Regulations on functions, tasks, powers, and organizational structure

Pursuant to the Plant Protection and Quarantine Law 2001;

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 88/2003/QD-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Plant Protection Department;

Considering the proposal of the Director of the Plant Protection Department and the Director of the Cadre and Civil Servant Affairs Department,

 

DECISION:

Article 1. Position and Functions

The Central Plant Protection Center of the Central Region is a plant protection public service unit under the Plant Protection Department, having legal personality, its own seal, operational funds, and bank accounts as prescribed by law. The scope of activities of the Center includes Da Nang City, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Dak Lak, Gia Lai, and Kon Tum provinces. The headquarters of the Center is located in Quang Ngai Town, Quang Ngai Province.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

Assist the Director General of the Plant Protection Department in implementing plant protection work in the provinces within the region's jurisdiction.

1. Monitor, compile, forecast, and report on the situation and development trends of harmful and beneficial organisms affecting plant resources to the Plant Protection Department and the provinces within the region.

2. Participate in directing the prevention and control of harmful organisms affecting plant resources; verify and compile pest situations within the region to report to the Department.

3. Train and enhance the professional skills of plant protection officers in the provinces within the region.

4. Implement agricultural extension programs on plant protection according to the assignment of the Director General:

4.1. Train and enhance instructors for integrated pest management and agricultural extension methods for plant protection.

4.2. Develop, transfer, and promote models demonstrating the application of science and technology in plant protection.

5. Participate in developing standards, procedures, and implementing research projects and experimental surveys on plant protection.

6. Cultivate beneficial organisms and biological products used in plant protection.

7. Identify and classify harmful and beneficial organisms affecting plant resources.

8. Monitor and propose the establishment and consolidation of grassroots plant protection organizational networks in accordance with the provisions of the law.

9. Provide plant protection services.

10. Participate in international cooperation programs on plant protection.

11. Manage personnel, finance, assets, and other resources assigned by the Department.

12. Perform other tasks assigned by the Director General of the Plant Protection Department.

Article 3. Organizational Structure

1. Leadership of the Center:

The leadership of the Center consists of a Director and Deputy Directors appointed by the Director General of the Plant Protection Department in accordance with regulations.

The Director oversees the operations of the Center, is responsible before the Director General and the law for the Center’s activities and assigned tasks.

The Deputy Directors assist the Director, are responsible before the Director and the law for the implementation of assigned tasks. The number of Deputy Directors shall not exceed two persons.

2. Staff supporting the Director of the Center:

a) Administrative General Department;

b) Technical Department;

c) Forecasting and Transfer Department. The Director General of the Plant Protection Department shall prescribe the operating regulations of the unit.

Article 4. Effective date

This Decision takes effect fifteen days from the date of publication in the Official Gazette of the Government.

This Decision replaces Decision No. 70/NN-TCCB/QĐ dated February 7, 1994, issued by the Minister of Agriculture and Food Industry (now the Ministry of Agriculture and Rural Development), regarding the functions, tasks, authorities, and organizational structure of the Central Plant Protection Center of the Central Region. Previous regulations contrary to this Decision are abolished.

Article 5. Responsibilities for Implementation

The Heads of the Office of the Ministry, the Director of the Personnel Department, the Director General of the Plant Protection Department, the Heads of relevant agencies and units under the Ministry, and the Director of the Central Plant Protection Center of the Central Region are responsible for implementing this Decision.
