DECREE

Prescribing the levels of preferential allowances

for persons who have rendered meritorious service to the revolution

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

BASED ON THE Ordinance on Preferential Treatment for Persons with Meritorious Service to the Revolution dated June 29, 2005;

Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,

DECREE:

Article 1. REGULATING THE standards for determining preferential allowances and subsidies for persons with meritorious service to the revolution and the levels of such allowances and subsidies

1. The standard for determining the levels of preferential allowances and subsidies for persons with meritorious service to the revolution as prescribed in this Decree is 470,000 VND.

2. ANNEXED TO this Decree are tables of preferential allowances and subsidies for each category of persons with meritorious service to the revolution, including:

a) Table No. 1: Levels of preferential allowances and subsidies for persons with meritorious service to the revolution;

b) Table No. 2: Levels of disability allowances for war invalids and persons treated as war invalids;

c) Table No. 3: Levels of disability allowances for war invalids type B.

Article 2. 1. The funding for determining the degree of disability and issuing the Disability Confirmation Certificate is allocated in the annual budget estimate of the commune in accordance with the State Budget Law and guiding documents.

THE STATE BUDGET WILL ENSURE FUNDS FOR IMPLEMENTING THE SUBSIDY AND ALLOWANCE SYSTEM AS PROVIDED IN THIS DECREE.

Article 3. Effectiveness

1. This Decree shall take effect fifteen days from the date of publication in the Official Gazette.

2. This Decree replaces Decree No. 147/2005/NĐ-CP dated November 30, 2005 of the Government regarding preferential allowances and subsidies for persons with meritorious service to the revolution.

3. The preferential allowances and subsidies stipulated in this Decree shall be implemented from January 1, 2007.

Article 4. Responsibility for Implementation

1. The Minister of Labor - Invalids and Social Affairs shall be responsible for guiding the implementation of this Decree.

2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for implementing this Decree.
