Guidelines for the price of public service activities related to coastal information services

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

Pursuant to Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

Pursuant to Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, ordering, or tendering for the provision of products and public services using state budget funds from regular funding sources;

Pursuant to Decree No. 43/2018/NĐ-CP dated March 12, 2018 of the Government on management, use, and exploitation of marine infrastructure assets;

At the request of the Director of the Department of Finance and the Director of the Vietnam Maritime Administration;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular applies to agencies, organizations, and enterprises involved in providing public service activities related to coastal information services funded by state budget from regular funding sources, implemented through ordering.

Article 2. Applicability

This Circular applies to agencies, organizations, and enterprises involved in providing public service activities related to coastal information services funded by state budget from regular funding sources, implemented through ordering.

Article 3. Principles for Determining Prices

1. The price of public service activities related to coastal information services shall be determined to ensure compensation for actual reasonable and legitimate costs, with appropriate profit to complete a unit volume of public service activities related to coastal information services in a year based on economic and technical norms issued by competent authorities and other relevant regulations.

2. Costs already guaranteed by the state budget shall not be included in the price; costs already determined in other services shall not be counted.

For common costs and costs related to multiple services that cannot be separated, they need to be aggregated and allocated according to appropriate criteria consistent with relevant laws.

Chapter II

PRICE OF PUBLIC SERVICE ACTIVITIES RELATED TO COASTAL INFORMATION SERVICES

Article 4. Structure and Method of Determining the Price of Public Service Activities Related to Coastal Information Services

The structure and method of determining the price of public service activities related to coastal information services shall be carried out in accordance with the annex attached to this Circular.

Article 5. Competence, Time Limit, Procedure for Review and Decision on Price

Competence, time limit, procedure for review and decision on price shall be carried out in accordance with the provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices. Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices.

Chapter III

IMPLEMENTATION

Article 6. Effectiveness

1. This Circular takes effect from February 15, 2023 and applies from the fiscal year 2023.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the provisions of the amended, supplemented, or replacing legal normative documents.

Article 7. Implementation Organization

The Director of the Office, the Inspector General, the Heads of Departments, the Heads of Bureaus, the Heads of agencies, organizations, and individuals related thereto are responsible for implementing this Circular./.
