Pursuant to the Customs Law dated June 29, 2001;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 96/2002/NĐ-CP dated November 19, 2002 of the Government on the functions, tasks, powers, and organizational structure of the General Department of Customs;

DECISION:
Article 1. The Export and Import Goods Analysis and Classification Center in the North, the Export and Import Goods Analysis and Classification Center in the Central region, and the Export and Import Goods Analysis and Classification Center in the South (hereinafter referred to collectively as the Centers) are public service units under the General Department of Customs, with the function of conducting analysis and classification of export and import goods as a basis for determining the name and code of export and import goods, serving as a basis for inspection and customs management and tax collection on export and import duties and other taxes as prescribed by law.
Article 2. The Export and Import Goods Analysis and Classification Center in the North is located in Hanoi City; it is responsible for conducting analysis and classification of goods according to the requirements of customs units in the northern region (from Quang Binh Province northward).
The Export and Import Goods Analysis and Classification Center in the Central region is located in Da Nang City; it is responsible for conducting analysis and classification of goods according to the requirements of customs units in the central region (from Quang Tri Province to Khanh Hoa Province and the Central Highlands).
The Export and Import Goods Analysis and Classification Center in the South is located in Ho Chi Minh City; it is responsible for conducting analysis and classification of goods according to the requirements of customs units in the southern region (from Ninh Thuan and Binh Thuan Provinces southward).
Article 3. The Center has the following tasks and powers:
1/ To take the lead or participate in drafting regulatory documents, rules, and procedures related to the analysis and classification of export and import goods, as assigned by the General Department of Customs Director (hereinafter referred to as the Director).
2/ To draft and submit to the Director programs and plans for developing the analysis and classification activities of the Center, and to organize their implementation upon approval.
3/ To implement the analysis and classification of export and import goods according to the requirements of customs units and pre-import analysis and classification requirements stipulated in the Export and Import Goods Analysis and Classification Regulations issued by the Director.
4/ To participate in researching and building scientific bases for determining and modifying codes for goods listed in the export and import goods catalog and export and import tariff schedules; to participate in researching and building codes for new goods, goods difficult to determine codes, or not detailed enough.
5/ To establish and manage a sample library of export and import goods at the Center.
6/ To independently conduct or coordinate with agencies and units inside and outside the sector to perform analysis and classification; to research and apply scientific and technological advancements in analysis and classification activities; to train and enhance the skills of customs officials performing analysis and classification tasks at the Center and for the team of customs officials inspecting export and import goods at customs units within the jurisdiction.
7/ To carry out international cooperation in export and import goods analysis and classification activities as assigned by the Director.
8/ To compile and report on the situation and results of analysis and classification tasks as prescribed by the Director.

Article 4. The Center has a Director and several Deputy Directors.
The Center Director is responsible to the Director General for all activities of the Center; the Deputy Center Director is responsible to the Center Director for the assigned tasks.
The appointment of the Center Director and Deputy Directors is decided by the Director General of the General Department of Customs.
Article 5. The Analysis and Classification Center has an Administrative and Financial Affairs Department. Other specialized fields operate under a specialist system.
The duties of the Administrative and Financial Affairs Department are defined by the Center Director.
The staffing of the Analysis and Classification Center is determined by the Director General.
Article 6. The Centers have legal personality, seals, and accounts to perform their assigned tasks and authorities as prescribed by law.
Operating funds for the Centers are provided from the budget of the General Department of Customs. The Centers are responsible for preparing budgets and submitting them to the Director General of the General Department of Customs for consolidation into the overall budget of the General Department.
Article 7. This Decision shall take effect from the date of signing.
Article 8. The Director General of the General Department of Customs, the Directors of the Analysis and Classification Centers, the Heads of the Organization and Cadre Training Department, the Heads of the Financial Management Department, and the Chief of the Ministry of Finance's Office are responsible for implementing this decision./.
