Establishment of the Road Motor Vehicle Inspection Center
THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government, stipulating the tasks, authorities, responsibilities for state management and organizational structure of the Ministry of Transport;
Pursuant to the requirements and tasks of implementing Decree No. 36/CP dated May 29, 1995 of the Government on ensuring traffic order and safety on roads and urban traffic order;
Following Decision No. 1546/QD-TCCB-LD dated September 23, 1994 of the Minister of Transport on supplementing tasks for the Vietnam Motor Vehicle Inspection Agency and Directive No. 75/PC dated April 12, 1995 of the Minister of Transport on entrusting the Vietnam Motor Vehicle Inspection Agency with the responsibility to organize the administrative apparatus to manage the entire process of technical quality inspection of all types of road motor vehicles;
Considering the proposal of the Director of the Personnel and Labor Department;
DECISION:
Article 1
Establish the "Road Motor Vehicle Inspection Center" under the Vietnam Motor Vehicle Inspection Agency; to organize and implement uniformly throughout the country the inspection and supervision of the technical quality and safety of all types of road motor vehicles according to standards and procedures prescribed by the Ministry of Transport.
The Road Motor Vehicle Inspection Center has the international trade name:
"Vietnam Auto Register". Abbreviated as "VAR".
Article 2
The Road Motor Vehicle Inspection Center shall have the following main tasks and authorities:
2.1. Study the current status of road motor vehicles to propose planning the system and network organization of Road Motor Vehicle Inspection Stations nationwide, with five-year and annual plans: for investment in material and technical infrastructure and training human resources.
2.2. Apply and propose to the competent authority national and international standards and regulations in vehicle technical inspection work that have been issued by the State and the Ministry of Transport. Define procedures and formats for the technical inspection of road motor vehicles at inspection facilities.
2.3. Organize technical training, application of new technologies, and management skills for the staff of the Center to be capable of fulfilling their tasks. Direct technical and operational inspection, supervision of technical quality and safety, and management of necessary inspection and appraisal equipment to ensure the integration, analysis, exploitation, and storage of information related to the technical inspection content of vehicles at stations within the national inspection network.
2.4. Report periodically on the inspection and supervision of the technical quality and safety of road motor vehicles within the scope, objectives, and tasks as prescribed.
2.5. Collect fees for vehicle technical inspections according to the provisions of the State. Organize centralized accounting, preserve and develop the material and technical infrastructure under its management. Inspect compliance with the operation rules of the stations.
2.6. Provide quality documentation of inspected vehicles to the competent authority.
Article 3
3.1. The Center is a public service organization, entitled to use its own seal, open bank accounts, and operate self-financing accounting according to State regulations, and cooperate and link with foreign vehicle inspection organizations to transfer technology, equipment, materials, and train personnel, etc., to ensure the completion of assigned tasks. The Center's headquarters is located in Hanoi.
3.2. The Center is led by a director, assisted by several deputy directors; the director is appointed by the Minister of Transport upon the recommendation of the Director of the Vietnam Motor Vehicle Inspection Agency. Deputy directors and the management staff of the Center are decided by the Director of the Vietnam Motor Vehicle Inspection Agency upon the recommendation of the Center's director.
3.3. Road Motor Vehicle Inspection Stations (hereinafter referred to as automobile inspection stations), initially include model standard stations directly established by the Vietnam Motor Vehicle Inspection Agency in Hanoi, Haiphong, Viet Tri, Da Nang, Ho Chi Minh City, Can Tho, under the Center, tasked with inspecting the technical condition and issuing safety certificates for various types of road motor vehicles in their respective areas.
In addition, there are automobile inspection stations belonging to the Departments of Transport, Public Works and Transportation, and specialized transportation organizations. These stations are reviewed and licensed by the Vietnam Motor Vehicle Inspection Agency to operate, perform their tasks, and comply with the supervision and guidance of the Center, forming a national network of automobile inspection stations.
The stations are located in areas according to the organizational plan of the inspection network across the country approved by the Ministry.
3.4. The station is an accounting entity, entitled to use business seals and stamps, and open accounts according to regulations.
3.5. The establishment and dissolution of Road Motor Vehicle Inspection Stations directly under the VAR Center are decided by the Director of the Vietnam Motor Vehicle Inspection Agency upon the recommendation of the Director of the Road Motor Vehicle Inspection Center. The establishment and dissolution of other inspection stations (belonging to public institutions) are carried out according to the technical inspection regulations of the Ministry.
3.6. The Director of the Vietnam Motor Vehicle Inspection Agency shall establish specific organizational and operational regulations for Road Motor Vehicle Inspection Stations, ensuring centralized and unified management principles in accordance with Decree No. 36/CP dated May 29, 1995 of the Government, consistent with the country's reformed economy and international practices.
Article 4
The Director of the Vietnam Motor Vehicle Inspection Agency and the Director of the Road Motor Vehicle Inspection Center are responsible before the law and the Minister of Transport for ensuring honesty and accuracy when issuing Safety Technical Certificates for road motor vehicles.
The Vietnam Motor Vehicle Inspection Agency shall develop systems, procedures, regulations for technical quality and safety inspection, forms, documents, stamps, badges, etc., related to assigned tasks to submit to the Minister of Transport for review and issuance.
Article 5
This Decision takes effect from the date of issuance. Previous documents contrary to this Decision are abolished.
Article 6
The Directors of the Vietnam Vehicle Inspection Agency, the Directors of the Vietnam Road Administration Agency, the Heads of relevant Departments, the Directors of Provincial Transportation Departments (or Departments of Public Works and Transport), organizations, units, citizens, and foreign individuals using motor vehicles on the territory of Vietnam shall be responsible for implementing this Decision./.
