JOINT CIRCULAR
Issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Finance under Decision No. 31/TTLB dated November 13, 1995 guiding the transfer of funds for payment of preferential allowances to persons who have rendered meritorious service to the revolution to the Vietnam Social Security

Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;
Pursuant to the Prime Minister's Decision No. 425/TTg dated July 26, 1995 on entrusting the Vietnam Social Security with the task of paying social disability allowances and preferential allowances to persons who have rendered meritorious service;
The Joint Ministries of Labor, War Invalids and Social Affairs and Finance guide the transfer of funds for payment of preferential allowances to persons who have rendered meritorious service to the revolution to the Vietnam Social Security as follows:
I. TYPES OF ALLOWANCES TO BE TRANSFERRED FOR PAYMENT BY THE SOCIAL SECURITY BRANCHES AT THE PROVINCE LEVEL:
The funds from the Ministry of Labor, War Invalids and Social Affairs transferred to the Vietnam Social Security for payment pursuant to Decision No. 425/TTg dated July 26, 1995 include regular allowances, one-time allowances, and supplementary payments for the following categories:
1- Persons who were active in the revolutionary movement before August 1945;
2- Martyrs and their families;
3- Heroes of the Armed Forces, Labor Heroes, Mothers of Vietnam Heroic Sons;
4- Disabled veterans, war invalids, and persons receiving benefits equivalent to disabled veterans;
5- Persons who participated in the revolutionary movement and anti-Japanese resistance and were captured and detained by the enemy;
6- Persons who participated in national liberation, national defense, and international duty;
7- Persons who assisted the revolutionary movement;
II. RESPONSIBILITIES OF THE PARTIES TRANSFERRING AND RECEIVING FUNDS:
1- Responsibilities of the transferring party:
a) The Ministry of Labor, War Invalids and Social Affairs shall be responsible for:
- After officially approving the social security budget by the State and coordinating with the Ministry of Finance to allocate and notify the approved plan to the provinces and centrally-administered cities;
- Annually and quarterly, notifying the Vietnam Social Security of the funding plan for allowance payments to the recipients in the 53 provinces and centrally-administered cities nationwide;
- Establishing forms and procedures related to allowance disbursement as a basis for settling allowance payments between the Vietnam Social Security and the relevant departments under the Ministry of Labor, War Invalids and Social Affairs;
- Inspecting the organization of allowance disbursement, settlement, and finalization of payments made by the Vietnam Social Security;
b) Provincial Departments of Labor, War Invalids and Social Affairs shall be responsible for:
- Annually and quarterly, notifying the provincial Vietnam Social Security of the funding plan for allowance payments to the recipients within the province according to each district;
- Reviewing and signing decisions for individuals entitled to allowances (including cases of increase or decrease) to transfer to the District Departments of Labor, War Invalids and Social Affairs for implementation;
- Inspecting the organization of allowance disbursement, payment fees, and settlement of allowance payments assigned to the district Vietnam Social Security;
- Maintaining files of recipients in accordance with regulations of the Ministry of Labor, War Invalids and Social Affairs;
c) District Departments of Labor, War Invalids and Social Affairs shall be responsible for:
- Annually and quarterly, transferring the allowance disbursement funding plan to the district Vietnam Social Security based on notifications from the provincial Department of Labor, War Invalids and Social Affairs;
- In January each year, compiling a formal list of recipients and amounts payable from February to December, and compiling a supplementary list of increases and decreases in recipients and amounts to be sent to the district Vietnam Social Security for payment to eligible recipients;
- Timely transferring full funding to the district Vietnam Social Security based on the aforementioned payment lists;
- Inspecting the implementation of allowance disbursement, payment fees, and settlement of allowance payments assigned to the district Vietnam Social Security;
- Maintaining files and original documents used for settlement of allowance disbursement funding for recipients;
2- Responsibilities of the receiving party:
a) The Vietnam Social Security shall be responsible for:
- Annually and quarterly, notifying the provincial Vietnam Social Security of the allowance payment plans and payment fees according to the notifications from the Ministry of Labor, War Invalids and Social Affairs to the provincial Departments of Labor, War Invalids and Social Affairs;
- Organizing payment mechanisms or delegating to the provincial Vietnam Social Security, guiding the district Vietnam Social Security to organize payments to recipients based on funding from the district Departments of Labor, War Invalids and Social Affairs to the district Vietnam Social Security;
- Establishing forms and procedures for receiving funding, organizing payments, and settling monthly allowance payments implemented by the district Vietnam Social Security;
- Allocating and notifying the district Vietnam Social Security of the payment fees for allowances received within the total fee rate of 0.25% as prescribed by the Government and after coordination with the Joint Ministries of Labor, War Invalids and Social Affairs and Finance;
b) Provincial Vietnam Social Security shall be responsible for:
- Guiding the district Vietnam Social Security to prepare reports on payment contents and settlement according to the tasks assigned by the Vietnam Social Security to the provincial Vietnam Social Security;
- Guiding the establishment of books and procedures for payments and settlement of funds received from the district Departments of Labor, War Invalids and Social Affairs;
- Quarterly, notifying the district Vietnam Social Security of the payment fees received;
- Supervising the district Vietnam Social Security to comply with regulations on managing funds received from the district Departments of Labor, War Invalids and Social Affairs;
c) District Vietnam Social Security shall be responsible for:
- Receiving recipient lists in January each year; from February to December, receiving supplementary lists of increases and decreases (persons - amounts) from the district Departments of Labor, War Invalids and Social Affairs to ensure timely payment to eligible recipients;
- Monthly, directly settling actual payment expenses and payment fees received with the district Departments of Labor, War Invalids and Social Affairs based on the recipient lists received (accompanied by monthly allowance collection receipts, one-time allowance notification letters signed by the recipients), and lists of recipients who have not received payments;
- Compensating for any allowances and payment fees paid incorrectly according to established regulations and procedures;
- Maintaining files and original documents used for settlement of allowance disbursement funding for recipients.
III. IMPLEMENTATION PROVISIONS:
1- The payment of allowances carried out by the Social Insurance Office at the district level must be conducted concurrently with the payment of pensions and other social insurance benefits;
2- For beneficiaries who have been entitled to allowances since September 30, 1995 or earlier, if they have not yet received their allowances, including monthly allowances and one-time allowances, and have already received claim forms or one-time claim notices, the Social Insurance Office at the district level shall pay them and establish a list according to the guidelines of the Ministry of Labor, War Invalids and Social Affairs;
3- The Department of Labor, War Invalids and Social Affairs and the Department of Finance and Prices shall be responsible for guiding the inspection and supervision of the organization of payments in accordance with the provisions of this Circular;This Circular takes effect from January 1, 1995. All previous regulations that conflict with this Circular are hereby abolished.DEPUTY MINISTER OF LABOR
