Article 1. Scope of Regulation
2. FORENSIC PSYCHIATRIC EXPERTISE THE AMOUNT OF SUBSIDY, NUMBER OF PARTICIPANTS, AND TIME FOR PERFORMING FORENSIC PSYCHIATRIC EXPERTISE BY DAY (CALCULATED BY HOUR) SHALL BE APPLIED ACCORDING TO THE PROVISIONS IN TABLE 03 ATTACHED TO THIS CIRCULAR.
Article 2. Applicability
3. PROVISIONS ON THE NUMBER OF DAYS PARTICIPATING IN EXPERTISE
PROVISIONS ON THE NUMBER OF DAYS PARTICIPATING IN EXPERTISE SHALL BE IMPLEMENTED ACCORDING TO THE PROVISIONS IN CLAUSE 3, CLAUSE 4, AND CLAUSE 5 OF ARTICLE 2 OF DECISION NO. 01/2014/QD-TTg.
1. THIS CIRCULAR SHALL TAKE EFFECT FROM DECEMBER 1, 2015.
2. THE SUBSIDY REGIMES FOR FORENSIC MEDICAL AND PSYCHIATRIC EXPERTISE REGULATED IN THIS CIRCULAR SHALL BE APPLIED FROM MARCH 15, 2014.
1. THE DEPARTMENT OF MEDICAL EXAMINATION AND TREATMENT SHALL TAKE THE LEAD AND COOPERATE WITH RELATED ORGANIZATIONS AND UNITS TO ORGANIZE THE IMPLEMENTATION, GUIDANCE, AND INSPECTION OF THIS CIRCULAR ACROSS THE COUNTRY.
2. ORGANIZATIONS, ORGANIZATIONAL UNITS, AND INDIVIDUALS RELATED TO THE IMPLEMENTATION OF FORENSIC MEDICAL AND PSYCHIATRIC EXPERTISE SUBSIDY REGIMES SHALL BE RESPONSIBLE FOR IMPLEMENTING THE PROVISIONS OF THIS CIRCULAR. ANY DIFFICULTIES OR OBSTACLES ENCOUNTERED DURING IMPLEMENTATION SHALL BE REPORTED PROMPTLY TO THE MINISTRY OF HEALTH FOR CONSIDERATION AND RESOLUTION.
IN THE COURSE OF IMPLEMENTATION, IF THERE ARE ANY DIFFICULTIES OR OBSTACLES, IT IS RECOMMENDED THAT ORGANIZATIONS, ORGANIZATIONAL UNITS, AND INDIVIDUALS REPORT PROMPTLY TO THE MINISTRY OF HEALTH FOR CONSIDERATION AND RESOLUTION./.
b) The regime for compensatory fees for forensic examination on a case-by-case basis
The amount of compensatory fees, number of participants, and time for conducting forensic examinations for each type of forensic medical examination on a case-by-case basis are specified in Table 02 attached hereto.
2. Forensic psychiatric examination
The amount of compensatory fees, number of participants, and time for conducting forensic psychiatric examinations on a daily work basis (calculated by hours) shall be applied in accordance with the provisions set out in Table 03 attached hereto.
3. Provisions regarding days of work participation in forensic examinations
Provisions regarding days of work participation in forensic examinations shall be implemented in accordance with Clauses 3, 4, and 5 of Article 2 of Decision No. 01/2014/QĐ-TTg.
Article 4. Effective date
1. This Circular takes effect from December 1, 2015.
2. The regime for compensatory fees for forensic medical examinations and forensic psychiatric examinations stipulated herein shall be applied from March 15, 2014.
Article 5. Responsibilities for Implementation
1. The Department of Medical Examination and Treatment shall take the lead and coordinate with relevant agencies and units to organize the implementation, guidance, and inspection of this Circular throughout the country.
2. Agencies, organizations, and individuals related to the implementation of the regime for compensatory fees for forensic medical examinations and forensic psychiatric examinations shall be responsible for implementing the provisions of this Circular. In the course of implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are advised to promptly report to the Ministry of Health for consideration and resolution.
