CIRCULAR

OF THE MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS

Guidelines for implementing the system of salary left for family members for state cadres, workers, and armed forces personnel working, studying, or training abroad

Implementing Article 6 of Decision No. 574/TTg dated November 25, 1993 of the Prime Minister on supplementing certain systems for civil servants, administrative and public service officials, armed forces personnel, and social policy beneficiaries, the Ministry of Labor, Invalids, and Social Affairs provides guidelines for implementing the system of salary left for family members for state cadres, workers, and armed forces personnel working, studying, or training abroad as follows:

v1. Subjects eligible for the salary left for family members system

State cadres, workers, and employees (including those from the Party and mass organizations) and armed forces personnel working at Vietnam's representative offices abroad (diplomatic, permanent, military attaché, press, radio and television, news agency, labor management...).

I. OBJECTS

Workers and staff working at international organizations who receive living expenses in foreign currency subsidized by the State.

State cadres, workers, and employees (including those from the Party and mass organizations) and armed forces personnel sent to study, intern, or as research fellows abroad.

2. Subjects not eligible for the salary left for family members system

State cadres, workers, and employees and other workers temporarily working abroad under Decree No. 370/HĐBT dated November 9, 1991.

State cadres, workers, and staff and armed forces personnel working as experts, consultants, or in other capacities abroad, receiving salaries funded by foreign countries or international organizations.

State cadres, workers, and employees going abroad for studies, internships, or as research fellows beyond the prescribed period without permission from competent authorities, or going abroad according to personal wishes and self-funding all expenses.

State cadres, workers, and employees permitted by the State to visit relatives or handle personal matters abroad.

II. SALARY LEFT FOR FAMILY MEMBERS

The subjects mentioned in Point 1, Section 1 above shall leave 40% of their salary based on their rank and grade in the salary scale and wage table stipulated in Decrees No. 25/CP and 26/CP, and the retention differential coefficient (if applicable) pursuant to Circular No. 25/LB-TT dated September 13, 1993 of the Joint Ministry of Labor, Invalids, and Social Affairs - Organizational and Cadre Department of the Government - Finance (excluding allowances).

Example: A department head earning a professional salary with a coefficient of 3.91, with a monthly salary of 262,000 VND from April 1, 1993, going on long-term work abroad, will have a monthly salary left for family members of 262,000 VND x 40% = 104,800 VND/month.

State cadres, workers, and staff, and armed forces personnel receiving salaries where they are assigned to work shall have their salaries left for family members calculated and paid there.

This circular takes effect from April 1, 1993. Any previous regulations contrary to this circular are abolished.

III. IMPLEMENTATION PROVISIONS

During implementation, if there are any issues, please report them to the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution./.
