Based on Decree No. 12/2017/NĐ-CP dated 10Article 1. Article 1. Scope of Regulation

This Circular applies to pedestrians; persons operating: non-motorized vehicles, motorized vehicles, special-purpose motorcycles, and similar types of vehicles; units providing ferry service on national highway routes funded by state budget capital, managed by the Central Government, and relevant organizations and individuals.

Article 2. Applicability

Article 3. Framework for the Price of Ferry Service

1. The framework for the price of ferry service, as set out in Tables 01 to 09 of the Appendix attached hereto, is the framework price issued for each ferry station on national highway routes.

2. The price of ferry service prescribed in Clause 1, Article 3 of this Circular includes value-added tax.

Article 4. Objects Exempt from Ferry Service Fees

1. Ambulances, including other types of vehicles transporting accident victims to emergency locations;

2. Fire trucks;

3. Agricultural and forestry machinery, including: tractors, plows, harrows, weeders, rice threshers;

4. Flood control vehicles; emergency vehicles for flood and storm prevention;

5. Special-purpose vehicles serving national defense and security, including: tanks, armored vehicles, artillery tractors, vehicles carrying armed forces on maneuvers;

6. Funeral vehicles;

7. Vehicle convoys with escort vehicles;

8. Vehicles transporting medicines, machinery, equipment, supplies, and goods to disaster-stricken areas or epidemic zones;

9. War invalids, disabled veterans, students, children under ten years old (including those riding bicycles). When using ferry services in these cases, they must present necessary documents (original or certified copies) such as: war invalid certificates, veteran certificates, or certificates issued by the school for students.

Article 5. Ferry Service Fee Tickets

1. The printing, issuance, management, and use of ferry service fee tickets shall comply with current laws governing invoice management.

a) Single-use ticket: a ticket valid for one-time use of ferry service by a person required to pay the ferry service fee.

2. Ferry service fee tickets at ferry terminals include two types: single-trip tickets and monthly tickets.

b) Monthly ticket: a ticket valid for multiple uses of ferry service within thirty days, from the date of sale specified on the ticket to the end date specified on the ticket. The monthly ticket only applies to objects with specified monthly ticket fees as set out in the Appendix attached hereto.

For pedestrians, their full name and identity card number (or citizen identification card number) must be clearly stated on the ticket. For objects without license plates as prescribed, the type of vehicle and the full name, identity card number (or citizen identification card number) of the driver must be clearly stated on the ticket. For objects with prescribed license plates, the type of vehicle and its license plate number must be clearly stated on the ticket.

3. A ticket purchased for a specific object required to pay the ferry service fee at a particular ferry station is only valid for that object at the ferry station where the ticket was purchased.

3. Ticket purchased for a subject who must pay for service using a ferry wharf shall only be valid for use by that subject at the ferry wharf where the ticket was sold.

Article 6. Responsibilities of units entrusted with providing ferry service

1. Units managing and supplying ferry services shall decide on specific rates for ferry service usage fees based on the provisions set forth in Clause 1, Article 3 of this Circular; organize the collection of ferry service usage fees in accordance with regulations, establish measures to prevent fraud and revenue loss, and impose strict penalties on individuals who violate these rules.

2. Publicly disclose and post information about the prices of ferry service usage fees in accordance with laws governing pricing.

3. For new ferry terminals that have been incorporated into national highways following the adjustment decision of the Ministry of Finance, units entrusted with managing and supplying ferry services may continue to apply existing standards and rates until new regulations are issued.

4. For the Kênh Tắt and Láng Sắt ferry terminals on National Highway 53, the collection of ferry service usage fees has not yet commenced temporarily.

Article 7. Responsibilities of the Vietnam Road Administration

1. For newly constructed ferry terminals, three months prior to their operation, the Vietnam Road Administration must establish vehicle standards, economic-technical standards, and a framework for ferry service usage fee rates to be submitted to the Ministry of Transport for issuance as a basis for implementation.

2. Within six months from the date of receiving local ferry terminals transferred to the management of the Ministry of Transport according to the decision of the Ministry of Finance, the Vietnam Road Administration must establish vehicle standards, economic-technical standards, and a framework for ferry service usage fee rates to be submitted to the Ministry of Transport for issuance as a basis for implementation.

Article 8. Implementation organization

1. This Circular takes effect from February 1, 2021, and replaces Circular No. 34/2016/TT-BGTVT dated November 15, 2016, issued by the Ministry of Transport, which stipulates the framework for prices of ferry services on national highways funded by state budget sources and managed centrally.

2. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments, the Director of the Vietnam Road Administration, and the Heads of related agencies and organizations are responsible for implementing this Circular.
