DECREE
AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE DECREE NO. 71/2020/NĐ-CP OF JUNE 30, 2020 OF THE GOVERNMENT ON THE IMPLEMENTATION PLAN FOR RAISING THE TRAINING STANDARDS OF EARLY CHILDHOOD EDUCATORS, PRIMARY SCHOOL TEACHERS, AND LOWER SECONDARY SCHOOL TEACHERS
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Based on the Education Law number 43/2019/QH14;
Pursuant to the State Budget Law No. 89/2025/QH15; the Law Amending and Supplementing Certain Provisions of the Securities Law, Accounting Law, Independent Auditing Law, State Budget Law, Management and Use of Public Assets Law, Tax Administration Law, Personal Income Tax Law, National Reserve Law, Administrative Violation Handling Law No. 56/2024/QH15;
At the proposal of the Minister of Education and Training;
The Government promulgates this Decree amending and supplementing certain provisions of the Decree No. 71/2020/NĐ-CP of June 30, 2020 of the Government on the implementation plan for raising the training standards of early childhood educators, primary school teachers, and lower secondary school teachers.
Article 1. Amending and supplementing certain provisions of the Decree No. 71/2020/NĐ-CP of June 30, 2020 of the Government on the implementation plan for raising the training standards of early childhood educators, primary school teachers, and lower secondary school teachers
1. Amending and supplementing Article 7 as follows:
"Article 7. Methods for implementing the training to raise the standard qualifications of teachers
1. Assigning tasks or placing orders: Localities assign tasks or place orders with training institutions to implement the training to raise the standard qualifications of teachers according to the approved plan. The assignment of tasks or placement of orders for training to raise the standard qualifications of teachers shall be carried out in accordance with current regulations on assigning tasks and placing orders for public goods and services funded from regular state budget expenditures.
2. For fields or specialties that do not meet the conditions to open training classes under the method prescribed in Clause 1 of this Article, teachers shall proactively register for admission with public training institutions in accordance with the enrollment regulations issued by the Ministry of Education and Training."
2. Amend and supplement Article 8 as follows:
"Article 8. Implementation Plan for the Gradual Increase in Standard Qualifications Training of Teachers
1. Five-year plan for the period 2026-2030 according to Model 1 attached to this Decree
a) Planning unit: Ministry of Education and Training;
b) Receiving unit: People's Committee of the province;
c) Basis for planning: The number of early childhood educators, primary school teachers, and lower secondary school teachers who need to raise their standard qualifications at the time of planning; the targets set forth in Articles 4, 5, and 6 of this Decree;
d) Deadline for issuing the plan: The five-year plan for the period 2026-2030 must be issued before December 31, 2025;
đ) Method of submitting the plan: The plan must be submitted in electronic form in compliance with the law and sent to the receiving unit through the electronic document management system.
2. Annual implementation plan for gradually increasing the standard qualifications training of early childhood educators, primary school teachers, and lower secondary school teachers (hereinafter referred to as the annual implementation plan) according to Model 2 attached to this Decree
a) Planning unit: People's Committee of the province;
b) Receiving unit: Ministry of Education and Training; early childhood education institutions, general education institutions where teachers have registered for training to raise their standard qualifications; training institutions assigned tasks or placed orders and related units;
c) Basis for planning: The demand for training to raise the standard qualifications of educational institutions; the targets set forth in Articles 4, 5, and 6 of this Decree;
d) Deadline for issuing the plan: Before December 15 of the year preceding the year of implementation;
đ) Method of submitting the plan: The plan must be submitted in electronic form in compliance with the law and sent to the receiving unit through the electronic document management system."
3. Amend and supplement Article 9 as follows:
"Article 9. Funding for the gradual increase in standard qualifications training of teachers
1. Funding for the gradual increase in standard qualifications training of teachers (public, private, and privately-run) shall be guaranteed by local budgets in accordance with the State Budget Law and other sources of funding as provided by law.
2. The preparation, allocation, assignment, execution, and settlement of funding shall be carried out in accordance with current regulations on assigning tasks and placing orders for public goods and services funded from regular state budget expenditures and relevant laws.
3. In cases where teachers are dispatched for training to raise their standard qualifications as stipulated in Clause 2 of Article 7 of this Decree, the educational institution where the teacher works shall be responsible for preparing the budget estimate, submitting it to the competent authority for approval in accordance with the State Budget Law, and paying the training fees to the teacher based on the tuition fee invoice or legitimate receipt issued by the training institution upon graduation.
4. Private and privately-run educational institutions shall ensure funding to pay teachers' salaries and benefits as stipulated in Point d, Clause 1 of Article 10 of this Decree when they are dispatched for training to raise their standard qualifications."
4. Amend and supplement Clause 1 of Article 10 as follows:
"1. Rights of teachers participating in training to raise their standard qualifications:
a) To be supported by management and user entities to participate in such training;
b) To have tuition fees paid at the level of tuition charged by the training institution where the teacher studies;
c) To have the training period counted towards continuous service time;
d) To receive 100% salary and benefits as prescribed by law."
5. Amend and supplement Article 12 as follows:
"Article 12. Reporting System
1. Report on the results and demand for training to raise the standard qualifications of educational institutions according to Model 3 attached to this Decree.
a) Reporting unit: Early childhood education institutions, general education institutions where teachers participate in training to raise their standard qualifications;
b) Receiving unit: Competent authority directly managing the educational institution according to the division of responsibilities;
c) Deadline for finalizing report data: From November 1 of the year preceding the reporting year to October 31 of the reporting year;
d) Deadline for submitting the report: Before November 5 of the reporting year;
đ) Method of submitting the report: The report must be submitted in electronic form in compliance with the law and sent to the receiving unit through the electronic document management system.
2. Report on training results and training needs to upgrade standard qualifications of the directly managing authority of educational institutions according to分级授权, using Model No. 4 issued together with this Decree.
a) Reporting unit: The directly managing authority of educational institutions according to分级授权;
b) Unit receiving the report: Department of Education and Training;
c) Deadline for finalizing report data: From November 1 of the year preceding the reporting year to October 31 of the reporting year;
d) Deadline for submitting the report: Before November 15 of the reporting year;
đ) Method of submitting the report: The report must be submitted in electronic form in compliance with the law and sent to the receiving unit through the electronic document management system.
3. Report on training results and training needs to upgrade standard qualifications of provincial People's Committees using Model No. 5 issued together with this Decree.
a) Reporting unit: Provincial People's Committee reports. The Department of Education and Training compiles the report on training results and training needs to upgrade standard qualifications according to Clause 1 and Clause 2 of this Article and submits it for signature and issuance by the Provincial People's Committee;
b) Unit receiving the report: Ministry of Education and Training;
c) Deadline for finalizing report data: From November 1 of the year preceding the reporting year to October 31 of the reporting year;
d) Deadline for submitting the report: Before December 15 of the reporting year;
đ) Method of submitting the report: The report must be submitted in electronic form in compliance with the law and sent to the receiving unit through the electronic document management system.
4. The report stipulated in Clause 3 of this Article serves as the basis for provincial People's Committees to develop annual implementation plans.
5. In addition to the reporting system prescribed in Clauses 1, 2, and 3 of this Article, state management agencies in education, and educational institutions shall submit reports on the training to upgrade standard qualifications of kindergarten, primary, and junior high school teachers as required by authorized agencies in accordance with the legal provisions on the reporting system.
6. Amend and supplement Clause 5 of Article 15 as follows:
“5. Direct the Department of Education and Training and related agencies to review and compile a list of teachers who must upgrade their standard qualifications; determine the time for teachers to participate in training; arrange and schedule teaching duties and programs, timetables appropriately so that teachers can work while studying; develop annual plans; allocate funds; organize mid-term and final reviews, evaluate the results, and draw lessons from this work.
Based on the local budget balance capacity, propose policies to support the implementation of the roadmap for upgrading standard qualifications of private and public kindergarten, primary, and junior high school teachers to be approved by the Provincial People's Council.”
7. Supplement Clause 4 after Clause 3 of Article 16 as follows:
“4. Provide legal invoices and documents to serve payment and settlement of training costs as prescribed.”
8. Amend and supplement Clause 1 of Article 17 as follows:
“1. Fully implement the reporting system as prescribed.”
Article 2. Supplement appendices and abolish the phrase "or bidding"
1. Supplement appendices issued together with Decree No. 71/2020/NĐ-CP including the following models:
a) Model No. 1: Five-year plan for the period 2026-2030;
b) Model No. 2: Annual implementation plan for upgrading standard qualifications of kindergarten, primary, and junior high school teachers;
c) Model No. 3: Report on training results and training needs to upgrade standard qualifications of educational institutions;
d) Model No. 4: Report on training results and training needs to upgrade standard qualifications of the directly managing authority of educational institutions according to分级授权;
đ) Model No. 5: Report on training results and training needs to upgrade standard qualifications of provincial People's Committees.
2. Abolish the phrase "or bidding" at point b Clause 2 Article 1; Article 7; Article 9; Clause 4 Article 15; Clause 2 Article 16 of Decree No. 71/2020/NĐ-CP.
Article 3. Implementation Provisions
1. This Decree takes effect from January 20, 2026.
2. Kindergarten, primary, and junior high school teachers who are required to upgrade their standard qualifications and have obtained graduation certificates meeting the requirements of the standard qualifications of the current grade they teach since July 1, 2020 but have not been reimbursed for training fees by the relevant agencies or units shall be entitled to claim reimbursement for training fees.
a) The amount claimed and reimbursed shall be equal to the tuition fee charged by the training institution at the time the teacher enrolled. This amount does not include retake and repeat course fees.
For kindergarten teachers as stipulated in this clause, if they upgrade their standard qualifications from college to bachelor's degree in Early Childhood Education, the provincial People's Committee shall advise the Provincial People's Council to decide the amount to be claimed, which shall not be less than the tuition fee for upgrading from college to associate degree;
b) The source of funding shall be implemented according to Clause 1 Article 9 of Decree No. 71/2020/NĐ-CP, which has been amended and supplemented by this Decree;
c) The documents for settling training costs include a payment request form, invoice or receipt of tuition fee from the training institution, certified copies of graduation certificates, and other supporting documents (if any) as prescribed by the law on cost settlement. If there is no invoice or receipt of tuition fee, a notification of the tuition fee charged by the training institution and confirmation by the training institution regarding the amount collected must be provided;
d) The settlement of training costs for teachers as stipulated in this clause shall be completed before December 31, 2027.
3. During the period of implementing the roadmap for upgrading standard qualifications, kindergarten teachers who have not yet met the standard qualifications prescribed in point a Clause 1 Article 72 of the Education Law No. 43/2019/QH14 and have labor contracts with the legal representatives of privately-run or public kindergartens established and operating in accordance with regulations in areas with industrial zones, directly caring for and educating children in groups or classes where at least 30% of the children are workers' or employees' children working in industrial zones, shall enjoy the policy as prescribed in Article 10 of Government Decree No. 105/2020/NĐ-CP dated September 8, 2020 on policies for developing kindergarten education.
4. For localities that have signed contracts with training institutions to upgrade teachers' qualifications through bidding, they may continue to implement according to the signed contracts.
5. The five-year plan for the period 2020-2025 already issued according to Decree No. 71/2020/NĐ-CP shall continue to be implemented until December 31, 2025.
6. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, Heads of management agencies, teacher training institutions, and units employing teachers are responsible for enforcing this Decree.
