CIRCULAR
Regulations on the technical evaluation criteria table in tender documents for purchasing medicines

Pursuant to the Law on Bidding dated November 26, 2013;
Pursuant to Decree No. 63/2014/NĐ-CP dated June 26, 2014 of the Government detailing implementation of certain provisions of the Law on Bidding regarding selection of contractors;
This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.
At the proposal of the Director of the Drug Administration Department and the Director of the Planning and Finance Department;
The Minister of Health issues this Circular stipulating the Technical Evaluation Criteria Table in tender documents for purchasing medicines.
Article 1. Technical Evaluation Criteria Table in tender documents for purchasing medicines
1. Technical evaluation criteria include the criteria specified in Appendix 1 attached to this Circular.
2. The evaluation method shall be conducted using a scoring system with a maximum score of 100 points, specifically as follows:
a) Medicine quality: 70% of total points (70 points).
b) Packaging, storage, delivery: 30% of total points (30 points).
c) The technical proposal document is considered to meet the technical requirements when it satisfies the following conditions: - Each criterion's score under the medicine quality requirement and packaging, storage, and delivery requirement is not less than 60% of the maximum score for that criterion. - The total score of all technical evaluation criteria is not less than 80% of the total points.
3. Tender documents meeting the capability and experience evaluation standards of the contractor and the technical evaluation criteria shall continue to be reviewed to determine the comprehensive evaluation criteria according to Article 24 of Decree No. 63/2014/NĐ-CP dated June 26, 2014 of the Government detailing certain provisions of the Law on Bidding regarding the selection of contractors.
Article 2. Effective Date
This Circular takes effect from the date of issuance. Clause 2, Article 7 of Circular No. 37/2013/TT-BYT dated November 11, 2013 of the Minister of Health guiding the preparation of tender documents for purchasing medicines in healthcare facilities shall cease to be effective from the date this Circular comes into force.
Article 3. Transitional Provisions
1. For tender documents issued before August 15, 2014, the selection of contractors shall be carried out according to the provisions of Circular No. 37/2013/TT-BYT dated November 11, 2013.
2. For tender documents issued after August 15, 2014 whose contents are not consistent with this Circular, the entity issuing the tender documents must amend the tender documents to ensure compliance with this Circular.
Article 4. Responsibilities for Implementation
The Director of the Drug Administration Department, the Director of the Planning and Finance Department, the Head of the Ministry’s Office, the Directors of Departments, Bureaus, General Bureaus under the Ministry of Health, Heads of agencies and units directly under the Ministry, Directors of Health Departments of provinces and centrally-administered cities, and Heads of health agencies of ministries and sectors are responsible for implementing this Circular. In the course of implementation, if there are difficulties or obstacles, the units and localities shall report to the Ministry of Health (Planning and Finance Department) for research and resolution.
