comments from the leadership of the Ministry of Public Security.

- Implement the provisions set out in Clause 2, Section II of this Circular.

b. Register vehicles according to business requirements.

- Accept letters requesting vehicle registration according to business requirements from agencies or units with approval comments from the leadership of the Ministry of Public Security or the leadership of the Police General Corps (for central agencies and units), or the Director of Provincial Public Security (for local agencies and units).

- The vehicle registration file must be complete as prescribed. For registered vehicles, there must be a copy of the Vehicle Registration Certificate (for vehicles registered by the People's Army) or a copy of the Registration Certificate (for vehicles registered by the Public Security).

- Implement the provisions set out in Clause 2, Section II of this Circular.

8. Recover vehicle registration certificates and license plates.

a. Accept the Vehicle Registration Certificate Recovery Application Form.

b. Recover license plates and Registration Certificates, print a receipt.

c. Write a withdrawal form for the original file.

d. Enter the recovery content into the computer. Print two Vehicle Registration Certificate Recovery Certificates (according to the model).

In the case of recovering a registration certificate to obtain a complete engine or chassis to replace another vehicle, print the Vehicle Registration Certificate and License Plate Recovery Certificate according to regulations; simultaneously, confirm on the back of the Vehicle Registration Certificate and License Plate Recovery Certificate issued for the chassis or engine.

đ. Cut off the upper right corner of the Registration Certificate.

e. Report to the authorized person specified in Clause 4, Section I of this Circular to sign the Vehicle Registration Certificate and License Plate Recovery Certificate.

g. Issue a Temporary Registration Certificate for automobiles and process the recovery of registration certificates and license plates for export or transfer within Vietnam; project vehicles exempted from import tax now transferred to other purposes; vehicles registered in economic and trade zones when exported or transferred into Vietnam.

h. Return the Vehicle Registration Certificate and License Plate Recovery Certificate to the vehicle owner.

i. Hand over the file, Vehicle Registration Certificate and License Plate Recovery Certificate (retained copy) to the file management officers.

III. RESOLUTION OF SOME SPECIFIC CASES

1. General principles

a. The Traffic Police Department of the Provincial Public Security guides the resolution of difficulties and issues in vehicle registration work at the county level Public Security. New issues arising but not yet covered by guidance documents shall be advised and reported by the Provincial Public Security Director to the Ministry (through the Police General Corps).

b. Difficulties related to local departments such as Finance, Customs, Transportation, Courts, Prosecution Offices, Civil Enforcement Agencies, agencies authorized to confiscate contraband items or vehicles, Asset Auction Centers, etc., shall be advised by the Provincial Public Security Traffic Police Department to the Provincial Public Security Director to issue letters for communication with these departments to reach a unified solution.

2. Numbering engines and chassis

a. Numbering engines and chassis for imported vehicles

- Imported vehicles without engine numbers or chassis numbers; if the customs declaration for imported origin does not have or cannot find the engine number or chassis number, then allow numbering based on the registration plate number.

- In cases where the engine number or chassis number of registered or unregistered vehicles is unclear, faded, or rusted, they can be renumbered according to the engine number or chassis number confirmed by the Customs Authority in the Declaration of Origin for Imported Motorcycles or Motor Vehicles.

- If the engine of an imported vehicle is enclosed by equipment making it impossible to number the engine or if the vehicle does not have a chassis number but only has a VIN on the windshield and the Customs Authority uses this as the chassis number, then there is no need to renumber the engine or chassis, but photographs of the VIN (with scale) must be kept in the file. The VIN is the engine number and chassis number of the vehicle.

b. Numbering engines and chassis for domestically produced or assembled vehicles

- Vehicles with engine numbers or chassis numbers stamped with pins (lade) or faded and unclear numbers can be renumbered according to the engine number or chassis number recorded in the Quality Inspection Certificate upon Factory Exit.

- Vehicles with overlapping engine numbers or chassis numbers must be referred for appraisal; if the appraisal agency concludes that the engine number or chassis number is original, they can be renumbered according to the engine number or chassis number recorded in the Quality Inspection Certificate upon Factory Exit.

c. If a registered vehicle has a new engine installed or a new engine block installed without an engine number, number it according to the registration plate number.

d. Vehicles with decisions on confiscation, decisions on handling evidence of competent authorities, or investigative agency's conclusion documents including: vehicles with engine numbers, frame numbers that have been drilled, erased, or cannot be identified with their original engine numbers, frame numbers shall be renumbered according to the number on the license plate.

đ. Procedures for renumbering engine numbers and frame numbers

- Prepare a proposal form for renumbering engine numbers and frame numbers (model number 02 attached) to submit to the Director of the Highway Traffic Police Department; the Head of the Provincial Traffic Police Department, the Head of the County Public Security Department for approval.

- Carry out the renumbering of engine numbers and frame numbers.

- Record the renumbered engine numbers and frame numbers onto the vehicle registration application form and the proposal form for renumbering engine numbers and frame numbers.

3. In cases where the vehicle origin documents are suspected to be fake, erased; vehicles with engine numbers, frame numbers identical to those of lost vehicles or suspected to have been welded, erased, or drilled.

a. Report to the Director of the Highway Traffic Police Department; the Head of the Provincial Traffic Police Department, the Head of the County Public Security Department for opinions; if the leadership decides to temporarily detain the vehicle and the registration documents, then a detention record must be established. The detention decision and detention record must be made in two copies, one copy given to the owner of the vehicle, and one copy retained at the registration authority.

b. Within the latest two working days from the date of the detention decision, the authority receiving the vehicle registration documents must request the Criminal Technical Appraisal Agency under the Ministry of Public Security to conduct an appraisal. Within the latest ten days from the date of receiving the appraisal request, the appraisal agency must provide a written response.

- If the appraisal agency concludes that the vehicle origin documents are not fake or erased; engine numbers and frame numbers remain original, then proceed with vehicle registration.

- If the appraisal agency concludes that the import origin documents are fake, erased, or engine numbers and frame numbers have been welded, erased, or drilled, then transfer the case to the competent investigative agency and notify the vehicle owner.

- If the engine numbers and frame numbers have been erased or drilled but the investigative agency concludes that it is not a stolen or smuggled vehicle, the vehicle origin documents comply with regulations, and there is no commercial fraud; and the Vehicle Inspection Bureau under the Ministry of Transport can determine the year of manufacture (still within the validity period), then administrative penalties shall be imposed according to the law and vehicle registration shall be processed.

4. In cases where during the process of transferring ownership, moving, changing, or reissuing vehicle registration plates or through file reviews, fake or erased vehicle origin documents are discovered.

a. Follow the provisions set forth in Clause 3 above.

b. If there is a written conclusion from the investigative agency stating that the vehicle is smuggled but not evidence in a criminal case, then implement the following provisions:

- Write a proposal to the Director of the Highway Traffic Police Department or the Provincial Public Security Director to issue a letter and transfer the file to the Customs or Tax Authority in the locality to collect taxes according to regulations.

- Guide the vehicle owner to contact the Customs or Tax Authority in the locality to resolve the matter.

- After the vehicle owner pays the tax according to the law, accept the registration according to the provisions of Clause 2 Section II of this Circular.

5. Registration of vehicles with decisions by competent authorities on confiscation, handling of evidence, auction, or civil enforcement.

a. Follow the provisions set forth in Clause 2 Section II of this Circular. In case of complaints, guide the vehicle owner to the authority that issued the confiscation, handling of evidence, auction, or civil enforcement decision to resolve the matter.

b. For vehicles confiscated and transferred to the state treasury, if they were previously registered by another public security authority, notify the public security authority that registered the vehicle. If the vehicle was confiscated but the confiscation decision did not specify the engine number or frame number, but these numbers are found, send them for appraisal; if determined that the vehicle has no signs of being drilled or erased, propose renumbering according to the license plate number and proceed with registration; if the confiscation decision does not specify the engine number or frame number, require the vehicle owner to have the confiscation decision amended by the issuing authority and proceed with registration.

6. Issuance and affixing of Control Stickers for vehicles operating in Special Economic Zones - Special Trade Areas

a. Accept the Declaration Form for Temporary Import and Re-export of Road Transport Vehicles; check the Vehicle Registration Certificate, Identity Card, Passport, or other documents equivalent to a passport.

b. Check and compare with the list of vehicles applying to operate domestically, record in the Monitoring Book and immediately issue Control Stickers to the vehicle owner, affix the Control Sticker on the upper right corner inside the front windshield of the vehicle.

7. In cases where the vehicle is transferred but the original file is lost or the owner's managed file is lost or damaged.

a. Guide the vehicle owner to write a letter or application requesting vehicle registration and issuance of license plates.

b. Check and compare the owner's documents according to the provisions of Clause 2 Part A Section II of Circular No. 06/2009/TT-BCA(C11).

c. The public security authority where the transfer-out procedures are carried out must confirm the transfer-out procedures on the copy of the Transfer Application Form and the Transfer Record Form.

d. The public security authority receiving the registration file must publicly post the vehicle with engine numbers, frame numbers, brand, type... which have lost files at its office. After thirty days, if there are no complaints or reports, proceed with registration and report to the Highway Traffic Police Department; if there are doubts, report to the Director of the Highway Traffic Police Department or the Provincial Public Security Director.

8. In cases where the vehicle file transferred does not meet the registration requirements.

a. Directly guide the vehicle owner and fully and accurately record the vehicle registration procedures on the back of the registration declaration form; clearly record the name of the guiding officer, the date, month, year of guidance, and bear responsibility for the guidance provided.

b. Within the latest two days from the date of receipt of the transferred vehicle file, the public security authority receiving the file must send a letter to the transferring authority, clearly stating the reasons for non-receipt and requesting supplementary procedures. The letter, along with the sealed file, must be handed over to the vehicle owner to transfer to the transferring authority.

c. Within three days from the date of receiving the request letter and vehicle registration file, the police agency transferring the file must supplement the file fully; in case there is no agreement on the resolution measures, the police agency transferring the file shall report to the Director of the provincial police for instructions from the General Department of Police (through the Highway Police Corps).

9. In cases where the vehicle has been transferred but the new owner has not yet completed the name change procedures and the vehicle registration certificate is lost.

a. Guide the transferee to prepare a letter or application for vehicle registration.

b. Check and compare the identity documents of the transferee and the transfer documents of the vehicle.

c. Publicly post at the office premises the name, address of the vehicle owner, license plate number, frame number, engine number of the vehicle; after ten years without any complaints or reports, proceed with registration according to the provisions of Clause 3 and Clause 4, Section II of this Circular. In cases where the vehicle is transferred within the province or centrally-administered city, print out the verification response form (Form No. 04 issued together with Circular No. 06/2009/TT-BCA-C11) to be given to the buyer to complete the preliminary tax payment procedures.

10. In cases where the vehicle registration files kept at the registration agency are lost, damaged, or misplaced.

a. The staff managing the vehicle registration files must write a self-criticism report and bear responsibility for the loss, damage, or misplacement of the files.

b. Establish a Committee to determine the cause, record each specific case of vehicle file in a protocol; this protocol has the value of replacing the original vehicle file and is stored and managed according to the file management regulations. The Committee consists of:

- At the Ministry, the Committee is chaired by the Director of the Highway Police Corps; the Head of the Force Building, Logistics Department and the Head of the Registration Guidance and Traffic Vehicle Management Department under the Highway Police Corps are members.

- At the provincial police, the Provincial Police Director chairs the Committee. The Head of the Traffic Police Department and the Inspector General of the Provincial Police are members; if the vehicle registration files managed by the county police are lost, the County Police Chief also becomes a member.

IV. MANAGEMENT OF VEHICLE REGISTRATION FORMS AND LICENSE PLATES, VEHICLE REGISTRATION PROGRAM ON COMPUTER, INFORMATION REPORTING SYSTEM

1. Management of vehicle registration forms and license plates

Vehicle registration forms for cars; motorcycles, motorbikes, electric bikes; trailers; temporary vehicles; safety technical inspection certificates for road traffic vehicles; inspection stickers; inspection books; license plates must be strictly managed in accordance with the regulations of the Ministry of Public Security and implement the following provisions:

a. The Highway Police Corps is responsible for managing, inspecting, printing, and distributing the registration forms to local public security agencies, including: car registration forms, motorcycle, motorbike, and electric bike registration forms, trailer registration forms, temporary vehicle registration forms, safety technical inspection certificates for road traffic vehicles, inspection stickers, inspection books;

b. The Traffic Police Department of the provincial public security agency bases on the required quantity of vehicles to be registered to print the forms specified in Point a of this Clause with the Highway Police Corps; produce license plates and print other forms to meet the registration and management requirements of their unit and distribute them to the county-level public security agencies.

c. The county-level public security agency forecasts the quantity of forms needed to be printed, sends it to the Traffic Police Department. By December each year, they must settle accounts for the forms and license plates with the Traffic Police Department.

2. Management of the vehicle registration program on computer

a. The vehicle registration uses a unified registration program, randomly selecting license plates on computers nationwide.

b. The Highway Police Corps is responsible for building and managing the vehicle registration program, randomly selecting license plates on computers.

c. The Provincial Public Security Director receives the random license plate selection program on computers, directs the Traffic Police Department and county-level public security agencies to install and use it in accordance with regulations.

3. Information reporting system

a. Regarding vehicle registration and management

- Regularly every week, month, and year, the county-level public security agency must report to the Traffic Police Department of the provincial public security agency on the situation and results of vehicle registration and management (Form No. 03 attached).

- Regularly every week, month, and year, the Traffic Police Department of the provincial public security agency must report to the Highway Police Corps on the situation and results of vehicle registration and management (Forms No. 03 and 04 attached).

b. Regarding vehicle registration database

- Regularly every week and month, the county-level public security agency compiles and transfers the vehicle registration data to the Traffic Police Department of the provincial public security agency.

- At the end of each month, the Traffic Police Department of the provincial public security agency must transfer the vehicle registration data of its locality onto CDs, floppy disks, or transmit it to the Highway Police Corps.

- The Highway Police Corps is responsible for managing the national vehicle registration database.

The General Department of Police will provide detailed guidance on the management, exploitation, supply, and use of the vehicle registration database.

V. IMPLEMENTATION

1. The General Department of Police Director is responsible for organizing training, directing, inspecting, and guiding the implementation of this Circular.

2. This Circular takes effect 45 days from the date of signature, replacing Decision No. 1370/2007/QĐ-BCA-C11 dated November 27, 2007 of the Minister of Public Security on the Vehicle Registration and License Plate Issuance Procedures for Road Motor Vehicles and Decision No. 1445/2008/QĐ-BCA-C11 dated August 28, 2008 of the Minister of Public Security supplementing some provisions of Decision No. 1370/2007/QĐ-BCA dated November 27, 2007 of the Minister of Public Security on the Vehicle Registration and License Plate Issuance Procedures for Road Motor Vehicles.

3. The Directors of all Departments under the General Department of Police, Heads of units directly under the Minister, Provincial Police Directors, and Ho Chi Minh City Fire Prevention and Fighting Service Directors are responsible for implementing this Circular.

During the implementation of this Circular, if any difficulties arise, local public security agencies shall report to the Ministry (through the General Department of Police) for timely guidance.
