REGULATIONS ON THE STANDARDS OF NATIONAL DEFENSE INSPECTOR RANKS

On the basis of Law organization At the proposal of dated June 19, 2015;

On the basis of Law on Inspection Decision No. 150/2020/NĐ-CP

On the basis of Law on Officers of the Vietnam People's Army December 21, 1999; Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army June 3, 2008 and Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army April 27, the Pursuant to Decree No. 50/2010/NĐ-CP dated May 14, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Natural Resources Tax;

Decree No. Decision No. 33/2014/NĐ-CP April 26, 2014 of At the proposal of for organization and activities of National Defense Inspectors;

Decree No. 97/2011/NĐ-CP December 21, the Circular No. 10/2011/TT-BQP At the proposal of stipulating National Defense Inspectors and Inspection Collaborators;

At the proposal of the Minister of National Defense,

Prime Minister At the proposal of promulgating this Decision to regulate the standards of National Defense Inspector ranks.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decision regulates the standards of National Defense Inspector ranks.

Article 2. Applicability

This Decision applies to officers of the Vietnam People's Army appointed to National Defense Inspector ranks.

Article 3. National Defense Inspectors

1. National Defense Inspectors are officers of the Vietnam People's Army appointed to Inspector ranks to perform inspection tasks and other tasks assigned by the head of the agency or unit.

2. National Defense Inspectors must meet the standards set forth in Article 12 of the Law on Officers of the Vietnam People's Army, the general standards prescribed in Clause 1, Article 32 of the Law on Inspection, and Articles 5, 6, and 7 of this Decision.

Article 4. National Defense Inspector Ranks

1. Inspector.

2. Senior Inspector.

3. Senior Level Inspector.

Chapter II

SPECIFIC PROVISIONS

Article 5. Standards for Inspector Rank

1. Responsibilities

Inspectors have the responsibility to assist the head of the agency or unit in implementing certain areas of inspection work and other tasks; they are entrusted to lead or directly inspect cases with moderate complexity and nature; when conducting inspections, they must comply with the law and be accountable before the law and the direct managing head of the agency or unit for the tasks assigned.

2. Tasks

a) Advising, proposing, and organizing the implementation of inspection work programs and plans;

b) Participating in building plans, organizing the implementation of decisions on administrative inspections and specialized inspections; assisting the unit head in handling complaints and petitions, receiving citizens, and preventing corruption; directly collecting, verifying evidence, and preparing inspection files;

c) Studying, compiling, collecting, processing information, and building databases on inspection work;

d) Preparing minutes, writing reports on inspection results, drafting conclusions on inspections to clarify each inspected content, determine the nature and severity of violations, causes, and responsibilities; recommending measures for resolution;

đ) Organizing lessons learned from the implementation of assigned inspections;

e) During the inspection process, performing duties and exercising powers as prescribed in Article 47 and Article 54 of the Law on Inspection;

g) Performing other tasks assigned by the head of the inspection agency.

3. Competence

a) Mastering Party guidelines, state policies, directives, resolutions of superiors, military regulations, and systems to apply them in inspection activities; handling complaints and petitions; receiving citizens, and preventing corruption;

b) Having basic knowledge of military and national defense; mastering inspection procedures and practices; handling complaints and petitions; receiving citizens, and preventing corruption;

c) Understanding laws and economic-social conditions;

d) Possessing the ability to research, analyze, and synthesize situations in the assigned field, draft guiding documents, and organize the implementation of inspection work; handling complaints and petitions; receiving citizens, and preventing corruption.

4. Requirements for Qualifications and Other Conditions

a) Graduating from a university degree or higher in a major relevant to the working field;

b) Holding a certificate for Inspector rank vocational training;

c) Holding a foreign language certificate at level 1 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the Foreign Language Proficiency Framework for Vietnam (hereinafter referred to as Circular No. 01/2014/TT-BGDĐT) or a foreign language certificate at level A or above in one of five languages: English, French, Russian, Chinese, German; or holding a certificate or recognition of ethnic minority language proficiency issued by an authorized body;

d) Holding an information technology certificate with a basic level of proficiency as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Proficiency Standards (hereinafter referred to as Circular No. 03/2014/TT-BTTTT);

đ) Having at least two years of experience in inspection work, except in cases where they have held a battalion command position or equivalent position, or transferred from a technical-professional officer position with a rank of major or higher to an inspection agency.

Article 6. Criteria for the rank of Senior Inspector

1. Responsibilities

A Senior Inspector is responsible for advising and assisting the head of the agency or unit in performing inspection work and other important tasks; they are assigned to lead or coordinate participation in inspections of cases with wide scope, complex circumstances, involving multiple fields and units both within and outside the Military. When conducting inspections, they must comply with the law, be accountable under the law and to the head of the managing agency or unit regarding the assigned tasks.

2. Tasks

a) Lead or participate in drafting plans and implementing decisions on administrative inspections and specialized inspections; assist the head of the agency or unit in handling letters and complaints, resolving appeals and accusations; receiving citizens and preventing corruption; directly collecting and verifying evidence, establishing inspection files;

b) Directly implement or organize coordination with relevant agencies and units to collect evidence and files related to the inspection case; resolve appeals and accusations; prevent corruption as assigned;

c) Draft reports on inspection results, inspection conclusions, clarifying each inspected content; determine the nature and degree of violation, causes, responsibilities; propose measures to address and improve management activities within the assigned field;

d) Organize evaluations and draw lessons from the implementation of assigned inspections;

d) Participate in drafting inspection procedures, appeal resolution procedures, citizen reception, and anti-corruption procedures; directly or participate in training professional knowledge for inspectors;

e) During the inspection process, perform duties and exercise powers as stipulated in Articles 47 and 54 of the Inspection Law;

g) Performing other tasks assigned by the head of the inspection agency.

3. Competence

a) Have basic knowledge of state administration; thoroughly understand the Party's guidelines, policies, State laws, directives, resolutions of superiors, military discipline regulations to apply them in inspection activities; resolving appeals and accusations; receiving citizens and preventing corruption;

b) Having basic knowledge of military and national defense; mastering inspection procedures and practices; handling complaints and petitions; receiving citizens, and preventing corruption;

c) Understand laws and economic, cultural, social management;

d) Possess research and analytical skills to synthesize situations in the assigned field; have the ability to assume responsibility as Head or Deputy Head of the inspection team;

4. Requirements for Qualifications and Other Conditions

a) Graduating from a university degree or higher in a major relevant to the working field;

b) Graduated from mid-level, brigade, division cadre training at relevant military academies corresponding to the specialty of the current working field;

c) Hold a certificate for training in the inspector rank of Senior Inspector;

d) Hold a foreign language certificate at level 2 as prescribed in Circular No. 01/2014/TT-BGDĐT or a foreign language certificate at level B or higher in one of the five languages: English, French, Russian, Chinese, German; or hold a certificate or recognition of ethnic minority language issued by the competent authority;

đ) Hold a computer skills certificate meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT;

e) Have been appointed to the inspector rank for at least nine years, except in cases where they have held a battalion command position or equivalent position, or technical-professional officers holding an equivalent rank to Senior Inspector transferring to the inspection agency.

Article 7. Criteria for the Senior Inspector Rank

1. Responsibilities

The Senior Inspector is responsible for directly advising the Head of the agency or unit to carry out inspection work and other tasks; they are assigned to lead or coordinate inspections of cases with large scale, very complex circumstances, involving multiple sectors, fields, units both within and outside the Military; when conducting inspections, they must comply with the law, be accountable under the law and to the direct managing Head of the agency or unit regarding the assigned tasks.

2. Tasks

a) Lead in drafting plans, researching, proposing programs of work, organizing the implementation of inspection cases; handling complaints and denunciations; receiving citizens and preventing corruption;

b) Directly implement or organize coordination with agencies and units to collect evidence and files related to inspection cases; handle complaints and denunciations; receive citizens and prevent corruption as assigned;

c) Draft reports on inspection results, conclusions of inspections, clarify each content inspected; determine the nature, level of violation, causes, responsibilities; propose measures to resolve issues to improve management activities for agencies, units, sectors, or localities;

d) Lead or participate in summarizing and evaluating large-scale, complex inspections, wide-ranging inspections as assigned;

đ) Lead or participate in building inspection business procedures; resolving complaints and denunciations; receiving citizens and preventing corruption; providing professional training for inspectors and senior inspectors;

e) During the inspection process, perform duties and exercise powers as stipulated in Articles 47 and 54 of the Inspection Law;

g) Performing other tasks assigned by the head of the inspection agency.

3. Competence

a) Proficient in Party guidelines, policies, state laws, directives, resolutions from superiors, military discipline regulations; have knowledge in state administration in economic, social, cultural, security, defense, and foreign affairs fields;

b) Have deep and broad knowledge in specialized business areas, proficient in inspection business procedures and operations;

c) Understand legal knowledge; domestic and international economic and social situations;

d) Possess scientific research capabilities, comprehensive summaries of wide-ranging topics in assigned fields; capable of assuming responsibility as Head or Deputy Head of inspection teams for large-scale, very complex cases involving multiple sectors and fields;

đ) Lead research and comprehensive summaries of inspection theory; participate in drafting legal documents on inspections; resolving complaints and denunciations; receiving citizens and preventing corruption;

e) Participate in developing programs and compiling specialized materials for training and professional development for inspectors and senior inspectors.

4. Requirements for Qualifications and Other Conditions

a) Graduating from a university degree or higher in a major relevant to the working field;

b) Graduated from advanced operational warfare strategy training at the National Defense Academy;

c) Hold a certificate for professional training in the Senior Inspector rank;

d) Hold a high-level political theory certificate or equivalent;

đ) Hold a foreign language certificate at Level 3 as stipulated in Circular No. 01/2014/TT-BGDĐT or a foreign language certificate at Level C or higher in one of five languages: English, French, Russian, Chinese, German; or hold a certificate or recognition of ethnic minority language proficiency issued by an authorized authority;

e) Hold an information technology certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT;

g) Have been appointed as a senior inspector for at least six years, except in cases where they have held a division commander position or equivalent position, or technical-professional officers holding an equivalent rank to the Senior Inspector who transfer to the inspection agency;

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Effective Date

This Decision takes effect from October 10, 2016.

Article 9. Responsibility for implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Councils, Heads of agencies and units, and relevant individuals are responsible for implementing this Decision./
